DPP Chibita letter to Lt. Gen. Andrew Guti on dropping gun charges on Bobi Wine but move him to High Court (22.08.2018)

Bobi Wine and the Opposition will have a long walk to FREEDOM: State Sponsored Oppression continues!

Today is start of a long journey, the ones celebrating that Bobi Wine got freed from Military Custody, celebrated to early. His journey to freedom is far from over. They will prolong his stay within in the legal system, as long as they can. Just like did to Gen. Moses Ali or even countless charges put on Kizza Besigye. Robert Kyagulanyi and the others will be in the Court system for ages, until the state finally drops it. When they have to get new charges for new crimes. That is what the National Resistance Movement (NRM) and President Yoweri Kaguta Museveni does to opposition. This is a play we have seen again. The tortured and arrested MPs, will still be in custody and await trials, as the cases are push forward for further discovery or whatever needs the state has at any given moment.

While that has happen. Here is re-cap of what that has happen.

In the early morning as Dr. Kizza Besigye was planning to leave his home in Kasangati, Wakiso. He was taken away by unknown men, as he later surfaced in Mukono District at the Naggalama Police Station. Detained by the authorities.

The message from Besigye before he was taken: “Every way out of my home is barricaded since very early today. The intention is to deny us freedom to move and to be at the Military Court where MP Robert Kyagulanyi is to be produced this morning. The struggle for freedom and sovereignty won’t be blocked! Museveni Must Go” (Dr. Kizza Besigye, 23.08.2018).

While Erias Lukwago, the lawyer representing Robert Kyagulanyi aka Bobi Wine. Which was set for Military Court Martial in Gulu today. He has been put under house-arrest by the authorities today.

Ingrid Turinawe have also been put under house-arrest by the authorities as well.

While the Director of Public Prosecution Mike Chibita has written to the Lt Gen Andrew Guti to drop the gun charges against Bobi Wine, Kassiano Wadri and the 28 other suspects. In the letter to Court Martial, he also asked the case to moved from the military courts to the civil courts.

While Bobi Wine was freed for a hot minute from the Gulu Military Court, he was re-arrested on similar charges as before of illegal procession and for treason. Therefore, he will have to answer in a civil High Court instead of a Military Court. He is remanded into custody until the 30th August 2018. He was on crutches and struggling to walk in the Court Martial today. He will be in Gulu Main Prison until next court date and be put back in Makindye Military Barracks. So, he was re-charges against at the Gulu Magistrate Court today and therefore, the case will continue.

What we have learned today, is that the government and authorities are still working overtime to silence and stop the opposition from having space. As Besigye has to behind bars, Lukwago has to be house-arrested and not allowed to represent his client. Neither is the like of Turinawe allowed to go out.

The NRM are really just showing their lack of tolerance, freedom and liberty for anyone else than the President. Who can call out everyone by name and say they are inciting violence, while his state sponsored violence can address anyone. He can arrest and detain anyone at the snap of his fingers. That is why Besigye is behind bars, Lukwago blocked and Turinawe blocked. While Bobi Wine is just moved from the military to the civic one. He is still in legal jeopardy, just another place than before.

The rest are still charged with treason, even if the gun-charges are taken away, while the forged destruction of the Presidential Convoy continues. As the President had to swing by to check if they followed his orders. Peace.

Uganda Police Force have seized two truckloads of tyres (22.08.2018)

President Museveni continues his rants: Now condemning and strangely lacking executive powers!

Now that President Yoweri Kaguta Museveni is starting to write articles daily and posting them on Facebook. Today, he was at least a bit more subtle than of late. He was writing with more respect and not being such a brat in Office. President Museveni wasn’t telling people that they are pseudo-intellectual or hooligans directly, if they are supporters of Robert Kyagulanyi or anyone else, which isn’t him.

As the aftermath of the Arua By-Election are continuing, because of the how the state has acted, used the Special Force Command and other Security Organizations to silence the Members of Parliament, but also the public. The state sponsored violence and random arrests, as well as the ones planned and the charges made by the state by the authorities. I will write side notes to each piece of the ones I have taken, because I will not care for commenting the economic parts of his writing, because at this point. The oppression and silencing of them is the ones that matters. Not the financial aspect, because no one really deem that important right now. We want them MPs and Arua33 released. Take a look!

I condemn in the strongest terms, the killing of somebody, in the Katwe area, whose name I have not yet been told by elements of the Security forces. When I asked the Police, I was told of a stray bullet being responsible for the death. A stray bullet (a bullet that goes away from the target) originally aimed at what and why? I was told that the Kampala demonstrating groups of Monday were more of a nuisance than a menace- which the Arua groups were. The Monday groups were operating in small groups, burning tyres and, then, sending them to social media, working for those who pay them, to show that Uganda is unstable. The enemies of Uganda are now worried at the emerging strength of the economy of Uganda” (Museveni, 22.08.2018).

The magic bullet of Houston has arrived in Katwe, Kampala. There been bullets hitting random victims and not where the Security Officers aimed. As they are killing at random. They are shooting in the air and suddenly hitting random places. Just like during the protests, tear-gas has been even thrown into the class-rooms and destroyed a class for the kids. These bullets, are because the security forces are ordered to quell by all means. They come with live-bullets, mambas and tear-gas to silence the public. Than, the President has trouble that the leaked pictures and messages of the violence happens online. Because he wants state sponsored violence done in darkness, without people knowing or reporting what is happening directly for the world to know. The OTT Tax is used to address and tell the world what is happening, as the Police, masked Special Force Command and others are quelling the peaceful protest by any means. He should beg forgiveness for all the lives, all the families and all the innocent people that is hurt by his authorities. Something, he never does, he condemns like the African Union and moves on.

I condemn, again, in the strongest terms the beating of journalists by elements of the Security forces. It is true that the journalists working for foreign interests or for our own local parasites tell lies, they do not do balanced reporting. On account of that you can block them because sometimes they interfere with the scene of crime. If they refuse, you arrest them and charge them with disobeying lawful command. Beating, however, is wrong because the Security forces do not have that power. People should not be beaten even as a punishment. They can be imprisoned, fined, hanged, etc according to the law and logic but they cannot, be beaten (flogged) except if the Police is dispersing a menacing mob threatening to kill people or damage property. In some countries, they use batons. On the issue of releasing Bobi Wine and the others, the President of Uganda does not have such powers. Once somebody is arrested, charged and remanded, it is only two authorities who can release such people in any way: the Courts or the DPP withdrawing charges if the evidence is not enough. Let us therefore, wait for the Courts and see what they decide” (Museveni, 22.08.2018).

President Museveni can lie, but this one is a major one, as per Security Organizations Act of 1987, which he enacted 13th November 1987, that says the President of Uganda can: “4. Restrictions on exercise of duties. (1) No officer or employee of either organisation shall take action directed against or affecting any person following intelligence gathered pursuant to section 3 unless that action has first been sanctioned by the President or such other authority as the President may direct; except that either of the Directors General may direct the police to arrest and detain, in relation to intelligence gathered, any person for not more than forty-eight hours pending a report by the Director General under section 3(b) and a decision by the President”. Therefore, he can direct the Director General, the DPP and the other agencies, if he has intelligence gathered to direct them. That is a clear lie. Easy lie, as he cannot even remember the laws he himself has enacted.

Finally, the anti-riot SOPs(Standard Operational Procedures) give the whole spectrum of options: warning rioters using loud- speakers, using shields and batons, using tear gas, using rubber bullets, using water – cannons, using rifles but firing in the air and, finally, shooting directly at the rioter in self- defence( for the Security personnel), to stop him harming a mwanainchi or damaging property if they do not pay heed. Therefore, Bazukulu, do not be misled by those who are misusing you that the Security cannot use deadly force. It all depends on the circumstances” (Museveni, 22.08.2018).

He defending the Police and the Army, as the quelling of the voice of the people. They are not allowed to protest. The Public Order Management Act, would have been used to stop the processions or any protests against the cause of the state. That is why the public isn’t informing the state of this. As they know the tear-gas, the live-bullets and the state sponsored violence will arrive. The videos of how the Security Organizations have acted towards the citizens, isn’t with respect. Neither, the way they have put them in the wagons and also the Nasser Road incident. Shows the lack of tolerance, where the intimidation and misuse of power, because the state has the biggest guns. They are killing people and arresting them. So, this defense is lying straight out, as the protocol isn’t followed and the key is to intimidate and silence the people, because the power of the President is the key.

When he lies, he should lie better, he has had training of doing so since starting to rule in 1986. I feel it bad, when I can use laws he is supposed to know and knowledge of powers he has given himself. Therefore, step your game of Mr. President and free them MPs, the Arua33 and everyone that has detained since the By-Election. Act like your responsible and not like a kingpin. Like you are doing at the moment. While thinking the public is stupid and not taking responsibility. Peace.

Uganda: Woman’s March dispersed by Police – As activists fights for the plight of the kidnapped woman!

Today was a day activists and especially Dr. Stella Nyanzi had a Woman’s March in Kampala. Going to the Inspector General of Police John Martins Okoth Ochola at the Police Headquarters to demonstrate with coffins to show the ignorance and the lack of care for all the kidnappings of woman in the Republic. Clearly, the Police Force was acting it is has done before. Instead of going into dialogue with the protesters. They went into warfare and skirmishes. As this little group was whisked away and the house of the IGP was shielded like a fortress with Police Officer in Anti-Riot Gear.

Some called this the Woman’s March, other in the slogan of Woman Lives Matters. 7 Activists was taken today, even some whose part of Chapter Four Uganda. Who also was protesting today. This shows that the National Resistance Movement (NRM) proves they are not there for freedom, liberty or even freedom of speech. As they are not allowed to speak up against the kidnappings.

All these activists was arrested with unlawful assembly and left on bond after being arrested earlier in the day. This was not at the same place as the demonstration. They were all taken to Jinja Road Police Station. That is typical of how these police officers works, as they usually does the same. To take the leaders from the protests and marches, even political rallies and drop them off further away. So the rest of leadership has to leave the premises and try to get them out on bond. As simplistic tactic to disperse the protesters.

They we’re peacefully walking to the Police Headquarters to deliver a letter and the police went all out. With all their gear and massive spark of outrage. They went into this with peaceful means. They came with coffins and a letter. To prove their point of the fragile lives, that is taken away and that the rampant kidnappings. This is happening a year after the deaths of woman in and around Entebbe. Which still is left unresolved, as the matter is on print. There is so many cases so many lives taken by the criminals and left played around.

That is the insecurity the NRM was supposed to fight and create. Instead it has gotten worse with time. The proof of with the rampant kidnappings and the deaths of innocent civilians. That is what it all boils down too. The demeaning way people are losing their lives, innocent woman who are just disappearing like garbage. When they are equals, citizens who has rights to justice and rule of law. Who are supposed to be protected and secured by the Police and other Security Organizations. The lack of that create a vacuum and the need for protest comes.

The need for organizing marches and question the powers for their lack of care becomes needed. Because the state isn’t answering to the plights of these people. They are left alone until they vanish, goes away and never returns. Used as pawns and used as bargaining chips to get a pay-off. That is what is happening. Peace.

IGP Okoth Ochola orders to shield the media: However, as long as they enforce POMA, will it matter?

In a Police Circular of 16th May 2018, the Inspector General of the Police Okoth Ochola has ordered a shift of policy towards the media. This is a change, but if we only see it on paper or in reality. Time will tell, because the laws that the Police use are still the same, they still have the Public Order Management Act (POMA), which has been used as a tool to oppress and silence opposition. Where the Police has interfered in journalistic endevours and political party works all across the Republic. All of that is well-known, as the Police needs to engage and give consent if anyone is gathering. That is so they can either stop it before it happens or have knowledge of any activity of any party, that is happening in public.

What is key from the message from the IGP was this:

Unit commanders must observe the safety of journalists very critically and no journalist or citizen should ever be abused or tortured. Torture is a criminal offence according to the law and whoever will be found to be involved in the crime shall be expeditiously investigated and prosecuted. The constitution calls upon us all to preserve, protect and promote media freedoms” (IGP Okoth Ochola, 16.05.2018).

CEON-U reported this from the General Election and Campaigning in 2016:

At the (media content) producer level, journalists reported pressure from government, security and ruling party officials, which sometimes saw the cancellation of critical radio programmes as well as suspension of presenters and talk show hosts for entertaining opposition candidates, especially Besigye. There were also increased cases of assaults and intimidation of journalists, self-censorship, and bribery” (CEON-U – ‘UGANDA GENERAL ELECTIONS 2016: REVISITING THE DEMOCRACY CONSTRUCT’ P:76, 2016).

It is not long ago, when Besigye was planning to hold a Radio Tour all-around Uganda, but the State sanctioned the radios holding him, but at the same period in time, the President could do the same and on the same topic, as Besigye was planning too. It is not many months ago. Therefore, the state is continuing to oppress and silence the other voices, than of the President.

Museveni likes to own the media, own the message and control it, therefore, he has lecture anyone to follow his voice and pattern, not question it, because then your not patriotic. That is what is well-known, so it is good idea that the Police are supposed to respect the covering of the journalists and their work. However, if they start to be to critical or get sources, which is questioning the Musevenisms, then know they will be besieged, be detained and lose their license. That is what Museveni does, so even if the journalist wouldn’t be arrested while on Live-Broadcast, like the police did in Kasangati in the recent year. Still, the NRM and Uganda Police Force has a long walk ahead.

It is nice that the IGP wants things to change, but they should also abolish POMA, so people are allowed to participate and be political active, without having the police breathing down their necks or coming with tear-gas, every time they congregate. This will certainly his a journalist, a camera-man or anyone covering it. They will not be totally shielded, I doubt the Police would do so. They usually cover all angles and anyone in the nearby passage get touched.

The Police can order and say they will leave the journalists be, but will they really follow through, when there are laws like the POMA in affect. That will not change the dynamics, unless, the Parliament makes other laws, that gives the provisions to the Police to act differently. Peace.

Dr. Kizza Besigye’s advice for termination of the NRM!

If you ever want the clear advice to bring down the dictatorship of President Yoweri Kaguta Museveni, who now acts and lives like he owns the Republic Uganda. Than if you want to get rid of that and want to use the advice of Forum for Democratic Change founder and former Presidential Candidate Dr. Kizza Besigye. Than his words and inspirational words should be for you. He explains the whole story and the whole theft of the state and how it was built around the President. How Museveni has taken all the institutions and the state is embedded with him. But that we already knows, therefore I have taken the part that people should listen to and use. The true defiance and defy the Museveni state, so that there are possible a peaceful transition from his rule. Where the state doesn’t belong to Museveni or the Movement, but to the people. The Citizens has a government who cares about delivery and not if Museveni get an expensive enough airplane or helicopter. Take a look!

Regardless of what the regime does, the people of Uganda are definitely closing in to take back their power and embark on a TRANSITION to a new dispensation.

The NRM/Museveni Junta has no legitimacy to amend the Uganda Constitution as it’s planning to do. This will be an activity of the TRANSTION PROCESS.

Immediate task: Termination of the NRM/Museveni Junta:

The following needs to be done to terminate the Junta’s control of our country:

1) Intensify the “awakening campaign”, for most Ugandans to become active in the processes of achieving a transition. Everyone has a role to play in achieving this.

2) Forming activist networks to make it possible to act together and to be coordinated.

3)Everyone seeking a democratic transition should take deliberate actions, individually or in concert with others to disempower and break down the Junta. Each one’s actions, however small, contribute significantly towards the desired change.

4) Public servants, including those in the security and military are called upon to join the struggle for democratic transition.

5) In coordination with other political and civil society formations, we’ll soon start various activities that will disempower and bring the, now fragile, Junta to an end.

The transition:

A transition process will start when the Junta ceases the control of the state- either, through popular actions or a dialogue process.

The key activities of the transition period are:

1) Government of National Unity.

2) A comprehensive review of the Constitution.

3) Rebuilding State institutions to ensure transparency in recruitment and a national character, a high standard of performance and public accountability; non-partisan character; high standard of discipline and professionalism etc.

4) Truth telling, justice and reconciliation.

5) Free and Fair elections” (Dr. Kizza Besigye, 11.07.2017).

The acts of defiance and trying to coordinate the powers to be. Make the state dissolution over the citizens who doesn’t act upon the oppressive measures dropped by the central government. That they does what they can locally to make changes to the state. This done in demonstrations and stop using the state based operations that makes the NRM regime so rich and can rig themselves into power. That they follow a leadership similar to Besigye and other who trying to dismantle the Presidency. For the simplest reason of getting democracy and getting rid of the dictatorship of Museveni. These words of Besigye should be seen as the guidelines for the patriots and the ones who wants the Republic run by elected men, and not selected men by the NRM. This is how it is now.

The NRM acts like they own the nation and the state, the State is controlled from the State House and the orders are from there. There aren’t anything done without the State House involved, that isn’t a healthy state. That is a Banana Republic and an undemocratic state where one-voice control it all. There is time for change, it has been a long time for change. This cannot only be done by the freedom fighter Besigye, but has to happen by the will and acts of the people. The people have to say, enough is enough. The impunity, the theft and the ignorance of needs of the people is enough. Time to stand-up and be together in the struggle for just ice, liberty and accountability. For a regime who wants to deliver government services and also give taxation with representation. Something that isn’t done now by this government and the President. Peace.
