Opinion: Museveni promotes impunity in regard to disregarding court orders..

I would want some amendment to this idea making independence to be a convergence of principles of justice. We should get time and discuss it deeply. Part of the problem they(security agencies) don’t implement court decisions is that they don’t agree(with them). There is need for convergence on what is justice in some of the cases between the courts and sometimes the population. For instance, we have got a problem of land issues especially in Buganda. You have got 5000 people in a parish and a magistrate says all of you must vacate because he has agreed with the landlord. Then the RDC says they must stay on the land. What is the historical position of the Ugandan reformers( NRM), freedom fighters and you the lawyers? If we just accept that court has decided that 5000 people must vacate, the RDC will come in and say they can’t leave. We say rubbish, they can’t go. If you say independence, it is abuse of power. You are making a big injustice to the population which can cause you a security problem” – President Yoweri Tibuhurwa Kaguta Museveni (21.09.2022).

It is really special and unique for a man that has appointed all judges and has all his cronies in the Ministry of Justice and Constitutional Affairs. The President has also appointed the Minister of Security and has total control of the National Army. All parts of Law Enforcement is following his command and is imagined in his idea of security. Therefore, the mannerism of what he said is so at fault. His blaming the same people he has trusted with the Judiciary.

The second part which is really troubling is that the President of over 30 years. He has created a new Constitution and enacted dozens of laws, which images what he stands for. The President has had the power and the majority for over 30 years. That’s why the President has the laws he deserves. Museveni knows this and the laws are there because of him. They are there for one reason. He wanted them and he has amended the laws several of times, as his mind has changed or being a President for Life makes it impossible to keep the old articles.

So with that in mind. Museveni should let the Courts judge in according to the laws and their judgements after their interpretations of these laws. Museveni has ensured the Judiciary are living within these limitations and scope of enforcement. The Law Enforcement and the Authorities are bound by the laws and how they are coded. That’s why the Courts cannot order differently or act against certain laws. This is because the President and his majority party has enacted these laws. As long as these laws are active and not repealed. The Courts have to follow them and judge accordingly. That is a very simple reasoning.

A man who has held power for so long and not willing to follow the Courts. It is just disgusting. Just shows the contempt of the same laws that he has enacted. He wants the Law Enforcement and Authorities to be above the law. In such a manner, that the laws are only mattering to civilians, but not the authorities, which are supposed to following it too. This is impunity and a double standard. One law for the people, another law for the security organizations that follows my orders.

The President wants his orders and directives to be more powerful than the laws. It shows that he don’t want rule of law or constitutional order. He wants to rule by his whims and direct orders. That’s what Museveni wants and this is why he defends defying court orders. This he does because it doesn’t fit his political alignment or his tinkering at that very moment.

The President surely defies court orders as a way of punishing his enemies or dissidents. He doesn’t care about not following the law in any concern. Museveni rather have his way than actually following the laws he has enacted. As a President his wording and pompous Head of State who clearly doesn’t value the legislation he himself has ensured or enacted it. In the years in office, he could have repealed or gotten his MPs to write laws that fits his current state of mind. If he had done that, the Judiciary and the Court would have ordered things differently. However, that has never been the issue, because if he did that. He would have higher stakes with the donors and with the ones who is supporting his reign. It would be draconian and be totally disregarding the values he came into office with.

That’s why Museveni is conflicted… and the President just shows contempt of the same laws he has enacted. This is disgraceful and distasteful, but its the epitome of how his ruling the nation at this very moment in time. It is also why he never wants accountability over the “safe-houses”, the drones or any sort of misuse of power. The President wants the fear and intimidation. He wants the ability to order tyranny and use the security organizations to his advantage. That’s why he don’t value the laws or court orders. Peace.

The Final Twisted tale of Kayihura! [Officially detained at Makindye Military Barracks]

Now the General, the former Inspector General of Police Edward Kale Kayihura is now taken into custody, he is charged with the killing of AIGP Andrew Felix Kaweesi from last year. He was taken from Mbarara, the police searched the hotel in Lyantonde and even sent a military chopper to his farm. Clearly, they had planned to apprehend him. The UPDF Statement of yesterday was vague at best and the reality has hit the fan. The kingpin, the man behind the shield is now in custody.

We know they are really gone after him too, as four of his close associates is also behind bars. The men around in leadership roles within the police is now also arrested. That is serious business. Means, that the time of freedom and liberty after ended service is now all gone and the state has started its retribution. This time in the name of Kaweesi.

All of Kayihura and his crew, his farm is sealed off and the ones big-man has now lost all his spark. As he is detained at Makindye Military Prison. Certainly, the arrest of Kayihura is big and many has awaited this. The last 48 hours shows so, as he has arrested many and plenty of petty matters and used political arrests frequently. Clearly, all of the families who has seen their relatives goes punished for being political will get their prayers answered with seeing the culprit behind the matter behind bars.

Here is the new fresh reports:

“Monday night security chiefs meeting sealed Kayihura fate. The decision to arrest former IGP Kale Kayihura was made during a high level security meeting held at State House Entebbe on Monday” (PML Daily, 14.06.2018).

“Kayihura met with the Chief of Defence Forces Gen David Muhoozi at the army headquarters in Mbuya, Kampala. At Mbuya, he was interrogated for about seven hours until around 8:00pm when a heavily-guarded military convoy of military trucks escorted him to Makindye” (91.2 Crooze FM, 14.06.2018).

“Former Inspector General of Police Gen Kale Kayihura has been detained at Makindye Military Barracks. Gen Kayihura, according to Defence Spokesperson Brig Richard Karemire, was airlifted from his farm in Kashagama, Lyantonde District” (91.2 Crooze FM, 14.06.2018).

This here is really showing how his fate was sealed. The State House decided that now was the time to set it off and signal him off. Even after many years of being obedient and loyal cadre. He is now an outcast and an outlaw. His rank and profile doesn’t matter, he is no a common criminal.

All of this just settle it. The ones time a favourite of the President is now just old hot-garbage. That will get the same treatment has Kayihura has served others in his role as the IGP. He is now soon giving the same plotted downfall as we have seen with other big-men Museveni want to get rid off. This is certainly, because Kayihura knows to much and has had to much connections. That is why he has to taken down now, before he spiral off and even reveal it.

It is official, he is arrested and detained. Certainly, not what Kayihura thought would be the end of his career. Now he will answer for the brutal assassination of Kaweesi. No one anticipated that, but that is front. Since so many people have been put forward as suspects in that case. This is just the nail in the coffin of Kayihura. Peace.

The Leopards Anus is now going after the Bean Weevil!

There are something strange going-on in the Republic, the former Inspector General of Police Gen. Edward Kale Kayihura is being haunted by the authorities. The fall from grace is magnificent. It isn’t a year ago since he was awarded an award by President Yoweri Kaguta Museveni and not even a year ago since he was reappointed as the IGP. That after already serving as the IGP since 2005. However, the bucked stopped in March 2018 as the President sacked the former loyal cadre.

Today, the total has appeared, the former loyalists and kingpin, the man who has followed all orders from above is now being searched for by the Police and Military in Lyantonde. We can just wonder what sparked this and what he knows. It is just weird, just as the fall of Abdullah Kiatta of Boda Boda 2010. The fall of Kayihura is sudden out of nowhere.

The Bean Weevil surely has to fly, it has to get enough wings and get away from the Leopard. The leopard is hunting for his prey. I would expect a gazelle or buffalo, but maybe the leopard aren’t that hungry anymore.

We can certainly see that loyalty within the National Resistance Movement (NRM) isn’t worth it. As soon as your used up, get ready to be deemed criminal. The cadre who followed orders and did the needed deeds of the movement is now ready to thrown away like garbage. Because outlaws and criminals, like petty thieves. This being the former IGP of the Republic, who had the role for 13 years and was in the ear of the President. Surely, that should pay-off, instead he loses everything as soon as the title is taken away. That must hurt his pride.

He went from being regarded and respected, hated too, but also a man whose orders meant something. His choices and his appointments meant a lot for the ones who was selected by Kayihura. Now the same people are haunting him. They are hunting him and that is blessed by Leopard.

The leopard doesn’t care, he is just ready for his prey. He is ready to take the bean weevil down. The reports are the Special Force Command of Gen. Muhoozi Kainerugaba, the Presidents Guards, who has arrested him and being detained at the Seniors Officers Mess in Kololo, Kampala (NBS TV, 12.06.2018). Clearly, he must be stunned to be captured there. What the police did in Lyantonde. Who knows, but they we’re out looking for insects. So maybe they catch a few ratchet grasshoppers on the way. So that Kayihura doesn’t feel so lonely. Today, on the 13 June 2018, there are verified reports that Kayihura is now summoned to the CDF David Rubakuba Muhoozi. So there is still uncertainty, but that he is trouble, that is for sure.   

What we know by now, is that the leopard has no mercy and not even to his own. He will not leave the wounds open and leave the ones leaving the fold, without some sort of retribution. No one crosses him without being touched. This is the fall, the mighty, mighty fall. Mount Everest and down to Sea-Level.

The Leopards Anus has now taken the Bean Weevil, what is the next move? What will you do now and for what reason will you use? Is he threat? Has he kidnapped the soul of the President? What did Kayihura do?

We can only await, but surely he will not be a cadre anymore, he will be a common criminal in the hands of the authorities. The state has taken by the presidential guards. There is no turning back now. The Bean Weevil are lucky if he can escape his fate now. Peace.

Uganda Police Force: Clarification on allegations made by Bweranaho Charles against the Flying Squad (09.05.2018)

Yumbe Riot: Conflicting reports, but seemingly authorities created the havoc and it got public reactions!

What can we can conclude is that the Police Force in Yumbe District has arrested about 60 people and two individuals seriously injured (some reports dead) after bullets hit the scene. The Police Force statements and the Uganda Revenue Authority statements doesn’t add-up. While the Police are saying the URA had an enforcement operation there, the URA counter-claim it and says there was none.

However, there has imports of illegal rice in this case, that created the havoc seen today in Yumbe, as both statements refers to it. The URA legal team, who encountered the boda-bodas with it, who was stoned for interfering with it. While the Police Force are not addressing directly the illegal rice, but that URA was looking at the number plates and lack of tax on the motorcycles.

Before the crowd and masses of people rioted, burning both motorcycles and a car belonging to the Danish Aid in the town. The end of the statement clarifies that the URA was there to collect taxes on the imported rice, and that the motorcycle drivers has to pay the state. Also that URA will continue this operations in the West Nile region.

The Police has said they will engage with the Boda Boda Industry and community, as of this incident. What is special, is one saying it was not paid for the motorcycle, the URA saying it was because of the lack of taxes on imports on the motorcycle. It is a small difference, but still one. We can wonder what was the truth.

What we do know, is that the Police has arrested a dozen of people and two killed, some say they were just hurt. Hard to know what is the fact. 103.2 Open Gate FM reported this earlier in the day: “Two people are reported dead in Yumbe District following a protest by youth in the area against operations of the Uganda Revenue Authority-URA. The protests were sparked by a URA operation against unregistered bodas bodas, in the event apprehending residents in the business. The operation became sour when the URA vehicle knocked down a bodaboda cyclist, making bodabodas to become rowdy by burning several vehicles prompting police to fire bullets. URA Manager Public and Corporate Affairs, Ian Rumanyika said the Authority was cracking down on unregistered boa bodas as well as those smuggles from South Sudan without reverting tax” (103.2 Open Gate FM, 28.03.2018).

So it wasn’t a peaceful initiating, as the URA Management followed and tracked the Boda Boda down. Knocked it and the Police intervened in the operation. The report of Open Gate, also say the URA was doing both, not just stopping the smuggling from South Sudan, but also look into the tags, which hadn’t paid tax. Secondly, they are saying that the URA team drove after the Boda Boda and actually knocked one down. That isn’t just fining and taking the tags, not only checking the products or rice, but actually nearly impounding it. This has been done without forewarning or local knowledge. If not this wouldn’t have happen.

So the URA are now combating illegal imports and also unregistered boda boda’s. Clearly, there have to be better methods, since this became violent, and the following after and knocking down. Was a final spark, since the URA Management created havoc on the way and than the Police intervened with guns, as the youth was throwing stones. When the violent activity transpired they addressed it with throwing stones and also burning cars.

Whatever it was, it shows the lack of oversight and the lack of basic understanding. It is natural for a state to tax imports, also serve taxes on plates, yearly pay for being able to drive on the roads. Both actions are normal, but if the URA Management did the right thing, if the Police Force did the same. Can be questioned and should be.

What should also be asked, would there be a better way to collect the missed tax and also secure the porous border points, so the Boda Boda can pay the levies when entering into Uganda again. Secondly, the URA should be able to notify the drivers of their missing payments and not knock them down for doing so.

We will see with time, if the stories are changing or if they will stay the same. However, this is worrying sight of the state of affairs. When collecting taxes becomes a stand-off, you know something is wrong. Peace.
