Makindye Court denied bail for the FDC activists that we’re detained yesterday

As of the actions yesterday by the Uganda Police Force that detained the men and woman who tried to attend the FDC Tuesday Prayers at FDC Headquarters at Najjankumbi have not gotten bail by the authorities (that is what is rumored to be the end-game). They are now kept in jail and detained as result of the actions of the Police who took them away on the spot.

The Activist have taken to Makindye Courts with the likes of Dr. Stella Nyanzi who also tried to attend the prayers without getting there before taking by the Police yesterday. So she and other activist are taken by Force after a day in being detained to court. As the men and woman surely will again be jailed as the Court has denied them bail. Though the certainty of their violation of law is not yet appeared. Other than them was involved in trying to defy the Interim order of 29th April 2016. At the Courts Pastor Sandra K. Ngabo and the kids, was not allowed to attend or allowed to enter the session in court.

IGP Kayihura have set Besigye under House-Arrest again today; This comes as a result of the defying the Interim Orders of the banned Defiance Campaign!

After a few days of ability too move freely the buck stops and the Police Force have again sieged the Kasangati compound of Dr. Kizza Besigye the former Presidential Candidate of Forum for Democratic Change. This comes after the FDC have shunned the Interim Order of 29th April as they planned to pray at their offices for the future of the country. “For God and For Country” this is illegal by the maneuvers of the Police today.

So that the Police Force already had taken many of major leaders and affiliated FDC members around the FDC Headquarters in Najjankumbi in Kampala. As I have taken notes on earlier today. But the movement from the Police to seal of the compound of Dr. Kizza Besigye is the latest, not surprising as the Police have a special unit soon made for him alone.

Dr. Kizza Besigye is yet again not allowed to have a life and be an ordinary person as IGP Kale Kayihura and his Police Force together with DPC Kasangati James Kawalya will make sure that he does not leave the compound; yet again!

This is just a mockery of justice as the Interim Orders made by the Deputy Justice Steven Kavuma/Stephen Kavuma is not justified.

As these orders from both the Deputy Justice and the Inspectorate General of Police have breached this two articles of the Uganda Constitution of 1995:

“27.    Right to privacy of person, home and other property.

1)     No person shall be subjected to—

(b)       unlawful entry by others of the premises of that person.

(2)     No person shall be subjected to interference with the privacy of

that person’s home, correspondence, communication or other property”

That is not what the State does when they are interfering with the communication and the correspondence of the actions of Dr. Kizza Besigye, they are breaching it again and again. To a point that this passage of the Constitution is useless, because Besigye is not allowed to walk out or be part of Political Party by the orders of Police chief today. Here is what piece of legislation that the Police Force is breaching when they stop the administration:

29.   Protection of freedom of conscience, expression, movement, religion, assembly and association.

(1)    Every person shall have the right to—

(c)       freedom to practise any religion and manifest such practice which shall include the right to belong to and participate in the practices of any religious body or organisation in a manner consistent with this Constitution

(d)       freedom to assemble and to demonstrate together with others peacefully and unarmed and to petition; and 

e) freedom of association which shall include the freedom to form and join associations or unions, including trade unions and political and other civic organization”.

So with these breaches and the stops proves how little both the value of the constitution of 1995 is right now for the NRM Regime, as they can take these rights away every time it is needed or can help them to shut down the opposition. The FDC is now practically a unlawful organization who is not allowed to function or have their Political work in the country.

Because they are not allowed to pray, that is part of the “freedom to practice” as every person supposed to have the right too.. the same right is to demonstrate, or the ENGLISH different where I am from and the ones that Stephen Kavuma and Kale Kayihura is reading. They are might learned in specialized and coded English that says something else than what I am reading, because the constitution is the LAW that supposed to set the BAR and level for Justice in a country. Henceforth the Constitution of Uganda, the Constitutional law of the nation. The Republic and the Constitution that gives the land the rule of law; and gives the rights to the citizens, so they can be lawful persons and make sure that the government does not act unjust towards them!

This action today is again and again taken the opportunity to House Arrest Dr. Kizza Besigye while the NRM Regime, their Police State and the reality of the thieving regime does not even honor the laws they got credit to make 21 years ago. The Police Force does not care about the general laws, they use the Public Order Management Act and the other laws that fits the authorities, even if they does not work in the manner the Constitution sets the precedence for the legal authority and the rights a civilian or citizen might have. Something that Dr. Kizza Besigye supposed to have and is now again taken away. Peace.

Its early morning people are supposed to get their morning tea and go to work. That is not the state of affairs in Kampala. Where many Opposition figures and leaders was going to attend the FDC Prayers at the Najjankumbi Headquarters even as the Interim Orders of 29th April 2016 got into effect and was submitted to the FDC on Monday the 2nd May 2016.

The Uganda Police Force and their Regional Police Commander of Kampala South Geoffrey Kaheebwa who has besieged the FDC Headquarters and taken away the men and woman who wanted to attend the prayers. This would be Dr. Stella Nyanzi, Lord Mayor Erias Lukwago, Sheik Katende and Pastor David Ngabo. Muhammed Ssegirinya of Councillor Elect of Kawempe was called by local Police Officer asked not to go to the Prayers! Fred W. Mutibwa the Eastern of the Desk Officer have also been detained.

“The right to worship is not entrenched in the constitution as being absolute. It is like any other form of right. The FDC weekly prayers are a way of mobilising people to demonstrate and these were last week banned by court,” said Gen Kayihura.

The Police have also detained Ronald Muhinda a radio journalist and Daily Monitors journalist Stephen Kafeero was both detained by them today.

“This defiance campaign is not a Besigye’s Defiance. It is the citizens campaign defying injustice. Kavuma decreed that its criminal to address the media but you are all here and I am addressing you. That is defiance.” – Dr. Kizza Besigye

So the actions that the Police Force is showing today are the blatant and violence of the citizens’ rights to express their freedom, even to simply pray for their country is now a crime. That should shock and awe about the steps that the NRM regime goes to silence their opposition now. Together with the threats of the journalists who are covering it will be detained from IGP Kale Kayihura says it all, how little they care for their own people. That the ones that reporting on the matter and being the watchdogs are told to keep their mouth shut, even on the World Press Freedom Day. The Police Force has really become totally political as the ones taking pictures of Kasangati getting detained. The world should suspend their aid and military support to the NRM regime as they don’t care for their own citizens and for any democratic values as long as the NRM and their Executive rules the country.

The actions of today speaks that level and the little care for rights of their fellow citizens even people showing up at the FDC Headquarters is a crime. Not even saying a word, just showing up at the Forum for Democratic Change Party Offices in Kampala. This is the true wonders of the National Resistance Movement; they went to the bush to be able to oppress their own people instead of being oppressed by Dr. Milton Obote. Long live the irony and the bleak sadness.

President Museveni might say he is stronger and better prepared as the procurement of tear-gas and anti-riots Armoured Personnel Carriers to bring down and smash the opposition. Something he often says with different words and with the same dead tone of short stuttering words. The NRM Regime is now so forced to force themselves on the Public that they have to detain citizens for praying. They are now detaining fellow citizens for praying. How does that feel fellow Christian and wanted –to-be Pastor Museveni? Does that feels like justice as you quote bible-words in your speeches and quotes of true democratic belief. While your actions and the actions of your Police Force are harassment of the opposition. That is just evident in today alone, and it’s not only happen today. It’s been a theme through your whole rule the only difference now is that the International media and world can get the information and you cannot supress it.

So in Uganda you have no right to prayer and the Police can detain you for praying. If it is so, then there are no essential freedoms as the People are told what to do and how to act by the Police State and the NRM Regime. They are now in full lock-down on the Opposition and monitoring all of them. More will be taken in and detained. If Kasangati get sealed off again would not surprise me and if the other leaders would be taken would be natural at this point. IF more members of the FDC is also taken it is Modus Operandi by them. On this World Press Freedom Day the Uganda Police Force have reminded the Journalist that it is illegal to cover or covering the Opposition. IT IS A CRIME to write about the Opposition and their demonstrations in Uganda. That is what the Uganda Police Force have told the journalists.

Just as expected the Ugandan Police Force would act out the Interim Order with Impunity and no honour. Today a man named Journalist Ronald Muhinda (Radio One FM 90) took this photo(the first photo); this photo in Kasangati on the first day the Interim Order of last Friday comes into effect as the FDC usually have prayers at their headquarters as a peaceful step to #FreeMyVote. Something the Deputy Justice Stephen Kavuma has seen as a malice attempt to undermine the rule of law, so apparently taking photos in Kasangati is illegal and is now the state of affairs.

“By press time, unspecified number of people including Daily Monitor reporter Stephen Kafeero had been arrested by police at FDC head offices in Najjanankumbi and Kasangati. However, Mr Kafeero was later released” (Daily Monitor, 03.05.2016).

This happens as early this morning as the news of Police Force have in deployed heavy guarded police at the FDC Headquarter of Najjankumbi in Kampala. So they wasted no time to use their force. The operation is under the command of the deputy RPC Kampala South Kaheebwa Geoffrey.

Even Pastor David Ngabo has been detained on the road towards the Najjankumbi to attend prayers. He has honoured his words last week where he said he would have no trouble being detained as a result of fighting the oppression. Also the other parts of Pastor Ngabo pastoral team have been detained.  Another man on the road who is detained is also Sheik Katende.

As we see with the journalist photo of Kasangati and with the state of Najjankumbi. There will be more arrests as I expected as the FDC leadership and FDC Youth Members will be picked up the Police Force. Early this morning Councillor Elect of Kawempe, Kampala Muhammad Ssegirinya got the call from DPC Kawempe and was told not to attend the prayers at the FDC Headquarters! Dr. Stella Nyanzi have also been detained on the road towards Najjankumbi to attend the prayers.

Friends,

Last Friday ‘Justice’ Steven Kavuma issued a so called interim order banning FDC’s planned peaceful protests, the Tuesday prayer and other such activities.

Most of us have focused on banning prayer. However, in its true form, this order is just one step towards banning FDC, and eventually all opposition parties and organised political groups in Uganda. This is why we should firmly resist this unlawful order.

It is likely that Col. Besigye will be put under house arrest again. If this happens, we appeal to the FDC President, Gen Mugisha Muntu and the party leadership to step in boldly to provide direction.

We also believe that FDC, being the party that won the presidential election, should FORMALLY seek the active cooperation of other like minded political parties, organised pressure groups and prominent individuals in society. This will give the struggle a more national and inclusive character. We hope that this will result into the formation of a solid “Alliance for Change”.

Kayihura warns the Opposition that the Demonstrations will not be like in 2011; and they will stand down until the country is “safe” in the “new” government!

As we could predicate like clockwork is that the Police Force would enforce the banning and interim orders of the Constitutional Court from Deputy Justice Stephen Kavuma yesterday. So since the clock is ticking… the IGP Kayihura had to speak his peace, and his Peace is not peace for anybody else then the NRM regime and the NRM cronies. As proven with his rhetoric today. Take a look yourself!

Kale Kayihura says this today:

“We were able to have peaceful elections contrary to what had been anticipated by many people. It was a big achievement and something you cannot take lightly because had we not done it, it would now be a different story” (…)”We can’t allow something similar to what happened in 2011 during the swearing in ceremony. Our main mission (of securing elections) was done but we can’t stand down until the country is safe and secure with the new government” (…)”There were predictions of violence before, during and after elections but thanks to the security forces that ensured this did not happen. The future of our country is very bright as people live in peace and happiness” (Kazibwe, 2016).

But last time it was the Police who came with brutality and used all force, dispersed and detained the opposition. Therefore Dr. Kizza Besigye had to go to hospital in Kenya before arriving back in Uganda. The Post-Election violence was massive in the last go-around.

This just had to happen the day after the Deputy Justice Stephen Kavuma who made the Interim Order of banning the Defiance Campaign. So that he comes with warnings is just a sensational as the sunrise every morning. It just have to occur; the issue is with the favour and extent he goes in. As he claims that the FDC and their campaign is to destroy the peace and the happiness of the country. That says that in his mind only NRM can bring peace, and if other disobey then they creating havoc and chaos. Initially saying so, but the words of non-violence during, under and after the elections of 2016 is a lie. He must have forgotten the pre-election violence of Rukungiri, Jinja and other. During the Campaign trail of Bukwo district, Ntungamo and the state of the violence before the Makerere Rally in February; then after that there been steady violence in the country. Something that IGP Kayihura knows as the army has been deployed in Kasese and Rwenzori. The Bundibugyo and Kapchorwa killings combined with the Kasese and Rwenzururu Kingdom killings proves the levels of blood that have been taken after the election. So a real it is not.

Combined with the connection of the Police Force enforcing preventative arrests, detaining, stopping demonstrations, applying detaining for unlawful behaviour even when they just trying to do party work. The other is the monitoring and spying on the opposition even when they have to comply for their actions to the Police as the POMA act says. And the Parties have obliges with that, even when he ruling party together with the Police have used all force to oppress them.

So I have trouble with the simplistic view of the acts of his Police Force towards fellow country-men and how he target fellow citizens who happens to be Opposition as enemies and with Anti-Riot Police Force. So the Peace he speaks is a forced peace. A Peace that is forced by fear and by tear-gas and detaining the opposition, not creating a space for dialogue or real peace in the country; because the Police Force does not hesitate to act upon the men and woman who might counter to the NRM, as they did to the people who closed their shops as a demonstration to the rigged election.

So his precaution of the 2011 Walk To Work is the statement as he has moved certain men who was involved like Andrew Felix Kaweesi and I am sure others are moved to the Kampala Metropolitan. Because they want to be sure that they can dissolve any demonstration as they want the perfect day for the 7th Term of President Museveni and his NRM that the Police Force is loyal too!

So we can be assured that the Police Force is ready to follow the words of the interim orders of the judge of 29th April 2016. Because he will use any excuse to extend the Police State of NRM and their thieving of power. Since the legitimate leader is not in the NRM, if it was so then they would not need to threaten the public. The Legitimacy is certainly bubbled down and cracked, therefore the silence and non-celebration except for the people of Uganda Media Centre who is paid men of the Ruling Party. So long behold the Swearing-In at Kololo Independence Ground on the 12th May. The reality is that the Police Force will use force on the 5th May, but if the Opposition able to mobilize as they did during campaign and Nomination day of the November 2015. Something I hope, and pray for, because if so the Police Force will be a small minority who should not hurt that big of a crowd and certainly that amount of people would monitor and share footage of the havoc so the media of the world would condemn the violent actions of the Police as they harass the Opposition with a steady pace. Peace.

Tanga Odoi cautions NRM speaker aspirants against personal attacks (Youtube-Clip)

The Chairperson of the NRM Electoral Commission Dr Tanga Odoi has cautioned aspirants for the position of Speaker that they risk being stripped of their candidature it if they continue using the media to malign each other.
Tanga has now issued a directive stopping the candidates from visiting media houses, which he claims has offered a platform of personal attacks. He says the central executive committee, which is the second highest organ of the NRM is due to sit on Monday to decide the selected names that will forwarded to the NRM parliamentary caucus” (NTV Uganda 2016).
