Dear His Excellency Yoweri Kaguta Museveni!

I write to you again as the Uganda Police Force is busy with rounding up and detaining all of these men and woman who are either parts of the leadership in the Forum for Democratic Change (FDC) or members of this Opposition Party. I am sure you heard words on the men and women who are detained on your word, after a loyal judge Stephen Kavuma written-up an interim order of the ban of Defiance in the land.

I know you are preoccupied with making the best and controlled Swearing-In ceremony as possible, while your henchmen and made-men are making their effort to silence all other opposition that can make you look foolish through international press. There are rumours of shutting down social media and banning Facebook and Twitter totally on 12th May 2016. Just as you did in on the Election Day in February in 2016; so you can have the control and send the message that you want the world and your citizens to hear, not some words like mine.

I know I have written hard about you and your regime, and it is been justified. The Justification is now clear as the Opposition are being detained in their homes and even charged with terrorism and getting objectionable charges to spread fear and control the rest of the population; as nobody want to be taken away without their family members knowledge or being detained without warrants or reasons for their custody in the hands of the men of the law.

There are reasons for those actions, you are worried Mzee, you are worried for how these opposition members and leaders can spread the news and views on how society should be. I am talking about this, Mee, a Ugandan society where you doesn’t detail control or usher in the leadership as you do now. Just as you did with the Swearing-In of High Court judges on the Entebbe State House steps earlier today and later in the day had meeting with Kampala NRM Councillors who we’re asking for guidance and their roles under you.

As you are the president, the people are yours and they are supposed to follow you blindly. You are the men with vision and they don’t have the vision as you. At that point your right Mzee, they don’t have the vision as you anymore. You have deflected and neglected them and forgotten what the State does and what a Statesmen are supposed to do. A leader is supposed to groom succession and people who are taking over and have the ability to make better result than him. That is succession you have forgotten as the power have totally eaten your soul up and your family up.

The legacy you leaves is not that you ushered Uganda out of dictatorship, you will be remembered for trying to liberate the Ugandans and ending up being the same as before, only difference you got 30 years of rule, while they got one or lucky two terms in power. Dr. Milton Obote and you is much of the same. Idi Amin Dada and you are much of the same as you use Spies and Safe-houses to keep the opposition silent. You use the army to hold the people intimidated and you have rigged the elections. You’re much of the same of the men you took down. Now you are the same as the man you got rid of together with President Nyerere and Obote to Coup D’état the Amin regime. You are now the same as him and Obote, you may not have the absolute killings of Amin, but you have and left many men in shadow and gotten rid of your enemies. Mzee you have done silently and over time, as they had shorter time and fewer morals. Because you started doing it in bush as guerrilla and being a liberation movement gives you an edge; a momentum to give you space to do as you like.

Your Army leaders and your Inspector General of Police follows you decrees and orders to word and execute them with brutal perfection as the Courts are diving into the lawful behaviour you have built up. As the economic malpractices you accept as you can skim the top and make giant funds for the generations of Museveni’s to come. Instead of these funds used to build government institutions as you we’re supposed to do. A forgotten practise and forgotten procedure from your chambers as the embezzlement and the cleaning the coffers so that the men and woman working closest to you can get “free Toyata LandCruiser Prado” to they want to follow your orders. That is why the Regional District Commanders gotten new cars days before the Election and the same with other men who you wanted to silence.

But the money for the Cars and other gifts to get loyalty have to come somewhere… they happen to come from the government funds that was supposed to keep the upkeep of schools and hospitals, but they doesn’t give you loyalty as much as the Police Commanders and Army Leaders who sufficiently keeps the civilians and citizens under tight control. Therefore they have to be paid first and the other can scatter. Mzee, the gig is up and your mind should have been preoccupied by baby-sitting grand-children and not detaining Forum for Democratic Change leadership and activist around the country for phony charges. You should be busy serving matooki to fellow family members not finding new ways of thieving money from the budget of 2016/2017 fiscal year.

Mzee, there is time to step back and give way to new leadership. I know it is not easy as you are making ready to swear yourself in to 7th Term, to run the country in the 30 years to the 35 years in Power and Control the State, the Republic and the Kingdoms of Uganda. You have had your hour.

You have had the ability to sell the vision of liberation, but now you’re following the steps of leaders you left behind and beaten with either force or tricks. And you know this as Dr. Paul Ssemongerere could have told the effects of your leadership and what it did to his opportunities to topple you in a peaceful manner… But that train has gone as so many former leaders and men fallen in your time, therefore the President that was new breed with you are either gone or become totalitarian as you. You know Mzee and feel the sting as you are not as respected and honoured as you we’re. That is your own making Mzee and the actions of latest years proves the control and the state of affairs you delivered. Not the ones promised, but the ones you found feasible as it gives you Power and let you keep that.

You can imagine the tales and stories you could have told if you had already left office to somebody else and left in peace. Instead you’re clinging onto Power without question and without impunity. Leaving scourged earth and detained citizens for their political affiliation and not for killings or thieving as the normal prison population have. Mzee the tales are told and your name is now synonymous with dictatorship, dictator, totalitarian, Police State and Oppression of Opposition. Your name does not cling anymore more with liberation, freedom, liberty, freedom of speech, democratic values, progress or industrialization. That must be downer, I know your YES-MEN and LOYAL Cronies would say this to you, but I will, because I don’t fear being thrown into jail or being beaten by your Police Force while trying to get a pass from the Police Officer to be allowed to walk to work. That is something I don’t need as I live in a free society.

Mzee, His Excellency Yoweri Kaguta Museveni, I know you would never read this, but hope some of your Citizens does and that it makes them think a second. As the FDC Leader/Activists/Members are detained because of the word “Defiance” and their campaign as a viable Political Party in the country, Mzee, that was not expected of you and your regime.

That your battle against Defiance comes from the man who have proclaimed Resistance, is just mind boggling and feels like mockery of a dictionary. And you know that Mr. President as you are former student at a Tanzanian University in the 1970s. That is why you went from Patriotic Movement to Resistance Movement over time. You did it with a reason back-in-day. You Mr. President have might forget this and the value of the state of affairs you’re in charge of. So the end-game is now that you are in charge of a state apparatus that have a ‘Modus Operandi’ to detain fellow citizens with impunity and take them from their homes in the name of “Defiance” and shut down a Political Party as the Swearing-In day is coming up the 12th May 2016. I never though a man would sink this low to stay in Power… but you have and scores of detained are over 200 men and woman, and that is the few I can calculate, and not the current I haven’t heard of yet. The liability and the feasibility of these actions cannot be strengthening the Nation or your Rule. You are the Commander-In-Chief and the Executive, Mr President and you are without questions arresting fellow citizens for their political place and not on direct crimes.

You wanted to be the kingmaker, the Nyerere of your time, you wanted to be the man people remembered with nostalgia and honour like Mandela, instead you and President Mugabe will not be remembered for the liberation of the countries from tyranny, but will be remembered for the liberators who turned into the worse Tyrants then ones before them. Why? Because you knew the pain and the suffering under the men and woman before you; an you knew the heart-breaking defeat and discouraging election rigging, still your machinery does now the same to fellow citizens of the country. So President Yoweri Kaguta Museveni, the tale and the mercy of the land, the oppression and the dictations of orders from you to uphold the rule and control of the land have in the eaten all of the things that could have made you great. Instead you’re the cancer and the one that kills the institution and opportunity to rebuild and create a better future for the Ugandan nation. You embezzle and oppress people, get state to silence the media and stops the truth from being free, as the truth is hidden the lies that comes from the State House and is the official communique the State gives out. My honest letter to President Museveni – “It cannot be easy…” (06.05.2016)

Dear His Exellency President Yoweri Kaguta Museveni!

I know you are touchy now-a-days it can’t be that easy being you. You have your Army and Police Force enforced on the people you are supposed to represent. Mr. President you have hired French speaking soldiers to deploy safety before the swearing-in, while there is a court-order about suspending the planned Swearing-In. While the Forum for Democratic Change and other Opposition continues to hustle in your backyard. You can’t have that right, it is your playground.

What is worse is that the American and European Union is not kissing your hand and respecting you as they used too. They used to say you we’re the proud future of African Leaders, the fresh new blood. Back in the day in early 1990s the then American President Bill Clinton praised you as the “New Breed” of African Leadership. Since you we’re not the same as the lingering leaders like Mobutu Sese Seko of then Zaire (Now Democratic Republic of Congo).

It can’t be easy to be you, you had the potential and the opportunity to leave a legacy of hope and democratic progress, even if you really we’re not really for it. Because you wanted to control the processes through the Resistance Councils instead of the now District and Local Government Councils around the Ugandan Country; and all of them are not directly loyal too you and the party line you have created in the National Resistance Movement.

And now after the hectic elections and the tides are turning. The old-friends from the West isn’t supporting your cause and your actions. That hurts you as you are the old-man with the hand and the only one with a Vision to Lead the Ugandan Republic. As you have taken it from the British Enclave into the Less-Developed Country (LDC) it is today.

Then all the international pundits that comments on the internal activities of your government, the way you want to control all parts of the political map as you have paid of Jimmy Akena and the Uganda People’s Congress (UPC) and disfranchised the Democratic Party. While not able to play the Forum for Democratic Change as they have been steadfast and countered your moves. They make your life so hectic and distress at every move, as they are supposed to respect you authority just as Hon. Akena do!

You’re supposed to be an honourable statesman by now. Instead you’re a Political Piranha for the international community who are tarnishing your name and rule. They are supposed to respect that you uses the army to intimidate the citizens, the citizens who are supposed to be sensitised under your understanding. As much they want to give you money to develop the Crude-Oil drilling and Pipeline to the Tanga Port in Tanzania. The International Community is supposed to salute you for the industrial feet of taking the dinosaur-remains or even fossil-fuel to drive the vehicles that our cars use.

It can’t be easy for you, Mr. President your questioned and become tarnished by the international community; who back-in-the-day called you the future and the New Breed. Though the ones that praised are long gone or is busy trying to get their wife [Hillary Clinton] elected in the Democratic Party in United States.

It can’t be easy for you, Mr. President that they are slashing the limited monies for the peacekeeping operations in Somalia and Central African Republic while you send troops there and keeps Mogadishu and other parts C.A.R. under some kind of control. While the United States and the European Union, condemns your internal wrangles that is not territory or their jurisdiction.

So you are hurt and feel the need to patch your hurt. Therefore as a tiny token from an adversary of you. It is time to see that you are not the new Breed as much as Butros Butros Gali of the United Nations does not have the same space for you as before. You we’re the beacon of hope, the man people looked up as they saw you as the man who beat dictatorship and created a new political landscape. What happen to you Mr. President?

It cannot be easy to see the devalued you have become, the easy way these foreign missions and elections observes says your rule it is not credible or genuine as you have dealt with school elections since your younger days at Ntare School. They don’t understand democracy as you do. These foreigners don’t understand how your handpicked men can represent the people’s will of Uganda, which is initially yours.

You have the audacity not only to house-arrest your opposition, but monitor and deny entrance to where they live. That means that your Police Force denies entry into where they live like today with Winnie Byanyima the wife Dr. Kizza Besigye was denied to go home. That is why it isn’t easy to be you.

That is big thing for you and your reputation yet again.

Not that it’s your first or last lie in the public. They come and go as it is not easy to rule and be honest, transparent and also responsible at the same time. As you have proven to the public and to the people from time to time; like you had no idea what happen in Rwanda and if the Rwanda Patriotic Army had any involvement around 1993-1994. Your armies had nothing to do in the end of first and second war in Democratic Republic of Congo. Even if you with pride after is said about yourself to be a kingmaker! You Mr. President is the Kingmaker who have made way for Paul Kagame, Laurent Kabila, Joseph Kabila and sometimes take your giant wings to support Pierre Nkurunziza, the same you did for Salva Kiir Mayardit as well.

So it is not easy to you nowadays as the Opposition have the support of International Community as you have lingered in power and taken the Ugandan People for granted. They expected something else of you. As you have yourself learned the lessons of Frantz Fanon who told that a leader couldn’t control the population, but only have true support if they are behind them; you couldn’t force them to support a leader, that wouldn’t work. But you know this you wrote about this in a thesis at the University of Dar-es-Salaam in Tanzania.

I am sure Mr. President that you never thought the world would come so quickly to door-step, that the words of your mouth would go further than Lira and Nairobi when talking to the press in Kampala or Mbarara. Instead now with this Social Media that you dislike with a passion, because you can’t control what people say and do. Something you prefer as you want to control and lead people, not make people lead you. As you Mr. President are the man-with-the-vision, not the man who has to listen. That is why you talk wild about the media and was so attacking on the Daily Nation and the NTV Uganda.

I say that Mr. President because of the actions of recent years proves that the opening of Multi-Party system was just to silence the International Community and keep them pumping up your national budget and to fill your coffers. We know that now and therefore condemn you.

Mr. President not easy to pull out of Somalia and the Central African Republic as the funds and the loyalty showed have been given your government useful foreign exchange, even if the funds from European Union and United States government have dwindled time as the Kenyan also taken parts of action as well and after President Moi been out of office, the continued relationship between U.S. and them have become better. Something you now and it makes your mind boggle on the farm.

Opinion: Human Rights versus National Security is B.S. when spoken about in Ugandan context right now!

Let me clear this is my view and not a general view as there might be seen as fellow counterparts have the same. There is hard to have peace, a general peace and neutral peace when fellow citizens are made enemies. You can’t have in a territory both enemies and neutrals. That doesn’t work, as the enemies of the state will be hunted down at one point. Something that happens as the National Security values will counter to bring down the enemies.

When you have come to the Point as you have made the Opposition to the worst enemies in country and therefore want’s to crush them. In a nation where the Ruling Party set the standard and have the rights first, the Human rights will be the norm. As the newest law that strengthen the government power instead of giving more back to the citizens. Citizens get quicker behind bars for nothing with the new laws; also with keeping the old laws from Colonial times gives the Police possibility to Preventative arrests and even detain without court order within 24 hours. Something that the Opposition parties have felt time and time again.

The initial ones that are saying that the National Security goes before the Human Rights are the ruling elite who earn the money by running the system. The Ruling Elite does not want to the system to change as they earn massive profits on it. Why change something that is currently working right? Well, is it? When you have to prosecute and make fellow citizens criminals, opposition members, opposition leaders from Councilors to Members of Parliament, that happens without questions and that is not a healthy society.

This way of working is making the opposition criminal and their activity criminal. That the society nearly or bravely saying assembles them for prayers are illegal says something of what that rule of law in the country. And it is illegal since it is a part of Defiance Campaign of the FDC that is by Interim Order of 29th April 2016 by Deputy Justice Stephen Kavuma.

So that a National Political Party from the Opposition should not be enemy of the state; as they come with peaceful demonstration and disobedience. President Museveni has used guns and fear to keep himself in power. Together with buying alliances and paying to silence the ones who is hungry. Not everybody can be paid for silence as Bishops and Jimmy Akena of the UPC. Therefore he makes the ones enemies as he did with Dr. Milton Obote and Tito Okello. He has done the same with others and people have eaten it up, but now he shows that his colors are the same.

The National Security of the country is now meaning that the President is secure and his ruling elite. Not that the Security of the nation and all citizens of the country. If it was so then that would be different and would make a difference.

Human rights as free movement, demonstrations and free speech shouldn’t be so hard for the National Resistance Movement, but if they we’re a legitimate ruling party they wouldn’t had an issue it with it. They wouldn’t have used the Police to detain peaceful demonstrators in the streets around an Opposition Party Headquarters in Kampala. The Police Force wouldn’t have put the regulatory of who could enter the premises or not. Even detaining fellow staff of the Headquarters… if that is not flabbergasting and boggles your mind then you don’t know to what extent the NRM Regime goes.

The National Security aspect isn’t for securing the safety for the citizens, it is for securing the riches for the elite and their businesses. As they earn monies over fist and have to keep it that way, even meaning that that they earn money on embezzling the government funds here and there. But that is not a value worth to consider. As the human rights and the justice for all men is not considered, only considered when it matters for the NRM elite. That should be a worry for the media, for the state and for the citizens.

Dr. Kizza Besigye and his new house-arrest is not biggest breach of human rights, it is just the epitome of how the government does not care about human rights, justice or rule of law. He is illegally detained by the Police Force as he is a criminal for defending his belief and the judgement of Electoral Commission that was fixed to fit the Ruling Party. So he couldn’t even counter the announcement made by the EC this time around because of the harassment of the opposition from the Police. The reason why Opondo and Museveni have sounded like wounded dogs while defending the announcement and victory. Even the double victory after the Supreme Court ruling on the Election Petition! They did not sound like proud winners, more like they knew what they did and wanted to clean their hands from the dirt.

As said the Human Rights at this point should come first, as the Government and Police Force is used to target fellow citizens, tax-payers who pays money to the Members of Parliament who doesn’t in the near future pay tax. That is not justice or free society. That is “man eats man Society” of late Julius Nyerere. We this with the men who represent the citizens, eats all the money of the citizens as they do this without taking actions to defend the citizens. The Government and the Police should shield the public, not make parts of the public its enemies. That is the idea that National Security goes in the front of the Human rights paradigm.

If you let the Human rights be stepped on, will you step on all liberties; all kinds of justices will be brought away from court to keep the streets clean in the name of the National Security. If the Human Rights are respected then the citizens; would have rights to not have issues in court unless they violate the criminal codes, but otherwise the civil liberties and the freedoms of the people is not worth anything.

That the State is making fellow citizens criminals for doing peaceful actions as praying is saying to what kind of a Police State the Ugandan Citizens are under.

The Announced Double Swearing-in (In) Uganda on the 12th of May; Doubling down on the days ahead…

There are circulated and planned demonstrations against the National Resistance Movement and their “elected” government during the General Election of 2016 and was announced and declared by Eng. Dr. Badru M. Kiggundu on the 20th February. That they waited for the Supreme Court Petition of Amama Mbabazi that they cascaded and destroyed by all means. Just the same way the Uganda Police Force went after Democratic Party Members, FDC supporters and leadership in the days after to destroy evidence of the altering and rigging of the election.

The Reason why Uganda People’s Congress haven’t done or had any issues after the Election is because their leader Jimmy Akena have done deals with the NRM and even had his own people in the party campaign for the NRM in certain areas. Therefore they have been left in peace as they in solidarity have concocted an campaign trail together with the NRM, as well as the Party had no Presidential Candidate, which is also an extended token to the NRM and their Executive.

So with all of that mind, with the electoral climate and the electoral process that have been farce, where the South Sudanese rented troops was around in the nation during the election days, together with the army and anti-riot police stationed on the streets while the election and polling where held. Where the ballots and pre-ticking extensions and the certainty of Police involvement in central parts of the electoral process, then you know that the general election was neither free nor fair for the people and the citizens hadn’t their vote, they got the people the Executive had selected, not the ones the people wanted to have elected.

The reason why the deals of the Pipeline between Ugandan Government, Tanzanian counterparts and the Total E&P Uganda is uncertain, as much as the drilling agreements in Lake Albert by Total, China National Oil Offshore Corporation (CNOOC) and the others who have gotten rights to do so. But, that is not important as the exotic dancing at the clubs of Kabalagala in the Suburb of Kampala is the real danger of the country. Just ask the wise-guy Hon. The hesitation also of the final days of the 9th Parliament to fix themselves some more cash without questions while stalling the budget talks for next budget year of 2016/17 that was supposed to voted-in Parliament; but the Members of Parliament wanted to be sure of a pay-rise for the Nobel duty of being Selected by the Executive. The Executive knows this and let it go, because he knows if he needs anything done he can just give them little sweet brown-envelopes and they will let him be giddy.

So with that all in mind, the planned demonstrations, the running and planning building a petroleum industry behind closed chambers, the amazement of last-pitched laws of the 9th Parliament and last saga of late the speakership of the 10th Parliament.

10th Parliament like the 9 Parliament before needs a speaker and people are fighting for it, the Incumbent Kadaga believes she is the one for it again, the deputy Oulanya believes it his turn and other are throwing in their vote for confidence of being it. The NRM have no plans of letting a opposition leading the Parliament minutes and the organizing the structure of the lawful assembly of the land. That cannot happen, because the NRM and the Executive need to work in own speed and own liking as the Executive is the final word as he fix the votes and run the land. Therefore his last word on who becomes it and who is dismissed, just like Amama Mbabazi and Gilbert Bukenya have been dismissed by him for their ambition, so if the speakers become the same; I am sure he will do it again with force of the NRM CEC and the screaming tone of NRM Secretary General Justine Kasule-Lumumba. Be noted, that will happen, because he keeps people hungry and when they see a moment of eating more than expected then he hit back.

As we note the days and coming days. The tension of the faulted election will unfold and the questions will remain at what force the Police and Army will address the men and woman who walks to demonstrate, and how will the rest of the days between the 5th May and to the 12th May go. There are the historical pains of the Walk to Work where the tear-gas and the crackdown of it. The Police have ever since been monitoring and also spying on the opposition with their Political Police and Commission that been vicious on the dismantling the hopes of the opposition.

So how it might go is hard to predict as we can hope of the grand show-up of the Nomination Day around Kampala, if so then the Police Force cannot take them all and wind-down the demonstration with water-cannons, live-bullets and tear-gas. This I say because this is the tactics of the Police Force, even take Helicopters and Armoured Personnel Carriers and Mambas filled with officers to control with harassment of the fellow citizens. So the Police will want to dissolve the matters and the will of the people with the tarnish of civil disobedience. That is what I am worried about as the loss of life and the loss of will after 30 years of oppression.

And I have not even mentioned the started wrangles between the councillors, KCCA administration of the selected men and woman of President Museveni and the elected Lord Mayor that they want to rid-off for the second time. Because the Mzee believes all of the opposition supporters of Kampala are cockroaches or rats, depending on the way he does not talk about crash or kill opposition as proven in the Supreme Court Election Petition of 2016. But, hey maybe I am wrong. You can do the fact check on the words used by the His Excellency during and after the Election Day.

So even if Don Museveni gets President Mugabe, President Kenyatta, President Kagame, President Kabila, President Kiir, President Al-Bashir, President Sheik Mohamud, President Magafuli, President Gulleh, Prime Minster Hailemariam Desalegn and so on. They will surely grace him at Kololo and surely nobody will attack the car of President Mugabe this time. As they did last time he entered a roundabout on the road towards Kampala from Entebbe International Airport. Surely the men and woman, who grace the Kololo, will either be the few die-hards of NRM, the actually paid for the day Crime Preventers and the ones that are earning on the National Resistance Movement. Even some ambassadors and other pleasantries will show-up. Even some of the singers like Bebe Cool and Jose Chameleone will be there to sing-a-song. So you are warned.

The levels and magnitude of it all is how the world will perceive the days and how the Police Force will act towards the Opposition. How the mentality and the grandest approach, how the rhetoric and words from the ruling party will also show the TRUE state of affairs.

The international reactions and the real surface of how they will deal with it; as we know the American Africa Corp have recently given more technical gear and training to the Ugandan Army in Somalia. Not that makes headlines or be questioned as the President Obama have talked about leaders who never leaves, but at the same time gives handouts to the same men he critic. That is saying something, but acting differently and is hard to fully follow and accept.

It is in this view that the 12th May will show who is loyal and who his friends are, this will show how powerful and loyalty towards the 30 year ruling President Museveni. The Besigye move is deteriorate and also show that the legitimate Executive are something Museveni is not, not at this point and time. Therefore he uses all tactics to oppression and harassment of the opposition. That I fear also will transpire in the coming days as the Police Force, UPDF Special Force Command and the Flying Squad will surface to violate the rights of fellow citizens of Uganda without any consideration to the violence or the extended freedoms they take away to enforce the rule of their Executive. That is the sad prospects I envision, but if the people show up on the 5th May 2016 as they did on the Presidential Nomination day in November 2015, then the Police Force cannot “kill” or dissolve the demonstration. They have to let it go, because the majority will control the streets even when the Anti-Riot Police have to lay low as they can’t brawl with every person on the street. They can only take a small piece of the population, as they are a minority, but a minority with weapons.

There been written a lot about the General Elections in Uganda of 2016, myself is guilty for doing so and with that in mind. I have read through the newly released Report of the European Union Election Observers Mission of 2016. That is worthy of taking what I see fit to broadcast and what the Europeans who went quick, took a safari and also spent some time at the Polling Stations. Here is what they said about the elections!

An important factor in what the EU thinks about the General Elections of 2016:

“Vital electoral reforms did not take place prior to the 2016 elections. Proposed amendments to the electoral legislation, compiled under the ‘Uganda Citizens Compact’, aimed at enabling the conduct of democratic elections, including to increase transparency in the appointment of the EC’s members, to restore presidential term limits and to improve parties’ financial accountability, were disregarded by the executive. Consequently, the legal framework contains gaps and ambiguities and therefore, in several instances, falls short of international principles for holding genuine democratic elections” (EU EOM, 2016).

Election Verification of Voters:

“The newly introduced voter registration system improved inclusiveness and accuracy of the voter register (VR). The final VR contained 15.277 million voters. However, establishing the cut-off date of 11 May 2015 for inclusion in the voter register disenfranchised approximately half million potential voters who turned 18 after this date” (EU EOM, 2016).

Lack of Transparency:

While legislation contains provisions on reporting and disclosure of political finance, these are neither followed by parties and candidates, nor enforced by the EC. This lack of transparency weakens the credibility of the elections” (EU EOM, 2016).

Maladministration of the vote:

“Voters showed remarkable determination on election day, waiting long hours to cast their ballots. The markedly late arrival of electoral material in certain areas marred an otherwise calm election day. The EC failed to address growing tensions among people deferred from voting. Instead, an imposing presence of police in the vicinity of polling stations was observed. Further shortcomings, such as unsealed ballot boxes in 20 per cent and compromised secrecy of vote in 11 per cent of polling stations visited, were observed by the EU EOM. Positively, party agents and domestic observers were mostly present in polling stations visited by the EU EOM” (EU EOM, 2016).

Talley Centre mishaps:

“In 85 per cent of the District Tally Centres (DTCs) observed, the printed sub-county results, broken down to polling station level, were not handed out or publicised. The Electronic Result and Transmission System, used to transmit the collated results from districts to the EC, did not contain key anti-fraud measures. In several districts, the electronic transfer did not take place; the results were brought to the EC by the district returning officer in person. The final tallying for these districts could not be observed, further undermining the integrity of the process” (EU EOM, 2016).

Police intervene in the Election:

“On a number of occasions, opposition candidates, particularly from the FDC and TDA/Go Forward, were denied access to campaign venues, restricting their ability to campaign freely. The EU EOM received reports and observed extensive use of force by police, including teargas and assault rifles, to disperse crowds during Kizza Besigye’s and Amama Mbabazi’s rallies in Bukwo, Kasenge, and Ntungamo, among others.25 On 15 February, police detained Besigye twice, preventing him from addressing scheduled rallies in Central Kampala, and used teargas and live ammunition against his supporters, resulting in one death and several injuries” (EU EOM, 2016).

Government officials intervene in the Election:

The orchestrated use of state resources and personnel for campaign purposes was observed. Government officials took an active role in the NRM campaign, with several Resident District Commissioners and high-ranking security officials openly endorsing the candidacy of President Museveni and the NRM campaign. Thus, candidates’ equality of opportunity was not respected” (EU EOM, 2016).

Intimidation during the Election:

“In Bukwo district on 6 January, the police dispersed the campaign rally of FDC presidential candidate Besigye in Toriet Internally Displaced Persons (IDP) camp using teargas and assault rifles. Several senior FDC figures received minor injuries. The police stated that Besigye diverted from his planned route without justification and thus provoked acts of public disorder” (…)”On 25 January, the IGP stated that all critics who are simply ‘political opportunists’ can ‘go hang.’ On 27 January, he was also quoted saying ‘power shall not be handed over to the opposition to destabilise the peace the country has fought for.’ In a press release, the police later claimed that the media had misquoted the IGP” (…)”EU EOM observers received reports of intimidation of opposition and opposition supporters in Amuru, Bujenje, Buliisa, Gulu, Isingiro, Kamwenge, Kapchorwa, Kasese, Kiruhura, Kisoro, Lira, Masindi, Mbarara, Moroto, Mukono, Nakapiripirit, Nwoya, and Wakiso. Intimidation of voters was reported from Kiboga, Lira, Luweero, Moroto, Nakapiripirit and Sembabule districts” (EU EOM, 2016).

Bad rhetoric during the Election:

“On 9 October, the President was quoted as saying that anybody who attempts to oppose him will, ‘Be smashed completely and no trace of his remains will be found on the ground,’ and on 20 December that ‘The thugs who attacked NRM supporters in Ntungamo will pay dearly.’ NRM secretary general Justine Kasule Lumumba was quoted on Radio Simba on 25 January saying, ‘We shall shoot anyone who will come on the streets to demonstrate against vote rigging.’ On 1 February, the deputy RDC in Jinja was quoted saying: ‘Whoever will be found disrupting the February 18 elections in Jinja District will be shot dead.’” (EU EOM, 2016).

Campaign funding disclosure:

“The total amount of money jointly spent by presidential and parliamentary candidates is not independently calculated and verified. According to presidential candidate Amama Mbabazi, he funded his three billion UGX campaign from his personal funds and received no donations. Kizza Besigye disclosed that his expenses totalled one billion UGX, of which 96 million UGX were donations. Incumbent president Museveni’s campaign team refused to disclose the amount/value or sources of his campaign funds” (EU EOM, 2016).

Media Freedom during the Elections:

“The NRM, with more funds at its disposal, admits to frequently using paid-for pseudo-journalism to boost its visibility and enhance the reputation of both the party and its candidates. An edifying example of the system in place occurred in Rwenzori, where 17 outspoken journalists were compelled to attend the President’s briefing in Masindi state lodge. The President not only instructed journalists to campaign for the NRM at grassroots level, but also provided them with financial ‘facilitation’. Consequently, the line between advertisements and editorial content was blurred and the impartiality of information offered to the electorate was eroded” (…)”Hostile statements targeting outlets owned by the country’s largest commercial media house, Nation Media Group (NMG), were repeatedly made by the President and reiterated by the state’s top executives. This reverberated at the local level, with the RDCs and other state actors orchestrating measures that encourage self-censorship on issues that might be perceived as critical to the President or the government. Intimidating phone calls, “guidance meetings” for journalists and editors chaired by the law enforcement bodies, as well as requests to submit the radio’s programming to the RDC or local UCC representative prior to broadcasting were the most wide-spread measures applied to put media under pressure. The EU EOM received reports on such occurrences in 20 districts” (…)”On 24 January the President stated: “Monitor and NTV don’t know that there is a good, they just tell lies…. NTV is an enemy”. The President voiced a similar statement on 31 January. On 29 January the minister of Information and National Guidance: “There is no media house that can take the law in their hands…we definitely shall close them down”. The government/NRM spokesperson criticized media on 1 February. On 9 February owners and editors of all leading media houses were invited to the dinner hosted by the EC and the UCC where all were warned that UCC will “without a hesitation sanction the media outlets” (…)”Media monitoring findings correspond the parties’ and candidates’ assessment of the balance and quality of local radio coverage of their campaign. While 78 per cent of the NRM’s local leadership believes that media featured them fairly, the FDC’s assessment of radio’s impartiality is diametrically opposed, with 78 per cent of local party representatives listing examples of biased coverage. In 21 districts, opposition candidates were denied access to radio broadcasts or stations, and in 32 districts, biased coverage against FDC, Democratic Party (DP) or Go Forward was reported” (EU EOM, 2016).

Election Day:

“In at least four cases, the police used teargas to disperse voters at polling stations. Only shortly before the official closing of the polling stations at 4 PM did the EC chairman announce the three-hour extension of voting in Kampala and Wakiso district. This was poorly communicated to the polling staff in affected areas, and EU EOM observers reported polling stations being closed at first and only after some hesitation did the polling staff improvise and try to re-open voting sites” (…)”Unauthorised persons were present in eight per cent of polling stations observed, and in none of them did the presiding officer requested them to leave. Essential election material was missing in 12 per cent of polling stations observed. Typically, the missing material was seals, but in a small number of cases also ballot boxes, ballot papers in sufficient numbers and the voter register was not available” (…)”In one quarter of the polling stations, observers encountered voters being turned away for not being on the voter register. Such a high percentage of voters not being aware of the location of the polling station indicates the lack of voter information prior to the elections. Only in two per cent of the polling stations visited were voters deprived of voting without lawful grounds” (EU EOM, 2016).

Counting:

“In 37 per cent of polling stations observed, the Presiding Officer had difficulties completing the Declaration of Result Forms (DRF), and in almost half of the polling stations the filling in of the Accountability of Ballot Papers Form proved to be problematic. In 20 per cent of polling stations where closing was observed, the numbers in the DRFs did not reconcile. This can be attributed to malpractice, negligence and/or numerical errors. The latter two were widespread since there were neither provisions nor even proper guidelines on how to conduct the reconciliation at the polling station level. Moreover, after filling in all forms, the safety and integrity of the DRF was not ensured in 30 per cent of polling stations observed, as they were not put into the tamper-proof envelope as prescribed by EC instructions. Intimidation of polling staff during the counting was reported from four polling stations observed by the EU EOM observers. In 93 per cent of polling stations observed at closure, results were not posted outside the polling stations, as required by law. Nevertheless, party agents were given copies of the DRFs in 93 per cent of cases” (EU EOM, 2016).

Tallying:

“The ban on social media on mobile devices was not lifted for four consecutive days. The overall environment created by state actors during the final stages of the tallying of results curbed voters’ right to access to information as called for in Uganda’s international and regional commitments” (…)”Further constrains on the public’s access to information originated from the EC’s statement de facto prohibiting media to publicise results announced at the polling stations. Such live reports on results by polling station is a habitual and defining feature of Ugandan media’s election coverage as it enables each voter to independently verify the results in his or her polling station. With the FDC’s leadership being detained, the police surrounding Mbabazi’s home, and with critical media being effectively silenced, the EC held a monopoly over both the content of electoral results information and the pace of its disclosure” (EU EOM, 2016). “The results, however, did not contain data from 1,787 polling stations, affecting 43 districts, eight of them strongly” (EU EOM, 2016). The EC eventually updated the final result on 22 February, adding the results from 1,658 polling stations. The EC also nullified results from 129 polling stations in 34 districts due to various malpractices, including disruptions during voting and the number of votes cast exceeding 100 per cent of registered voters. However, the list of affected polling stations was not published, thus compromising the EC’s accountability” (…)”These were Jinja with 388 polling stations (PS) out of 399 missing, Rukungiri with 273 PS out of 276 missing, Kyenjojo with 277 PS out of 337 missing, Kabale 190 PS out of 478, Kampala with 162 PS out of 1,338, Wakiso 119 PS out of 1,359, Isingiro with 88 PS out of 385, and Ntungamo with 78 PS out of 432 missing. These eight districts account for 1,575 or 88.5 per cent of the missing PS” (EU EOM, 2016).

It is good to see that the Elections Observers is saying the same as so many other people have said about it. This here counters the words of Andrew Mwenda, Ofwono Opondo and President Museveni. The words that should stick to into President Museveni mind is this:

“Consequently, the legal framework contains gaps and ambiguities and therefore, in several instances, falls short of international principles for holding genuine democratic elections”.

Because he said this after the elections was over: “am glad that my people here have seen the mistake of listening to foreign meddlers.” (…) “If the international community has lost confidence in us, it is a compliment and it means we are right”.

So in his mind because the European Union now saying he is wrong and that the framework is co-operative with free and fair elections; then in the mind of President Museveni means we’re right. The President Museveni has now “won” the 7th Term and is ready for his 31 years of power. He is double the age of average aged Ugandan. So there is something missing and wished for. Therefore the ending of the tension and the presence of security outfits in nearby area. The Army and Police Force is close by and the ones that keep him in Power. Not the loyalty of the people or the legitimacy of the way he became the incumbent again! Peace.

Mr. Eduard Kukan I will be honest I had little faith in you and your mission as the fraudulent and praising foreign missions to express faith in the government they are funding through donor-aid and direct-budget funds. Therefore I thought that you would naturally say it was free and fair without hesitation. Because you went from Slovakia to go on Safari, drink some sodas and have matooki and be merry. But I am glad you did your job well, not because of your view, but because of sense observations and reports been told. That seems genuine as your concern for the maladministration and fraudulent elections you observed.

The Amendment of the Income Tax Act in Uganda; is the first out of many freedoms that the Members of Parliament have given themselves

It’s been hectic around the Amendment for the Income Tax that has opened the possibility for Members of Parliament and the ones on Diplomatic Missions to not be paying the Income Tax in Uganda. There been an outrage on Social Media, therefore I started to look into it. First will I add the specific amendment that was voted in Parliament now in April 2016, that’s give’s the Members of Parliament no Income Tax, because older laws already gives them Immunity. Certainly this is gift basket to the coming 10th Parliament, as the 9th Parliament gives a tax-break to themselves, as they already have certain obligations and other services provided by law; and that is not so strange they are the makers of laws, so they have made laws that fits them and gives them advantages.

Orignal Law before the Amendment:

93. Cases where returns of income not required

Unless requested by the Commissioner by notice in writing, no return of income shall be

furnished under this Act for a year of income-

(a) by a nonresident person where subsection (4) of section 4 or paragraph (c) of

section 87 or both apply to all the income derived from sources in Uganda by

the person during the year of income; or (effective 1st July, 2001- Income Tax

(Amendment) Act, 2002)

(b) by a resident individual-

(i) to whom section 4 (4) applies; or (effective 1st July, 2001- Income Tax

(Amendment) Act, 2002)

(ii) whose total chargeable income for the year of income is subject to the

zero rate of tax under Part I of the Third Schedule to this Act!” (The Income Tax Act, 1st July, 1997)

Here is the what the Amendment of 2016 does to this section:

“Unless requested by the Commissioner by notice in writing, no return of income shall be

furnished under this Act for a year of income-

(a) by a nonresident person where subsection (4) of section 4 or paragraph (c) of

section 87 or both apply to all the income derived from sources in Uganda by

the person during the year of income; or (effective 1st July, 2001- Income Tax

(Amendment) Act, 2002)

(b) by a resident individual-

(i) to whom section 4(4) applies, except persons employed by diplomatic missions and prescribed organisations on which diplomatic immunities and privileges are conferred;”. (effective 1st July 2016 – Income Tax (Amendment) Act 2016)

(ii) whose total chargeable income for the year of income is subject to the

zero rate of tax under Part I of the Third Schedule to this Act!”

So with the important Amendment to the Tax law tha set the standard for the Diplomatic Immunities and Privileges. They are no except from the Income Tax. That means that the Income or Pay that they are getting so not taxed or their salary is now Tax-Free.

And as this complies with Scetion 4 (4) here is what that says:

“4. Income tax imposed:

(4) Where the gross income of a taxpayer for a year of income consists exclusively of

employment income derived from a single employer from which tax has been withheld as

required under section 116, the income tax payable by the taxpayer for the year of income

is the amount equal to the sum of the amounts required to be withheld from such income

under section 116” (The Income Tax Act, 1st July, 1997).

So just to take the last piece of law to put this all together and give meaning while it have created a fuzz and been question what this part of law means that people with Diplomatic Immunity get exception from Income Tax. Even if the Third Part of Law says that people who lives most of the days in Uganda have to pay Income in Uganda, but with this new text to the law, that certain people are exempt and doesn’t have to cough-up the money.

This is what the Parliament (Power and Privileges) Act of 1955 of 24th February 1955 say this in the act:

“2. Immunity from legal proceedings.

No civil or criminal proceedings may be instituted against any member for words spoken before, or written in a report to, Parliament or to a committee, or by reason of any matter or thing brought by the member in Parliament or a committee by petition, bill, motion or otherwise” ( Parliament (Powers and Privileges) Act 1955).

And lets not forget this act to called Parliament (Remuneration of Members) Act 1981, that is still active and give certain benefits the Members of Parliament. It came into effect on 1st July 1981 and is still active and this is what it says:

“4. Regulations:

“amenities” includes housing, transport, medical attention, domestic servants, security guards and secretarial services;

“Minister” means the Minister responsible for public service and Cabinet affairs”, (Parliament (Remuneration of Members) Act 1981).

So they have no cut the Income Tax because the Parliament Law of 1955 gives the Immunity and therefore are they under the provision of the exemption. That is not surprising, but that is a fact. So it is clear that the end of 9th Parliament will be self-serving an in their own interest and not for any common-good for the people.  And the ability of still having colonial laws that are active and not terminated is a little profound for me. As the NRM Regime have tried to rewrite everything, but seems that certain relics of the past is a good thing, if it gives them more power or ability to harass the opposition or control fellow peers. The Immunity of Members of Parliament together with Amenities and now the exception of Income Tax proves the levels of positive acts that are made for MPs to be able to paid salaries and amenties without paying Income Tax. That is astonishing and questionable. That the Minister of Parliament can get funding for housing, transport, medical attention, servants, securities and sectorial services without paying Income Tax on the Salary that are getting. With the benefit of Immunity!

So some laws from the Colonial Past and one law made by Obote II gives an edge together with the new amendment of a law made two years after the “Museveni Constitution” of 1995. Certainly there some ironies that the Members of Parliament are getting funded amenities under the NRM Regime because of President Obote and his UNLA and UPC fixed it 5 years before NRA overthrow them. But that is just me.

The levels of self-serving is just continuing the traditions in the Ugandan Parliament. This is all the way from 1955 to 2016. It might be 50 years apart, still the same mentality is there and the men of power wish to extent their power, if it is immunity, impunity or exception from taxes. The same powers and same common greed is there. As showed in the laws that inflicts the Cabinet and the Members of Parliament. Peace.  

The Markie event of the President Bid of Hon. Moses Wentangula in Kakamega yesterday; as the rally happen; the chaos and the bickering transpired; either it is issues between the Opposition or the hired noise from JAP; it make me worry about the coming election!

Yesterday the Forum for the Resotoration of Democracy (FORD-Kenya) Hon. Moses Wentangula had his Presidential Bid Rally in Kakamega at Muliro Gounds. As much as the Kakamega County said the grounds we’re rebuilt for recreational use and not public rallies anymore. The rally still occurred. Though under some unfortunate circumstances as Orange Democratic Movement supporters crashed the venue and created unnecessary actions, that lead to tear-gas and people hurt in melee.

Yester was supposed to be the start of the Hon. Wentangula bid for presidency as the main candidate for the Opposition Parties and their alliance Coalition for Reform and Democracy (CORD-Kenya). That is a multi-party coalition of the most of the opposition parties that are in the country. They are supposed to be the stark contrast to the Ruling Jubilee Alliance which is the ruling coalition with Jubilee of President Kenyatta and his Deputy Hon. William Ruto of the United Republic Party.  Just as they in October 2015 was to create a Party out of the coalition that becomes the Jubilee Alliance Party (JAP). So the ruling party will be stronger and counter stronger towards the opposition coalition.

Odinga Wentangula

As we saw yesterday even with the days before Hon. Raila Odinga in his written statement on 01.04.2016: “I will endorse Wetangula Tosa 2017 at the monumental Muliro gardens Kakamega.I find strong leadership in My brother Hon Moses Wetangula,he is young,energetic and brave to face-off with Uhuru in the 2017”.

Hon. Odinga had already given in public sphere the endorsement of Hon. Wentangula as he had planned his bid and surely had worked the CORD before this, so it was not a coming like a lightning strike or all of sudden no Chapattis in the whole of Kenya!

The ODM supporters acted wildly as they tried to undermine the leadership of CORD. If not is strange tactic from Hon. Raila Odinga to first endorse then sending his loyal followers to destroy the start of Hon. Wentangula bid for presidency in coming election of 2017. CORD if they will ever counter the ruling regime, need solidarity and ethics. Prove that they are different from them and strike as viable choice for the public to run behind.

If the Opposition wants to be taken serious they have to show it with actions and not go to grind against each other; especially not rowdy ODM Supporters at a campaign rally. The same would be if FORD Supporters ran around creating havoc at an ODM Rally. Even if the ODM supporters did this in good faith to support Hon. Raila Odinga and tamper with the President Bid of Hon. Wentangula. As he already had endorsed and given way for in the way he did Mwai Kibaki.

As long as they bickering and look chaotic the JAP under President Kenyatta and Deptuy Ruto will blossom while looking smart to the public. That is something both Hon. Wetangula and Hon. Odinga. The Odinga family have had misfortune compared to the ruling mafia in Kenya that is in fourth extension with Uhuru Kenyatta, as he follows the proud leadership click from Jomo Kenyatta his father, Daniel Arap Moi who was Jomo Kenyatta’s Deputy; the same with Mwai Kibaki who worked under Daniel Arap Moi before being ready for the Executive position or become the President; the same was with Uhuru Kenyatta who got groomed during Mwai Kibaki and made ready when his turn came. While Jaramogi Ogdinga Odinga got detained and lost his Prime Minster position, Rail Odinga got to become Prime Minister under Kibaki as the Power-sharing agreement was to med peace. After that he lost on his bid to again try to become the President as Uhuru Kenyatta won on his coalition and Raila Odinga got back into Opposition.

Now that the Opposition should be gearing up together and make sure the makeshift that the Opposition wish to create, instead the ruling party and the JAP can have field day and think their wise as their consolidate their alliance and coalition under one house to strengthen the party towards the General Election in 2017.

The actions of yesterday was to be a merry and not create tension between the ODM and FORD, which is not needed; if they want to be seen as professional partners who have one single presidential candidate, if not they may fall short as the The Democratic Alliance before the General Election in 2016 with the bickering between the partners and the loosing of the major-party and their main candidate Dr. Kizza Besigye while Amama Mbabazi and his newly formed party Go-Forward got the whole Coalition for himself, but the DP and the UPC struggled with affiliation, as the FDC grew strong by being the third force during the election period.

The same could happen, but the CORD have been strong together for long under the regime of Hon. Raila Odinga, but the assessment after yesterday seems bleak as even Hon. Raila Odinga did not show up at the venue, even Hon Nabil Naberwa (FORD) was detained after the rally.

Cord Effect Says this:

“Intelligence reaching us indicate that a prominent Western Kenya leader, working with unnamed politicians from outside Western, not aligned to CORD and suspected to be heavily financed by Jubilee, has spent the better part of the last three days hiring buses and trucks full of people from as far as Khayega and Kibigori with the intention to use them to cause disturbances at Moses Wetang’ula presidential launch later today” (CORD Effect, 03.04.2016).

So the Government and Police will investigate the matter and the cause for chaos that happen on Muliro ground at the Presidental Bid of Hon. Wetangula. The matter at hand it’s supposed to be a joyful occasion to inspire the opposition and gain support as something else then the JAP. The day was not only marked with the words, but with the killing of an unfortunate police officer and people hurt by the crowd of ODM supporters. If they we’re payed to be that by the JAP then this is a sorry for a ruling party to make a propaganda victory and senseless actions towards counterparts, fellow brothers from another mother.

We as pundits like me, hope for peaceful election and not of violence by any means. If this is only the start then it is worrying of the state of the politics, if it is really ODM supporters, then the ODM Party have to sufficiently either stand by their endorsement of Hon. Wetangula and Hon. Odinga better enlighten his fellow supporters. If the FORD gets hurt by this, they better get into dialogue and square it out, as this should not be something that creates animosity. Certainly JAP will win on this if this is truly a actual event where the Opposition parties going against each other, but if this is payed and staged by them. Then the JAP Party is the reason for the death of Police Officer, and then getting the FORD Official behind bars for their own gain, which is political manipulation and then trying to score a mental victory by making it look like a flawed event.

The post election season has been characterised by tension arising from the house arrest of lead opposition leader Dr Kizza Besigye, a court case by former presidential candidate Amama Mbabazi and filing court petitions for MP, L.C and municipal elections.

The Citizen Election Observers Network- Uganda (CEON-U) is concerned that the continued house arrest of the lead opposition candidate infringes on his right to freedom according to article 23 of the constitution.

In article 43 of the constitution: (I) In the enjoyment of the rights and freedoms prescribed in this Chapter, no person shall prejudice the fundamental or other human rights and freedoms of others or the public interest.

(2) Public interest under this article shall not permit-

(a) political persecution;

(b) detention without trial;

(c) any limitation of the enjoyment of the rights and freedoms prescribed by this Chapter beyond what is acceptable and demonstrably justifiable in a free and democratic society, or what is provided in this Constitution.

Section 24 of the police act gives the police a right to arrest someone if he is a threat to public security, but CEON-U demands that police produces evidence that makes Besigye a threat to public security, otherwise will his arrest be indefinite.

In a multiparty system, opposition parties should not be viewed as enemies of the state, but rather as groups that provide alternative Government programmes.

As part of a process of increasing citizen participation in Uganda’s electoral process, CEON-U recently carried out an opinion survey on the recently concluded general elections.

The survey was meant to expose electoral irregularities so as to provide a premise on how to better organise elections in Uganda.

Consequently;  8 CEON-U managers visited areas where there is conflict, court petitions and requests for vote recounts to establish the causes of the disputed elections. The team visited Tororo, Gulu, Kotido, Butambala, Serere, Jinja, Mayuge, Iganga, Mukono, Kasese, Bundibugyo and Ntungamo. The managers worked closely with our long-term observers who are natives of the constituencies and the districts which they observed, before, during and are observing after elections. CEON-U held focus group discussions with members of the community, local council leaders, opinion leaders and voters from all political parties in the districts.

CEON-U also met district police officials, district returning officers, registrars in courts of law and victims of electoral violence.

Findings:

Generally, the presidential and parliamentary elections were peaceful, but the period leading up to the election day was volatile in all the districts visited. In Mayuge for instance a man died under unclear circumstances. He was a supporter of Robert Ntende, an independent candidate. He is said to have been killed by supporters of Idi Isabirye.

In Iganga at Idudi supporters of NRM and FDC clashed on the eve of elections over voter bribery. The NRM MP was giving out cash to voters who alerted FDC supporters. FDC supporters reacted by blocking the NRM from giving out money, the NRM called a NAADS soldier to rescue them. He came and shot dead a 25-year-old man and the crowd became more rowdy. And the soldier continued firing live bullets. In the process of the scuffle, a woman was shot through the arm and an s.3 student was shot through the neck. Both these people were not involved in the scuffle but had gone to the trading centre to buy food. This shooting took place at 8:00pm. (attached are the pictures of the victims of the shootings).

The way results were tabulated and announced at the district provided a sharp contrast with what the locals had gathered from the polling stations. This happened for all the elections, presidential, parliamentary, district council and municipal elections.

NRM UPC Arua 16.11.15

There are mainly two known political parties, the NRM and FDC; even though Uganda has 10 political parties. UPC which was once a known party is almost non-existent.

In a strong multi-party dispensation system people are given an opportunity to have divergent views on handling issues of governance. A weak political party system promotes a one party system of governance which impedes institutional growth.

The management of electoral processes by some of the district returning officials was poor.

A case in point is Jinja: When it came to the L.C.3 election of Walukuba West Parish B;

The LC 3 election had five candidates Joseph Bateganya Atumika, Bisusa Amisi Kafuko, Kirunda Isaac Kiwunda, Mande Milton and Mbulugu Emmanuel.

On Election day the ballot papers that were supplied to the polling stations had wrong names. Mande Milton was called Mande Milton Kirunda. Also party symbols were mixed up between the NRM candidate and FDC candidate. This was sufficient ground for the election to have been cancelled. However, even when the Jinja district returning officer, Ambrose Mwaita was notified about the anomaly he told the candidate Kirunda Isaac Kiwunda that electoral commission Jinja was not going to do anything about this case. A case has been filed against the electoral commission in Jinja court by Kirunda Isaac Kiwunda.

There are several other electoral disputes that have been filed in courts of law in the various districts. In Omoro Constituency there is a Petition: Simon Toolit Vs Oulanyah Jacob was logged in on March 24 2016. Simon Tollit is suing the Incumbent Oulanyah Jacob and EC over election mal practice. These included ballot boxes being kept away in a saloon, EC tampering with DR forms, EC using a Different format of the District DR Form to declare results among other things.

Intimidation and Violence:

In Katawi, Amuria, Bukedea and Serere there were cases of intimidation and violence. The community claimed they were beaten by militia groups and crime preventers and were warned against voting an opposition party into power. ( attached is a picture of the people who gave confessions during a focus group discussion)

In Mukono the parliamentary campaigns were characterised by violence and chaos. According to the electoral commission, Fatuma Ndisaba’s supporters used to beat up Betty Nambooze’s supporters during campaigns. There was also the problem of candidates campaigning beyond the stipulated for campaign time and supporters clashing after the campaigns.

Recommendations:

 The military should be restrained from participating in elections, because elections are volatile in nature. Electoral commission should improve its image by investigating and eventually laying off district returning officers who are said to have altered DR forms and extorted money from candidates who wanted to be announced winners.   All political parties should be treated equally and respectfully by the Government in power.  The Government should seriously consider the electoral reforms that civil society presented last year. Presiding officers and polling assistants should be better remunerated to prevent them from being compromised during elections.  Management of elections is not a single days event. Planning and training of officials, desk officers, middle level managers, desk officers, heads of departments on the process of elections should start the second month after the general elections. Training presiding and polling officials should be done a month to the elections to minimise errors on the DR forms.

Conclusion:

The democratic path is a long bumpy one, despite the many electoral irregularities that marred the recently concluded elections, the gains made over the last 30 years cannot just be thrown away. We need more concerted effort to promote true democratic ideals.
