UPDF Press Statement on Arua By-Election (16.08.2018)

Besigye says: “No Civilian should be tried in a Military Court Martial!”

We know that the National Resistance Movement (NRM) and President Yoweri Kaguta Museveni are breathing and living of militarism. That is evident with the recent Arua By-Election, every solution to a problem can be answered with the Special Force Command or the army. That is what the President and his henchmen do. Now, the opposition leader of Forum for Democratic Change (FDC) Dr. Kizza Besigye have addressed the press today.

Besigye have been charged for treason and all sorts of charges by the authorities, he has been hospitalized and lost his possessions over his campaigns against the NRM. Therefore, if there is anyone who knows what they do to you. He is the one, who has fought tirelessly and continued since he went out of the NRM himself. That is why his words matters, as he has been charged with treason more than once. He has been for long, house-arrested without charges and also detained more times than anyone can count. All of that because he has worked for a peaceful transition from Museveni. However, that haven’t happen. Now, there are other leaders whose in the same fire, which Besigye have felt in the past. This being Robert Kyagulanyi, Paul Mwiru, Francis Zaake, Kassiano Wadri and Gerald Karuhanga.

Here is extracts of his words:

There has been a choreographed presentation of a state of confrontation between opposition groups which I believe is deliberate and has ominous intentions” (…) “The people being detained have been held against a background of state inspired violence. There’s absolutely no way the regime can convince people that they can cover their tracks by planting evidence against our people” (…) “These tramped up charges are the rule in as far as NRM dress its opponents in an attempt to criminalize them. We demand that all those persons being detained be freed unconditionally and immediately” (…) “Certainly, no civilian should be charged or attempted to be tried in a military court martial. The main inciter of violence is the NRM junta and they shouldn’t transfer this onto anyone” (NBS Television, 16.08.2018).

Besigye is speaking the truth here. That is evident and not the first time, the NRM is creating a story to maliciously arrests and charge opposition. He has been there himself countless times. Now we are seeing this with other opposition leaders.

He is spot on, with the recognition, that only soldiers and generals should be Military Court Martial, but in the minds of Museveni and NRM. Everyone are soldiers of his NRA. They are all loyal to him and his guns. That is why it is okay to take civilians to Military Court. Even if that is only for the military and deserters. Which none of the MPs or their fellow activists are. They are all civilians who represents people and also citizens. They are not representing the military or the army.

It is not like these MPs was in the service or deserting from the army. These was civilians, therefore the jurisdiction of the Gulu Military Court is not sufficient. But mere militarism of politics. Which is the hallmark of the political landscape under Museveni. He does it again.

Besigye is right. Again. Speaking words of truth. Peace.

Museveni calls the Opposition MPs terrorist!

You would think someone who is supposed to be of a sound mind, would be careful throwing around the word and name-calling fellow politicians: terrorists. However, for President Yoweri Kaguta Museveni. This is very easy, especially, when the courts have charges these MPs with Treasons just moments ago. Just as that appears. A new note from the President arrives online. Trying to explain the world what is happening to Robert Kyagulanyi, Francis Zaake, Kassiano Wadri, Gerald Karuhanga and Paul Mwiru. All of them are in legal jeopardy, while their fate is awaiting.

The elections in Arua Municipality were held peacefully because the organisers of violence and criminality had been arrested” (…) “The cases of terrorism, damaging property, manslaughter etc against the Hons: Wadri, Bobi Wine, etc will continue. Their actions led to the death of a Ugandan, injury of a number of others and damage to property, so the allegations go. All those leaders, including the NRM members, should never encourage their supporters to violate the law, let alone themselves violating the law. Processions through populated centres without co-ordination with the Police should never happen. I never organize processions. I always drive to and from the rally site in my convoy. Sometimes, only the boda boda riders join me. The convoy moves fairly fast to the rally site and from the rally site, never touching the passers-by, the property of the people or the convoys of the other candidates” (Yoweri Kaguta Museveni, 16.08.2018).

Clearly, the message is out. That National Resistance Movement (NRM) and the President is not taking responsibility for the live bullets and the havoc the Presidential Guards did on the 13th August 2018 in Arua. All blame and responsibility are on the opposition leaders, who had no guns or ability to kill. They we’re just in the area and the needed scapegoats. These are apparently the Opposition MPs who have the balls to question the authority of the President.

The President is really taking it far by calling them terrorists, because their actions was terrorism. They acted with vile attempt to scorn the population and cause harm. That is what the President said today. Their actions led to the live bullets from the Special Force Command, that killed their own driver. He puts not the blame on the orders and the ones who carried the weapons, but the ones who possibly stood in the way of the weapons. That shows how insane the reasoning of the President is at this moment. If he thinks this is wise reasoning, it will only benefit the minds of Mwenda and Opondo, but not the enlighten ones. Who knows who orders the live-bullets and the ones who took the live of the innocent civilians. That was not the opposition MPs, but the government sponsored violence, which has ever since tortured and harassed these fellows MPs. Which some we don’t know where is and in what health-condition. That shows how dire the efforts to destroy the opposition is from this President.

He is acting as a terrorist, ordering guns and soldiers to street, he is the one in-charge of the men brutally killing and torturing their representatives. He is in-charge and should take responsibility. However, he puts the blame on the opposition. That is just his M.O. Peace.

The President’s Revenge: Treason Charges on the Opposition Leaders!

We saw this coming, this has been the writing on the wall. President Yoweri Kaguta Museveni and his Presidential Convoy, together with the forged and mockery of justice, with the “collected” evidence from the hotel in Arua. Is now the proof of criminal conspiracy, even if no one believes this. This the NRM regime who has decided to hurt and take out more opposition leaders, in manners we usually see to the Forum for Democratic Change (FDC). Now we see it with Robert Kyagulanyi aka Bobi Wine, Kassiano Wadri, Gerald Karuhanga and Paul Mwiru. All of these are now charged with treason for the attack on Presidential Convoy the 13th August 2018. That is what is happening.

While all of it is done in secret, as the lawyers, the public and the reasoning for these charges are not seen. Not even the knowledge of the health state of the MPs. We have just seen Francis Zaake, whose been really hurt by the Special Forces Command in the aftermath of the last days of campaigning. There

23. Treason and offences against the State.

(1) Any person who—

(b) unlawfully causes or attempts to cause the death of the President or, with intent to maim or disfigure or disable, unlawfully wounds or does any harm to the person of the President, or aims at the person of the President any gun, offensive weapon, pistol or any description of firearm, whether it contains any explosive or destructive substance or not” (Penal Code Act of 1950).

Two Credible reports:

First: “MPs Kassiano Wadri, Gerald Karuhanga, Paul Mwiru and 33 others charged with treason at Gulu Chief Magistrate’s court” (Sadab Kitatta, 16.08.2018).

Second: “Arua municipality MP-elect Kassiano Wadri has been charged with treason before Gulu Chief Magistrate’s court. Wadri who won yesterday’s Arua By-Election is accused with others of stoning the president’s motorcade” (The Observer, 16.08.2018).

We can expect that they used the Penal Code Act of 1950, the subsection 23 1(b) to charge all of them. This being the MPs who has shown power and ability to beat the NRM in an election. Therefore, Presidents revenge is now in full force. This is just like the times Kizza Besigye has shown how tired the public is of the NRM. However, the President cannot have it. Therefore, he makes his own rules and judgment on the opposition. This is happenings as the remains of the driver is already buried. While, the Special Force Command will not answer for their crimes and hurts against the public.

The opposition will answer for the forged charges and for their supposed treason. Because the President was again hurt by the lack of loyalty towards him. Everyone are supposed to follow his guidelines and they didn’t. There is no celebration in Arua. Where Anti-Riot Police is out and the military is in full gear. Like they were occupying the town. That is the humiliation, as the forged charges and misuse of treason is out again.

If the NRM thinks this is wise. It is not, it just shows the tyranny and the crimes against the public…

Kudos. NRM. You are showing your true face to the world over a By-Election, not even a General Election. Peace.

Arua By-Election: Kassiano Wadri wins, Arua said “No to Yellow”!

Ale leleko” – translated to “We don’t Want Yellow!”.

Kassiano Wadri, the detained politician are now the winner in the Arua By-Election, the one which was campaigning with Gen. Mugisha Muntu and others. His strong team and joint opposition campaign was winning the polls today the 15th August 2018. Just as the authorities are detaining and has harassed, even tortured several of his fellow MPs. This is clearly sending the message. That militarism is still active and if people are not following the program of the President. He will answer with violence and state using force to arrest them.

Wadri clearly been an answer that Arua was tired of the Yellow. They we’re singing this on the 10th June 2018, as they buried their former Member of Parliament Ibrahim Abiriga. Now, that has come with the ballots, as the Electoral Commission has announced the victory to Wadri. This is really damaging the NRM again. As an independent, a former Democratic Party MP for Terego County, has won the Arua Municipality.

So, Wadri has won this one, while being under military detention on an unknown location. This shows the militarism of the NRM. This is not stopping.

While this is looking a lot like the General Election, when Kahinda Otafiire lost to Capt. Mugabe Dononzio Kahonda in the district of Ruhinda Constituency. Who was in jail while the polls was going and again returning for 9 months in 2017. This is clearly, that the authorities and the government are mad that they picked someone else than their preferred person.

Now, Arua has done the same, as we don’t know where the Arua Municipality MP are at. He might be going to the Gulu Military Court together with the other MPs answering similar charges as Bobi Wine. Wadri might continue to be their MP from Prison. There are others who has been like that,

The opposition won this race, another By-Election victory, even when the President put everything into it. Used intimidation, used usual tactics, but they didn’t eat it. They didn’t carry it and accept it.

Wadri has won, he was not my favorite MP, but everything is better than the NRM and the militarism they are promoting.

Now we all can sing ‘Ale Leleko’, Arua didn’t want Yellow.

The proof is there. The NRM need to reconfigure itself, but that is impossible with the militarism and the President ruling with an iron fist and with live-bullets. Killing isn’t making him popular, they are seeing the evil and don’t want to be associated with it. Peace.

Arua By-Election: Return Form for Transmission of Results (15.08.2018)

Arua By-Election: Robert Kyagulanyi is set to be charged with treason, the same might happen to Zaake, Mwiru, Karuhanga and Wadri as well!

New reports from Arua and Gulu, is that the Police is now charging Robert Kyagulanyi, whose been hospitalized after severe beating by the authorities, are tomorrow ready to be charged with treason. This is the last attempt and resort of the National Resistance Movement (NRM) to retaliate against his popular uprising and stardom on the political scene. The same sort of forged treason charges has been put on Dr. Kizza Besigye after the recent elections and also why he had to flee into exile.

Now, Bobi Wine aka Kyagulanyi will go in the same shoes and his own way. This he most likely will do together with Kassiano Wadri, Francis Zaake, Paul Mwiru and Gerald Karuhanga. Whose all been in detention since 13th August. Their been incommunicado and not able to meet their lawyers or even close relatives. They have been moved for the last 48 hours between various locations and no one except the authorities has had that knowledge.

Therefore, these reports are striking:

Police displays the alleged two SMG riffle guns found in the hotel room of Kyadondo East MP Robert Kyagulanyi Ssentamu” (New Vision, 15.08.2018).

Moses Ali: Hon Kyagulanyi has been flown to Gulu hospital but he is now okay, he was found with a gun and he will appear before the court martial in Gulu The other 4MPs will appear before the chief magistrate tomorrow in Gulu. The total number of those arrested is 33” (Parliament of Uganda, 15.08.2018).

Moses Ali: Kyagulanyi Sentamu aka Bobi Wine to appear in court martial in Gulu tomorrow. He was found in possession of a gun and the other MPs will also head to court (URN, 15.08.2018).

Let me be perfectly clear and not misunderstood. This has happen before, that the Police and Army in Uganda has forged charges, put it on opposition members and made trials prolong their sufferings. Even to this day, Erias Lukwago and Kizza Besigye are answering for “crimes” done while protesting in the “Walk to Work” demos. Therefore, what is happening today and the news of what is scheduled tomorrow is really just the vindictive ways of President Yoweri Kaguta Museveni.

He thinks this is a wise way of silencing the opposition. While the car that was destroyed in the unrest in Arua are now on the streets of Kampala. He defended the live bullets and killings of the driver of Bobi Wine, while they are planning to take him to the military court and charge him with treason. Who knows who else will follow the program of bitter and fake evidence, if that will be Mwiru, Zaake or Kauhanga, even Wadri. Since all of them stood in the path of the almighty highness, the royal genius, Museveni himself.

What we are seeing here, is another violation of the rights, these gentlemen has to the rule of law. As their lives been in limbo for over 48 hours. Now within short amount of time, they will be moved to court and put on trial. Where most likely, it will end up in seeking more evidence and put them behind bars, while awaiting further examination and collection of evidence. As this is just the preliminary and need of witnesses and affidavits, as well as other court functions to make sure the proceedings are going as planned. If not the state might move the case to Moroto, even to Kampala. Just to seek to prolong the agony. That is just what the NRM does to opposition whose in the dire needs and who has striking high at the king.

No one is allowed to strike against the holiest of them all, Museveni. That is treason. That is why these gentlemen could all be charged with that, not only Kyagulyani, but the rest of them too.

We all have to see how this goes. But it is not the first time, that Museveni bitch outs and puts others on blast for his misgivings. Wont be his last either, as long as he rules, everyone else striking against him is doing treachery against the state. Since, Museveni is the state and everyone needs to follow his guidelines.

That is why Kyagulanyi is now getting the same treatment as Besigye. Everyone going against the king, better not miss. Peace.

Arua By-Election: How long can the Police and Military keep Kyagulanyi, Zaake and Mwiru incommunicado and without charges?

I wonder, not that this is new in the Republic, because this sort of treatment has been standardized under the Inspector General Kale Kayihura. Even him himself is without charges in detention without convictions or without proper charges as we speak. This is happening under the new IGP Martin Okoth-Ochola, who is following the same regime apparently.

Why I am asking? Is because Robert Kyagulanyi aka Bobi Wine, Paul Mwiru and Francis Zaake, together with Kasiano Wadri, whose been in detention and without reach since their arrests by Special Force Command on the 13th August 2018. They have all been taken by the authorities and we don’t know why.

The Criminal Procedure Act of 1950 section 17, which is still in force states this: “17. Detention of persons arrested without warrant. When any person has been taken into custody without a warrant for an offence other than murder, treason or rape, the officer in charge of the police station to which the person is brought may in any case and shall, if it does not appear practicable to bring the person before an appropriate magistrate’s court within twenty-four hours after he or she was so taken into custody, inquire into the case, and, unless the offence appears to the officer to be of a serious nature, release the person on his or her executing a bond, with or without sureties, for a reasonable amount to appear before a magistrate’s court at a time and place to be named in the bond; but where any person is retained in custody, he or she shall be brought before a magistrate’s court as soon as practicable. An officer in charge of a police station may discharge a person arrested on suspicion on any charge when, after due police inquiry, insufficient evidence is, in his or her opinion, disclosed on which to proceed with a charge” (Criminal Procedure Act of 1950).

So it is not like there are laws to this. But as the spin has gone, most likely the Criminal Procedure isn’t as important as the Penal Code Act of 1950 subsection 24, which states: “24. Penalty for acts intended to alarm, annoy or ridicule the President. Any person who, with intent to alarm or annoy or ridicule the President— (a) wilfully throws any matter or substance at or upon the person of the President; (b) wilfully strikes the person of the President; or (c) assaults or wrongfully restrains the person of the President, commits an offence and is liable to imprisonment for life” (Penal Code Act of 1950).

Clearly, as today’s defense of the “attack” on the Presidential Convoy, the military and police will with force use this against the gentlemen. Even if the driver of Bobi Wine is dead and the others was taken hostage and arrested directly at the hotel in Arua. As this was the final of campaigns before today’s poll in this By-Election.

This shows how dire and how much hurt the President is putting people through, he can make these men go to jail for life, just because he has the power and wants to send a message. No one, not Besigye nor Bobi Wine has any rights. Only him, he didn’t fight in the Bush to give other people freedom, he fought only for his freedoms.

That is evident, as the malicious and forged crimes are put on anyone who causes a threat or a stir in the eyes of the President. That is why its okay for the Special Force Command to aim and shoot at the car of Bobi Wine, but they are in legal jeopardy because of spin-control case of destroyed vehicle, which have been dipping through traffic in Kampala later today. That has been evident by all the photos on Social Media.

We can now wonder, what sort of charges, what sort of trial and when these MPs will see the light of day. What sort of custody or even state of health, as the state are barring anyone from seeing them. They can be at a military barracks or even in a long forgotten jail in Arua or Gulu.

We only know that the state has them for over 48 hours, been beaten by the Presidential Guards and now in limbo, both physically and legally. The only one living and breathing without any care is the President. Who always put charges on other people, but are never to blame. Even when he shoots live bullets at unarmed civilians. That is just the way he is and how little he care for his own citizens. Peace.

Arua By-Election: President Museveni’s defense misses it’s mark, the spin is out of control!

We went to the bush to fight for the right of making political decisions by Ugandans without intimidation by word or action. Anybody who threatens this will have himself to blame” (Yoweri Kaguta Musveni, 15.08.2018).

I didn’t know that the National Resistance Army (NRA) went to the bush to intimidate, threaten and come with military force against the peasants. That is what he is saying today. So, now it is okay to make decisions where the National Resistance Movement (NRM) are intimidating and harassing Ugandans, but not by any others. They are to blame. Right now the President has the swagger of Idi Amin and Milton Obote. The ones he fought against and beat. He is acting like they did and does to perfection.

As we continues, I will explain the lies of his writing, because it doesn’t make common sense. Not that common sense, is this man friend, more his mortal enemy. That is because he has overstayed in power and also lack of understanding of other people’s view. He needs everyone to follow his guidelines and that is a bit tiring. Therefore, let’s look at more of his nonsense today.

I understand that some of our people were worried about the endless criminal acts of elements of the Opposition, including the incidents of Arua on Monday. The elements of the Opposition, including Kassiano Wadri, Kyagulanyi (Bobi Wine) and others, who stoned our convoy, including my vehicle. The stones they threw broke the rear glass window of the car, where I put some luggage. That window glass is not armoured. There was no harm on the old man with a hat. It is a big shame to have such confused people who want to use violence to intimidate Ugandans. Nobody has a right to intimidate any Ugandan by word or action. Fortunately, my convoy did not react with fire in response to this attack. This was because we were not equipped for anti-riots. Our intervention could have resulted into people’s death because we only had live bullets” (Yoweri Kaguta Museveni, 15.08.2018).

Just as anticipated from this man. Museveni will blame the opposition. He will make the victims the criminals. Just as he did in Kasase and with Forum for Democratic Change (FDC) and Go Forward before the General Election in 2016. This is his Modus Operandi (M.O.).

Secondly, his car was made will ballistic glass windows and a specialized Toyota Land Cruiser V8, the expensive kind. Therefore, this argument falls flat. Like he would spare coins on the cars in his convoy? Most likely not. This is a man whose been eating of the state plate since 1986. That kind of President has the best gear and everything he wishes for.

Third argument of only having live bullets is just a mere insult to the public. That he doesn’t disregard or even thinks of the aim on the seat where Robert Kyagulanyi usually sits. It is like the Special Force Command (SFC) doesn’t carry other things. The Presidential Guards only have live bullets and nothing else. They are armed soldiers, they are supposed only to have that. They are not toy-soldiers. Therefore, you ordering them to hit the car of Bobi Wine was deliberately action from your side. The Intervention was a made up one. Everyone who has seen your car, has seen the perfect damage and only a fool would believe it was possible to create that sort of damage in that manner. Maybe Don Wanyama thinks Ugandans isn’t that bright.

Last, but not least. Weak tea, Mr. President, you have no right to kill, even if someone would try to block your Presidential Convoy. Your are not above them, your representing them. You have forgotten that. Peace.
