
I wonder, not that this is new in the Republic, because this sort of treatment has been standardized under the Inspector General Kale Kayihura. Even him himself is without charges in detention without convictions or without proper charges as we speak. This is happening under the new IGP Martin Okoth-Ochola, who is following the same regime apparently.
Why I am asking? Is because Robert Kyagulanyi aka Bobi Wine, Paul Mwiru and Francis Zaake, together with Kasiano Wadri, whose been in detention and without reach since their arrests by Special Force Command on the 13th August 2018. They have all been taken by the authorities and we don’t know why.
The Criminal Procedure Act of 1950 section 17, which is still in force states this: “17. Detention of persons arrested without warrant. When any person has been taken into custody without a warrant for an offence other than murder, treason or rape, the officer in charge of the police station to which the person is brought may in any case and shall, if it does not appear practicable to bring the person before an appropriate magistrate’s court within twenty-four hours after he or she was so taken into custody, inquire into the case, and, unless the offence appears to the officer to be of a serious nature, release the person on his or her executing a bond, with or without sureties, for a reasonable amount to appear before a magistrate’s court at a time and place to be named in the bond; but where any person is retained in custody, he or she shall be brought before a magistrate’s court as soon as practicable. An officer in charge of a police station may discharge a person arrested on suspicion on any charge when, after due police inquiry, insufficient evidence is, in his or her opinion, disclosed on which to proceed with a charge” (Criminal Procedure Act of 1950).
So it is not like there are laws to this. But as the spin has gone, most likely the Criminal Procedure isn’t as important as the Penal Code Act of 1950 subsection 24, which states: “24. Penalty for acts intended to alarm, annoy or ridicule the President. Any person who, with intent to alarm or annoy or ridicule the President— (a) wilfully throws any matter or substance at or upon the person of the President; (b) wilfully strikes the person of the President; or (c) assaults or wrongfully restrains the person of the President, commits an offence and is liable to imprisonment for life” (Penal Code Act of 1950).
Clearly, as today’s defense of the “attack” on the Presidential Convoy, the military and police will with force use this against the gentlemen. Even if the driver of Bobi Wine is dead and the others was taken hostage and arrested directly at the hotel in Arua. As this was the final of campaigns before today’s poll in this By-Election.
This shows how dire and how much hurt the President is putting people through, he can make these men go to jail for life, just because he has the power and wants to send a message. No one, not Besigye nor Bobi Wine has any rights. Only him, he didn’t fight in the Bush to give other people freedom, he fought only for his freedoms.
That is evident, as the malicious and forged crimes are put on anyone who causes a threat or a stir in the eyes of the President. That is why its okay for the Special Force Command to aim and shoot at the car of Bobi Wine, but they are in legal jeopardy because of spin-control case of destroyed vehicle, which have been dipping through traffic in Kampala later today. That has been evident by all the photos on Social Media.
We can now wonder, what sort of charges, what sort of trial and when these MPs will see the light of day. What sort of custody or even state of health, as the state are barring anyone from seeing them. They can be at a military barracks or even in a long forgotten jail in Arua or Gulu.
We only know that the state has them for over 48 hours, been beaten by the Presidential Guards and now in limbo, both physically and legally. The only one living and breathing without any care is the President. Who always put charges on other people, but are never to blame. Even when he shoots live bullets at unarmed civilians. That is just the way he is and how little he care for his own citizens. Peace.
