Opinion: Did the State House breach article 192 of the Constitution with the takeover of Nairobi County?

State House issued a statement late Tuesday stating that Sonko had signed off to surrender Health, Transport, Public Works and Planning. “In a landmark agreement signed at State House today (Tuesday), Governor Mike Mbuvi Sonko and Devolution Cabinet Secretary Eugene Wamalwa in concurrence with H.E President Uhuru Kenyatta, signed an agreement, handing over functions of the Nairobi County Government to the National Government, pursuant to Article 187 of the Constitution,” the statement by State House Spokeswoman Kanze Dena said. The signing of the agreement was witnessed by the Speaker of the Senate, Kenneth Lusaka and Attorney General Paul Kihara, she added, “This will ensure Nairobi residents receive services efficiently.” (Capital FM – ‘Uhuru rescues Nairobi from Sonko’ 25.02.2020).

Seemingly, the biggest news other than locusts and coronavirus is that Governor Mike Sonko has signed off parts of his Nairobi City Council or Nairobi City County to the Central Government of Kenya. This was done with a big presser and hoopla at the State House. As the President, the Cabinet Secretary and Governor all convened together. However, are there some missing pieces?

Yes. For my part there is no emergency nor internal conflict. Neither war. There has also been no report from nay independent commission who has authorised a takeover. There are allegations of maladministration and corruption against the governor and his government. However, his not yet sentenced or detained. His been charged and the state is building a case against him. That is bad enough, Sonko is a target and has to answer for his misgivings.

However, the lack of certain things, make it natural to question the takeover. Also, the Senate didn’t authorise the takeover. Therefore, there are too many things lacking in the provisions of the constitution to allow the takeover. Just read the article itself.

Kenya Constitution 192. Suspension of a county government:

(1) The President may suspend a county government–

(a) in an emergency arising out of internal conflict or war;

or

(b) in any other exceptional circumstances.

(2) A county government shall not be suspended under clause (1) (b) unless an independent commission of inquiry has investigated allegations against the county government, the President is satisfied that the allegations are justified and the Senate has authorised the suspension.

(3) During a suspension under this Article, arrangements shall be made for the performance of the functions of a county government in accordance with an Act of Parliament.

(4) The Senate may at any time terminate the suspension.

(5) A suspension under this Article shall not extend beyond a period of ninety days.

(6) On the expiry of the period provided for under clause (5), elections for the relevant county government shall be held” (Constitution of Kenya 2010).

NAIROBI, Kenya Feb 27 – The Senate has summoned Devolution Cabinet Secretary Eugene Wamalwa, Attorney General Kihara Kariuki and the Chairperson of the Council of Governors Wycliffe Oparanya over the Nairobi take-over by the national government. Senate Deputy Speaker Kindiki Kithure issued the orders on Wednesday afternoon directing that the hearings should be jointly done by the Devolution and Justice and Legal Affairs Committees” (Capital FM – ‘Senate sharply divided on legality of Nairobi take-over’ 27.02.2020).

So, that the Senate is also questioning the operation made by the State House. As they are supposed too. They were by the provisions in the article 192 in the Constitution clear message to the lawmakers. This could be taken down by the merit and lack of protocol.

Not like it is a war-zone either in Nairobi. Maybe a downward spiral in jobs and financial security for plenty of its citizens. Nevertheless, the state cannot just issue this. Sonko might did as a private trade to save his political career. Still, that doesn’t save the act. Especially, if the state cares about the articles in the Constitution.

That is why I could just with pin-pointing the guidelines to the suspension of a county government is supposed to be validate. Which was clearly not done. If it was, then the Senate wouldn’t call in the people who signed off Nairobi to the State House. Peace.

Opinion: Are we seeing a possible purge on the TangaTanga?

There are now speculations that the Senator Kipchumba Murkomen will be purged from his position as the Senate Majority Leader and become a backbencher with his other 9 compatriots, who voted to save the Governorship of Ferdinand Waititu yesterday, which it didn’t. The ones aligned with the President and Odinga, all voted for the impeachment and won.

Therefore, its now talk of the town that Jubilee’s own Secretary General Rapahel Tuju will takeover the post from Murkomen a strong ally of the Deputy President William Ruto. We are seeing already the rift between the TangaTanga associates of Ruto and the other President’s men. The TangaTanga are seemingly voting and acting like opposition. Even as they are ironically part of the government party.

However, the Orange Democratic Movement (ODM) and other leading parties, which are part of the defunct National Super Alliance (NASA) are voting with the government and for the government. They are even holding rallies, press conferences, all in accordance with the government and their collective work of the Building Bridges Initiative (BBI). You cannot make this up.

The Jubilee consist of the faction with the President Uhuru Kenyatta and Ruto’s TangaTanga. The TangaTanga should if these things go on. Just do themselves a favour and split from Jubilee. Go back to the party structure previous to the second term of Jubilee. Because right now, the battle in between is getting hectic. As the Jubilee is dismissing the TangaTanga and also favouring the line of the opposition Raila Odinga. Which must hurt the pride of the DP and his disciples. As they are fair-game, as a punishment for not openly endorsing the BBI from the get-go.

That is how it seems from afar, as the verdict is still out. However, there are actions being made and wordings coming out too. Showing that the TangaTanga is hurt and they are also directing their fingers at Odinga, not at Kenyatta. Which in itself is ironic, as their mate and boss is the one who sanctioned and gave life by the government to the BBI in the first place. Not like Kenyatta isn’t the man who gave way for it and bought peace between them. By also in some way silencing the opposition, as they are in-directly working with a mission together with the state.

That’s why TangaTanga, DP Ruto and his associates feels left behind and lost. They are not directly part of the BBI. They are part of the Jubilee, supposed connected with the President. But he seems to think they are fair game too. As he haven’t stopped it. Just like he didn’t stop sen. James Orengo from taking over for sen. Moses Wetan’gula as the Minority Leader in the Senate last year. That was a token of support from the President, while the disloyal cadre got punished.

We can just wonder how this will go, but the purge might happen. There might be more associates of DP Ruto, which the President and his men is aiming for. To prove to Ruto that a 2022 ambition is fruitless and no one around him will support that. However, are they then supporting the dynasty of Odinga now?

That would really be weird, but the whole BBI and the whole set-up is a blended miss-match and doesn’t make sense. Nevertheless, they still act upon it and the consequences are already there. Peace.

Opinion: CS Mwangi Kiunjuri axed today

Well, Mr. Take a Photo of Locust and post on it Social Media, then the professionals at the Ministry of Agriculture and Irrigation statement the other in the media. This is the man who was reshuffled away or axed from the Kenyatta Cabinet on the 14th January 2020. Not that its deserving to sack CS Mwangi Kiunjuri.

But, his a long-term ally of Deputy President William Ruto. A man who help to intimidate witnesses for the ICC case of the ones in power. CS Kiunjuri was first the CS for Devolution and Planning for two years, until he was appointed on the 26th January 2018 as the CS for Agriculture and Irrigation. So, he got close to two years there too, but this time his out and no new deployment.

That is why his axed. The man of the Maize, Sugar, Rice, Tea and Coffee Cartels. As his helped them and been a cushion for them. Ensured their enrichment over the farmers, while they use the National Cereals and Produce Board (NCPB) to give favourable deals between traders over farmers. Therefore, the cartels and inside trading benefits the traders, not the farmers.

That is why the golfer, the long time MP and CS didn’t do his work properly. He surely has enrichen himself as an MP. As he got over 700 million shillings over the years in Parliament. While, he has gotten connections with Ruto and others. His been part of dam scandals and others, where he surely gotten something sweet.

With the two years as CS of Agriculture, he most likely found some ways to his pockets too. That is why he will miss the bargain of being there. As he could ensure the rotting cereals, while importing UNGA, Sugar and whatnot else for the benefit of the cartels. Since, the pricing of the state would maybe not be beneficial of the ones there.

Now, the man has fallen, but not expect changes in the Ministry. That’s a fools hope at this point. There was no big change in Bett and will be little or nothing with the next. Only a new face and soon new scandals involving farming goods. Just await a sugar, tea, coffee or such scandal in a few months time. It is inevitable.

Kiunjuri might be a useless minister, but he knew how to keep the cartels mobilized and secure them funds. So, that they could oil the political machinery in parliament and the patrons of the industries. That is what it does and will continue. There are two many big-men eating of this plate to stop it. It is too much at stake, that is why the DCI and whatnot else doesn’t investigate it. They just let it go.

Now, Kiunjuri is let go. It is not a sad day, maybe for the Cartels, but they will get a new puppet under a new name and flag. This revolution will not be televised, but experienced in homes across the Republic. As the Maize, Sugar, Coffee, Tea and Rice will be used as a tool by the cartels, as there is no interest stopping them.

Not under Kiunjuri, not under Bett and whatever the new CS is. It will not happen, only go skin-deep if only so. Peace.
