Latest Update from Makindye Magistrate Court – Good News: “Non-Cash Bond”!

The great news from the Makindye Magistrate Court have finally given a verdict a Non-Cash Bond of 5 Million shillings. So the rumors were wrong even if the ordinary Modus Operandi would be to detain the Fellow FDC Activist.

“Suspects rounded up Tuesday as they attempted to hold FDC prayers granted UGX5 million non-cash and UGX20m non-cash for sureties” (NBS TV Uganda, 04.05. 2016).

Asuman Basalirwa said this in court: “The court needs to protect individual rights and prevent lawlessness. This adversely strains their welfare .Its Ironical that the same state who,s motto is For God and My Country is holdings citizens for praying. Bail should not be refused mechanically”.

So there are hope, but if the demonstrations happen tomorrow, don’t be surprised if the same fellows will be back in custody of the Police. Because they will use all force stop the FDC from demonstrating. Therefore they have house-arrested Dr. Kizza Besigye again! Peace.

Yet again, we can see the compound of Dr. Kizza Besigye the Presidential Candidate of Forum for Democratic Change in the February 2016 General Election. He set under house-arrest while fellow activists are in Makindye Magistrate Court. IGP Kayihura promised this yesterday when he said he “would monitor” him again. That means closing his gates and all of his movement, as they have done 40 days before in this calendar year alone! This is the only Steady Progress that National Resistance Movement have the ability to deliver. That being making a fellow citizen home into a prision. Peace.

The Men and Woman who was detained yesterday for attending the FDC Tuesday Prayers are charged with contempt of Court Order. That Court Order is the Interim Order of banning of the Defiance Campaign of 29th April of Deputy Justice Stephen Kavuma. The 29 Activist have deemed themselves not guilty. Amongst them are Dr. Stella Nyanzi, Lord Mayor Erias Lukwago and Pastor Happy David Ngabo.

Think that is enough for now. It seems like the rumours was justified and that the Opposition activist, Leaders and others was deemed to be detained as the NRM Regime continues to strive for excellence of forging the power. Seeming likely that they will be denied bail and continue to be detained and under Police Custody. Peace.

Update: 

All six suspects charged in Kiira Court for DEFIANCE have been released after paying UGX 1.8M in bail fees. So the FDC Activists there was atlest released, but the tale of the Campaign of Defiance is not yet over. It is just starting.

Besigye defends continued defiance campaign despite Deputy Chief Justice Kavuma’s court order (Youtube-Clip)

“The former Forum for Democratic Change presidential candidate, Dr.Kizza Besigye, has spoken out in defence of his campaign of defiance after the police moved to block him from going to the opposition party’s offices at Najjankankumbi to attended prayers organised as part of protest against the results of February Presidential elections” (NTV Uganda, 2016).

IGP Kayihura have set Besigye under House-Arrest again today; This comes as a result of the defying the Interim Orders of the banned Defiance Campaign!

After a few days of ability too move freely the buck stops and the Police Force have again sieged the Kasangati compound of Dr. Kizza Besigye the former Presidential Candidate of Forum for Democratic Change. This comes after the FDC have shunned the Interim Order of 29th April as they planned to pray at their offices for the future of the country. “For God and For Country” this is illegal by the maneuvers of the Police today.

So that the Police Force already had taken many of major leaders and affiliated FDC members around the FDC Headquarters in Najjankumbi in Kampala. As I have taken notes on earlier today. But the movement from the Police to seal of the compound of Dr. Kizza Besigye is the latest, not surprising as the Police have a special unit soon made for him alone.

Dr. Kizza Besigye is yet again not allowed to have a life and be an ordinary person as IGP Kale Kayihura and his Police Force together with DPC Kasangati James Kawalya will make sure that he does not leave the compound; yet again!

This is just a mockery of justice as the Interim Orders made by the Deputy Justice Steven Kavuma/Stephen Kavuma is not justified.

As these orders from both the Deputy Justice and the Inspectorate General of Police have breached this two articles of the Uganda Constitution of 1995:

“27.    Right to privacy of person, home and other property.

1)     No person shall be subjected to—

(b)       unlawful entry by others of the premises of that person.

(2)     No person shall be subjected to interference with the privacy of

that person’s home, correspondence, communication or other property”

That is not what the State does when they are interfering with the communication and the correspondence of the actions of Dr. Kizza Besigye, they are breaching it again and again. To a point that this passage of the Constitution is useless, because Besigye is not allowed to walk out or be part of Political Party by the orders of Police chief today. Here is what piece of legislation that the Police Force is breaching when they stop the administration:

29.   Protection of freedom of conscience, expression, movement, religion, assembly and association.

(1)    Every person shall have the right to—

(c)       freedom to practise any religion and manifest such practice which shall include the right to belong to and participate in the practices of any religious body or organisation in a manner consistent with this Constitution

(d)       freedom to assemble and to demonstrate together with others peacefully and unarmed and to petition; and 

e) freedom of association which shall include the freedom to form and join associations or unions, including trade unions and political and other civic organization”.

So with these breaches and the stops proves how little both the value of the constitution of 1995 is right now for the NRM Regime, as they can take these rights away every time it is needed or can help them to shut down the opposition. The FDC is now practically a unlawful organization who is not allowed to function or have their Political work in the country.

Because they are not allowed to pray, that is part of the “freedom to practice” as every person supposed to have the right too.. the same right is to demonstrate, or the ENGLISH different where I am from and the ones that Stephen Kavuma and Kale Kayihura is reading. They are might learned in specialized and coded English that says something else than what I am reading, because the constitution is the LAW that supposed to set the BAR and level for Justice in a country. Henceforth the Constitution of Uganda, the Constitutional law of the nation. The Republic and the Constitution that gives the land the rule of law; and gives the rights to the citizens, so they can be lawful persons and make sure that the government does not act unjust towards them!

This action today is again and again taken the opportunity to House Arrest Dr. Kizza Besigye while the NRM Regime, their Police State and the reality of the thieving regime does not even honor the laws they got credit to make 21 years ago. The Police Force does not care about the general laws, they use the Public Order Management Act and the other laws that fits the authorities, even if they does not work in the manner the Constitution sets the precedence for the legal authority and the rights a civilian or citizen might have. Something that Dr. Kizza Besigye supposed to have and is now again taken away. Peace.

“The police have returned to the home of former FDC presidential candidate Dr. Kizza Besigye to restrict his movements again, a few weeks after they ended a 47-day siege on the home. Inspector General of Police General Kale Kayihura told journalists that Dr. Besigye will be confined at his home in Kasangati, Wakiso district with effect from today until further notice. The police chief asked Besigye and his FC party to drop the defiance campaign which breaches last week’s ruling by Deputy Chief Justice Steven Kavuma that banned FDC activities for four weeks” (NTV Uganda, 2016)

My letter to Deputy Chief Justice Stephen Kavuma after yesterday’s Interim Order banning the Defiance Campaign of the FDC

Dear Deputy Chief Justice Stephen Kavuma!

You have raised the bar honourable judge, then I don’t talk about the amount of Nile brew you might poured down during the last judicial year. I write to you Sir regarding the assessment you made yesterday. As you said this:

“”An interim order doth issue against the 1st [Forum for Democratic Change] and 2nd [Kizza Besigye] respondents, their agents officials, supporters or any other person acting under their authority from engaging in demonstrations, processions, other public meetings, media campaigns or pronouncements including but not limited to the planned demonstration or procession scheduled for 5th of May 2016 or any other day in furtherance of the defiance campaigning pending hearing and determination of the main application for temporary injunction,”  Stephen Kavuma said.

I know you must have had hard time lately, not been able to walk to the Workers house on the 9th Floor and eating with younger girls there lately. Time is a wasting, right? There are limited amount of time we’re living so time use sound reasoning Sir.

I have a hard time calling you Sir, as you have done something foolish. You have given an interim order that have stopped the grand party of FDC and their operation initially illegal. As the National RESISTANCE MOVEMENT can do what they like? Do you have problem that the country is run by the Resistance?

Defiance means defying and being disobedience. So honourable judge you have to have an interim order against any kind of teen-ager who is disobedient to their parents, because they usually defy their parents; neither if the kid is right or wrong them still do it. I propose you write a decree on Monday. This would be seen as being loyal to the Interim order of 29th April 2016.

While the resisting or resistance is from a Latin resistentia and meaning to Hold Back. So there are similarities between the disobedience and towards the men who hold back. And then my honour what is the full meaning of a Resistance Movement you might wonder:

“(also resistance movement)A secret organization resisting authority, especially in an occupied country: he went underground and joined the resistance’” (Oxford).

The NRM is not an secret organization though the accountability of it is lacking. As we know and you Sir Kavuma. But by your interim order against the defiance campaign you have initially made the Resistance illegal to. That means that you need to force and order of the secret running organisation that is resisting authority and holding back. Even resistance means that you’re a narrow-minded who doesn’t want’s change. As the resistance is used as refusing to comply to the orders or laws. Henceforth creating a Resistance Movement to build, which would be a loyal group working against the authorities to resist them and holding them back.

For me your honourable judge for the judgement is ridiculous in the sense. If made an interim order where you ban building boulevards, then you can’t build roads, could you? As a Boulevard is a thicker road with certain adjustments, while a road is something leading from A-B, but the same could be said about the Boulevard as well.

It is the same kind of mixture between the words of Defiance and Resistance honourable judge. Therefore as a sane man I hope you are and that you have your reasoning intact, a clear mind and does as your duty preside. To either abolish the order and say you did in a layman’s term a “Boo-Bo”. If you don’t do that you should as an honourable man do something about this Resistance and their will of holding back from authorities. They have to be stopped and should be hold in the same regard as the ones behind the Defiance campaign.

So the new interim order must be to change the NRM as they are spreading the same kind of venom and unfairness towards authorities with sounded mind like you Honourable Kavuma. I know that won’t happen as you want to be loyal to the pay-check and His Excellency who appointed you. Therefore to show him his honour you validated that with decreeing this interim order yesterday despite the lacking moral and linguistic authority to pull it off. As you will now be remembered for determined order to stop the FDC and their Defiance Campaign.

You should mind that this shows your value of your judgement judge. The interim order will be the landmark, the moment that you earned your coins in favour of the President Museveni, but not of the rest of the land. You have showed that you stand for empty principals and do not consider the real implications for your loyalty to the Resistance that is a narrow-minded man who doesn’t want change. That must be very bad, as I hope you have health coverage in Nairobi as the Mulago Hospital under current leadership is not that well-funded of late. So please honourable judge ask for coins to pay for your foreign health care visits in the near future as recite for your token of loyalty.
