Magistrate halts case against IGP Kayihura pending constitutional court decision (Youtube-Clip)

“The Makindye Magistrates’court has formally stayed the criminal prosecution of the Inspector General of Police General Kale Kayihura and seven of his senior police commanders over torture. On Monday morning, Presiding Grade One magistrate, Juliet Nakitende, ordered that the proceedings against Kayihura be halted until the court receives further directives from the Constitutional Court. Magistrate Nakitende was moved by an order issued and signed by the Deputy Chief Justice Steven Kavuma last Friday, which suspended the said trial until the Constitutional Court hears and determines a petition filed by a city advocate Robert Rutalo challenging Kayihura’s trial on torture charges. Justice Kavuma’s order was served and presented before court by David Wandera Oudo, Rutalo’s advocate. The DPP represented by the Makindye court Resident State Attorney, Immaculate Angutoko, also informed court that he has officially taken over Kayihura’s prosecution and only needs assistance from private lawyers to avail him with the necessary evidence. After court, the petitioner in the Constitutional Court Rutalo told journalists that he was never paid by Gen. The Citizens’ Coalition for Electoral Democracy in Uganda (CCEDU) was launched on 19th August 2009. CCEDU is a broad coalition that brings together over 850 like-minded civil society organizations and over 25,000 individuals to advocate for electoral democracy in Uganda. The CCEDU secretariat is hosted by the Foundation for Human Rights Initiative (FHRI). CCEDU’s vision is to realize a Uganda where the principles and practices of electoral democracy are upheld. Its mission is to advance integrity and citizen participation in Uganda’s electoral process. CCEDU carries out its work in all districts and regions of Uganda. Since its establishment, CCEDU has been a leading player in advocacy for electoral reforms, observation of general and by-elections and civic/voter education campaigns.
CCEDU has a special mandate to observe Elections in conformity with the relevant international instruments governing election observation and the Constitution and National Laws of the Republic of Uganda
This statement presents the preliminary observations on the opening and setup process of the CCEDU Election Observation Mission in the five districts. CCEDU share a more detailed report with once more information has been received from our observers.

SUMMARY

In August 2015, government approved the creation of new districts. Subsequently, the EC, on 30 June 2016, announced the programme for Parliamentary and Local Government Councils election in five of the newly created districts namely Kakumiro and Kagadi curved out of Kibaale district; Rubanda curved out of present day Kabale district and Omoro curved out of present day Gulu district. The offices for election are: District Woman Member of Parliament, Local Council V chairpersons and Youth representative.
In line with its mission to enhance integrity, transparency and active citizen participation in Uganda’s electoral processes, CCEDU commissioned an election observation mission in the five (5) districts, to observe the pre-election, Election Day and post-election periods.
CCEDU has deployed 100 polling station observers distributed proportionally in all the 49 sub counties that make up the five districts. These have been stationed across all the 49 sub counties to observe and report on the Election Day processes at the polling stations. (See Annex of CCEDU Observer Distribution in the 5 districts). These 100 observers are supported by 5 district supervisors, one in each district. Additionally CCEDU members and staff of CCEDU secretariat are on ground supplementing reports from the stationary observers.

PRELIMINARY ELECTION DAY FINDINGS

The conduct of the elections was guided by the 1995 Constitution of Uganda, the Parliamentary Elections Act 2005, the Local Government Act 1997 as amended and the Electoral Commission Act 1997.

This statement is based on observer reports and incidents filed by all the 100 observers deployed in the 5 districts as at 11:40 am focusing on the opening and setup process.

Kibaale District 29.08.2016

Findings on Set-up and Opening Process:

On the opening and set up process, CCEDU has observed the following:

• Polling officials had arrived only in 28 polling stations of the 100 polling stations by 6:30am. Although Omoro had a higher presence of polling officials, on the contrary, polling officials in Kakumiro, Kagadi, Kibaale and Rubanda districts were not present at polling stations by 6:30 which affected the opening of most polling stations.

• The Presidential and Parliamentary Elections Acts as amended provide for polling to begin at 7:00am and end at 4:00pm. By 7:00am, only 10 polling stations out of the 100 polling stations observed in the five districts had opened. Although most of the polling stations (72 of 100 polling stations) observed had opened by 8:00am. 27 polling stations opened after 8:30am.

• Although 91 of 100 polling stations observed had all strategic materials, 5 polling stations in Kagadi, Kakumiro and Rubanda were missing indelible ink and 1 polling station in Rubanda was missing the voter register.

• In line with Objective VI of the national objectives and directive principles of state policy, which provides for gender balance in all government institutions, out of the 4 polling officials in the 100 polling stations observed, at least 2 of polling officials were women.

• In most of the polling stations observed, polling officials followed procedure by observing the presence of at least 5 registered voters in 95 of the 100 polling stations observed. Additionally, polling officials in 95 of the 100 polling stations observed displayed ballot boxes to be empty before voting commenced observed and in 93 of 100 polling stations observed polling officials followed the set procedure of sealing ballot boxes before voting commenced.

• CCEDU observers have also noted the presence of party agents across all districts. NRM party agents were present in all the 5 districts (in 96 of the 100 polling stations observed), Independent candidates agents present in Kagadi, Kakumiro, Omoro and Rubanda (in 75 of the 100 polling stations observed) and FDC party agents present in Kagadi, Kibaale, Omoro and Rubanda (in 58 polling stations observed.) However UPC, DP and PP party agents presence is limited to Omoro district.
Critical Incidents:

The following critical incidents have been reported and confirmed by CCEDU observers between 7:00am and 11:40am:

• Biometric Voter verification systems malfunctioned in Kibaale District, Buyanja County, and Matale A Sub-county and at Nkooko B polling station, Bugangaizi East County, Kakumiro District.
Voter bribery has been reported in Bubare C polling station, Rubanda county East in Rubanda District.
• A fight between agents of an NRM candidate and an agent of an Independent candidate were reported and confirmed at Birembo A Sub-county, Bugangaizi West County in Kakumiro District.
• In Kyanyi Polling station, polling station code 01 in Nyamarinda Sub-county, Kibaale district, it was observed that 4 people known to be deceased had their names ticked in the voter’s register as though the deceased had voted.
Kakumiro community radio was reported to have been campaigning for an NRM candidate in Kakumiro town council, Kakumiro district.
• Agents of independent candidates were said to have manhandled an agent for the NRM candidate at Kakindo sub-county, Bugangaizi West county, Kakumiro district.

Conclusion

CCEDU remains committed to objectively observing and reporting on the elections as they unfold in the five districts. We shall provide a comprehensive statement on the polling and closing, counting and tabulation processes tomorrow August 30 at 10:00am.

We urge voters to remain peaceful and come out in large numbers to exercise their right to vote.

To get the rest of left seats in Parliament and Local Government are for grabs in the newly formed districts of Rubanda, Kagadi, Kakumiro and Omoro. So the stakes are high, even the Electoral Commission have again delivered Electoral Material late at the dozen polling stations in the districts. The famous ways of Boda-Boda’s are the common delivery method in the early morning as the stations are set up and made ready. But as the rest of the General Election this year, there been issues of bribery, pre-ticked ballots and some occurring incidents of even burning down a radio station. Take a look!

Good News:

“Police says they have not registered any clashes in the ongoing elections in the five newly created districts” (933 KFM, 2015). This counter’s the reports and worries that Dr. Badru Kiggundu of Electoral Commission claimed before the elections that they we’re worried about violence during the election. Seem, like the EC Engineer we’re wrong on that point.

Kagadi 29.08.2016

From Kagadi there are already reported that the National Resistance Movement have delivered pre-ticked ballots. “In police cells at Kagadi is Arinaitwe Ismail over Arson attempt. OC Kagadi police station says Arinaitwe tried to burn a radio station” (Capital FM Uganda, 2016). So there is a special situation in the district for the NRM Flagbearer Steven Kasingbwe, Forum for Democratic Change candidate Peter Byahangire and Independent Candidate Yosiya Ndibwami.

In one polling station in Kakumiro district there been reported low turnout as well at Kabworo polling station in Kakumiro town council. In the district where you have to choose between Apuli Ssemanda of NRM and Independent Candidate Lawrence Bazala, so it will be interesting to see who becomes the elected in the newly created district. A problem at some of the Polling Stations is that people are missing from the Electoral Register. So Voters sent away even if they we’re supposed to vote in Kakumiro. Also reported this: “Fight between agents of an NRM candidate and an agent of an Independent candidate were reported and confirmed at Birembo Sub-county, Kakumiro” (…) “Kakumiro community radio was reported to have been campaigning for an NRM candidate” (CCEDU, 2016).

In Rubanda district this we’re reported: “Distribution of polling materials to the 32 polling stations within Bubaare subcounty Rubanda districts begins at 6:35am!” and this happen on Boda-Boda’s in the district. So at some at the polling stations the Election material came late. “At Kacerere 5 Polling Station, Rubanda, Voters are outside waiting for a candidate(s) who will pay them money for their vote” (…) “Many of those we have talked to are unwilling to go and vote before they are paid. A vote is going for, between UGX 500 and 2,000” (NTV Uganda, 2016). “The arrest was executed by Dannie Elly Ecwatu the Officer in charge of Muko Police Station” (…) “This followed a tip-off by residents of Muko. Arigye recorded a statement at Muko Police Station with case reference number 07/29/208/16 The suspect is said to be a campaign agent of the independent District Woman MP candidate,  Hilda Kabarungi” (New Vision, 29.08.2016). Also in Rubanda we’re FDC MP Hon. Francis Mwijuke: “Just to be sure. Tight marking. No taking chances. Here in the new district of Rubanda- Kabale monitoring the polling for LC5 chairman and the district woman MP” (Mwijuke, 2016). The CCEDU said this about the election in Rubanda: “5 polling stations in Kagadi, Kakumiro and Rubanda were missing indelible ink and 1 polling station in Rubanda was missing voter register” (CCEDU, 2016).

In Omoro the highly contested by-election as the Democratic Party, Uganda People’s Congress, National Resistance Movement and Forum for Democratic Change candidates who contest for the single positions in this elections. Today’s bigshot we’re when DPs Norbert Mao went out to stamp out his vote today at Labongologo Polling Station, where he voted for Omoro Woman MP and District Chairperson.

From Kibaale district:

The FDC candidate in Kibaale District Woman MP race, Counsel Proscovia Kunihira has Just Cast her vote . There Is largely a Poor turn up of voters in Kibaale and other 4 Districts where the élection Is taking place. But, we have total confidence Our candidate Will win This race and paint Kibaale and Bunyoro” (Mulindwa Walid Lubega, 2016). Also some technical difficulties as the “BVS malfunctioned in Kibaale District, Buyanja County, and Matale A Sub-county and at Nkooko B p-station” (…) “In Kibaale district, 4 people known to be deceased had their names ticked in voter’s register as though the deceased had voted” (CCEDU, 2016).

What Might happen:

So now it just to see how the Election will be tallied and the results will come. If there will be incidents like the NRM Primaries or even Presidential Election earlies this year where Pre-Ticked Ballots are coming from the sheds, Police Stations and from Candidates all over the place. Wouldn’t be surprised if the Tally Centre’s get raided by a disgruntled candidate or even comes with security forces to clear the result in the name of the candidate.

Let’s hope it gets totally free and fair, but if any indication and trust between the electorate, let’s say the citizens and the Electoral Commission as the sham and rigging we’re evident during last election. So the low-turnout now is a continuation of the low turnout at the Local Councilor Elections during the latest polls. So therefore the end-game will make this interesting as the proof of systematic malfunction might come again. Peace.    

Opinion: The Ugandan State Officials tries to Torpedo the #PoliceBrutality Case of IGP Kayihura!

The Ugandan Officials cannot help themselves even if they are drowning in Lake Albert; they will still claim: “There isn’t any WATER here!” That is just the way they are for the moment. They are just for the moment more focused on the brown envelopes from the Executive, than actually taking care of the neglect of service towards the citizens. That is the key for them at the moment… why do I say that?

Well, the Police Brutality and the questionable behaviour of the Police Force in the recent months and for a long while finally ended in a petition and a Court Case at the Makindye Magistrate Court. Something that first got the impunity of the Police Commanders and the Head of the Department IGP Kale Kayihura to disobediently smooch with fellow compatriots from Algeria than show up in Court that day.

After that we’re the violent supporters of Kayihura and the Police a lawyer’s car and also closed of the area to seal off the petitioners against the lawmen. The demonstrations and their behaviour we’re sanctioned by the Police, while the Police has on the same acts of the Opposition or ordinary citizens acted with violence or detaining fellow citizens. So the ironic staged affairs are openly showing the blatant disregard for equal laws for the people. The Police Force and their commanders are apparently above the law.

So tomorrow the Police Commanders are supposed to answer for their brutal affairs and misconduct in service as civil servants. They represent the people and they are supposed to create a safe society. Instead they are the once that have a monopoly on violence against innocent citizens. At the same time before the weekend the all but famous for justice and just understand of law. Honourable and Deputy Court Justice (DCJ) Stephen Kavuma kind of thinking of cancelling it or disperse it. This happens days after DPP Mike Chibita wanted to control it and now even the DCJ Kavuma even drops his few cents. So that the Makindye Magistrate Court becomes second fiddle to the other Government Law Officials who want’s to torpedo the case.

The DCJ Stephen Kavuma who has fought against the Forum for Democratic Change during the early year and suspended the party who answered the fraudulent election and cast of ballots. So the Defiance campaign we’re shut down with Interim Order, so again the Justice Officer showed his gallant ways to counter normalcy to please his fellow Executive. Because the Executive is above the law and the men who shield him can do what they please. The rest have to beg for mercy even when the Police go against the law and detain people without any warrant or just cause. If they are detained days upon days for wearing wrong T-shirt or being a part of Consultation meeting for the wrong party. Even when they are detained days upon days when the local judge have ordered them free, the Police Commander still let the linger in jail without any charge. That can be supported, but a Police Brutality case against the Police Commanders and IGP Kayihura proves that the law is not similar to them all.

The FDC and their men have battled court and have to take every precaution when they are detained and released from prison. And if they don’t show up on time to court, than they are sanctioned and house-arrested even when the warrant or charge is non-existent towards them. So when the Defiance Campaign we’re a problem they we’re on them like they we’re a disease and needed quick remedy.

But when it comes to his case and the case against the Police Commanders he can show disregard. He disgraces the court and the basic lawfulness. As he is on the top and sanctions other citizens and political opposition he acts without any caution. Still, with that in mind his men and leadership acts without honour or bravery.

IGP Kale 03.05.2016

While he had “supporters” around the Makindye Magistrate Court last time who violently and closed off the area where they tormented the petitioners. Now, today there a celebration and rally for Crime Preventers who are most likely going to protest the case in Kampala and Makindye tomorrow. As the shipped pocket-changed loose-police affiliated organization will be used as a tool to oppress the opinion of the police brutality. As they will be day after left behind in Kampala as the Uganda Police Force doesn’t pay them to travel home to whatever district in Ankoli, Acholi, Busoga or Toro they really are from. The same they did during the campaign period… The NRM and the Police Force cannot help themselves when it comes to this.

When just comes 24 hours to Kampala, the Crime Preventers as they have to fight extreme crime in the City just before Court case happens. Just as they think people are stupid and can’t put two and two together. They come to claim the legality and shut down the citizens who might want to show up and question the behaviour against the state and their top-officials. Something IGP Kayihura and his top Police Commanders are. They are top-officials and men who supposed to be regarded and leaders. The Uganda Police isn’t above the law, even if the lawmakers and justices are letting them go off the hook right now. Because the reality is that the citizens and the ones watching knows that the Police Brutality will be torn in the flesh. Not only to the ones who we’re beaten for “just being on the wrong street at the wrong time”, but also the leaders who sanctioned the behaviours of the Police Officers to do so!

They will not be forgotten, all the live-bullets, killings, the hurt people after the mambas and the beatings after political rallies. They will be victims that will be on the CV of IGP Kale Kayihura. This will be words in the remembrance of the Police Commander, that I’m not so sorry to say: “he didn’t give a fuck about the lives of the citizens of Uganda”. He only cared about his own position and the ruling party existence, but not justice for all men under the law. That is what this case and the actions of all parts of the state shows disregard for decency and justice. The other people are acted upon as they are guilty before proven innocent. While the IGP Kayihura and his Police Commanders are innocent and above the law, before proven guilty; which is the disregard of the law. If you think otherwise you have to get your mind corrected. Today is a weird news day, the news from Uganda are scattered and shows the ability of nobility from Ugandan Government isn’t there. The impunity from Uganda Police Force continues as the loyal men to IGP Kayihura doesn’t cares about the law. While President Museveni drops a few coins, while his MPs ask for millions shillings worth of cars themselves; and there over 400 MPs so the amount of money used on the cars are huge. At the same time the news of Danish Tax Payers have built most of the Courts, the NRM steady progress is in the hands of foreigners and not in the hands of the allocations done by Ugandan Parliament. If so, then they would have contributed some cash for the cement that constructed these buildings. And so it goes on!

Just as Dr. Kizza Besigye goes to Court to be allowed to leave for United Kingdom for his meetings with Ugandan Diaspora, FDC P10 and others who support his cause abroad. The former District Police Commander Aaron Buguma showed his disgrace for Law and Order with not joining his own court trial as his own boss Inspectorate General of Police (IGP) Edward Kale Kayihura the other day. So the law is different it seems depending on who it is served upon, especially the ones who supposed to guard it can run away from their brutal behavior against citizens.

While the riches of President Yoweri Kaguta Museveni, the walking budget, showed his mercy at the Bwebajja Fruit Sellers SACCO got Ush.100m and also giving away tools. This came today as Court Justice Bart Katureebe said this in Parliament: Danida built almost all the courts in Uganda, but why isn’t gov’t not taking interest in this. You have courts sharing offices with bars”. That means the Danish Tax Payers monies built the Courts of Uganda, not used the extended revenue made Uganda Revenue Authority (URA) or the generate tax that President Museveni so proudly speaks of. EU spokesman Kristian Schmidt: “Praise for Denmark by Chief Justice: “Danida built almost all the courts in Uganda”.

Members of Parliament procurement of cars:

Each of the 427 MPs will receive UGX150m by October to buy new car to travel to their constituencies, according to Speaker Rebecca Kadaga. Parliament will have to process a supplementary budget amounting to at least UGX64bn to finance the MPs car grant. This comes after Parliamentary Commission rejected proposal by finance ministry to finance MPs car grant in shifts with priority given to newly elected MPs” (WBS TV Uganda, 17.08.2016).

If the greed of the Members of Parliament wasn’t big enough their road safety fears are extended as the men and woman have discussed building a fly-over to make sure they are well. While the Uganda National Roads Authority (UNRA) need to do this instead of securing better roads so there is less accidents and incidents to secure road safety. The road projects are most likely to be fulfill are the ones where foreign donors dolce out money or grants through bilateral and multinational organizations as International Monetary Funds or World Bank instead of through the ordinary budget of the allocated funds in the fiscal year. So that the MPs have the balls to order fresh from the factory SUVs and ask for fly-over to secure their working place is disgusting.

Another issue today: “Appearing before the parliamentary committee on ICT, minister of ICT and National Guidance Frank Tumwebaze admitted that the NRM government has finally given up trying to control the internet especially social media usage in Uganda. Tumwebaze said “every time government tried to block social media, within a few minutes, Ugandans were already back on after invoking VPNs “(virtual private networks)” (The Observer, 18.08.2016). So the VPN shows the sanctions for national security doesn’t work… so the reality is that the Ugandan Government are beaten by technology and their own public will to do what they do. The only danger this is to the Ugandan Government is that the NRM cannot be only source of information and where the intelligence they are gaining. Therefore the Opposition will have a place to share information without fear online and on social media even if the Ruling Regime bans it or tries to shut it down.

I should have commented on the closure of Greenhill Academy for being World Bank and Mark Zukerberg (Facebook Founder) donated school for having books with explicit content; while the reports that most UPE schools lacks books or equipment. So the ironic side of the closure is amazing and foolery from the state. But wanting to take control of private institution is not strange in the context of micro-management style of the present day NRM.

There are always more, this my little update on today’s Movement news and the Parliament of Uganda. This has been hazardous… this has been special and would not be the last. Because this government cannot help themselves and we who follows now it! Peace.

Opinion: The NRM Government are a bunch of cowards as the IGP Kayihura case has changed hands

The Police Brutality case that we’re recently at Makindye Magistrate Courts, where the Police Commanders and Police Officers we’re no show. Also the main Police Commander, Inspectorate General of Police (IGP) Edward Kale Kayihura wasn’t there either. As the Police Commander we’re summoned by the courts. The spokespersons for the Uganda Police Force tried to defend the matter, but this proves their intent of not questioning the Police for their actions of violence without mandate against the random citizens.

The reports now that Director of Public Prosecution Mike Chibita has issued control of the case. Now we just waiting for Chief Justice Bart Katureebe to do the judgement in the case and dissolve the matter. As the National Resistance Movement does whatever it can to stall their associates from any kind of behaviour at this point. With the same mind stall the judgements for the opposition as the blasting cases against Forum for Democratic Change bigwigs are lingering in courts after the fraudulent election of 2016.

But before I blaze the glory of the grand election; let’s be clear the change of guards and the change of prosecution is to totally control and leave it out of the hands of the Makindye Magistrate Court. They want to centralize the evidence or destroy the affidavits, get the witness to silence and the men who beaten to whiskered away. Though the footage and video-clips of the clear violence without any aggression are clear indication of the system of oppressive behaviour from the Police Force; as they famous remedy of Political uprising and meetings is live bullets, tear-gas and Mambas with a dozen Police Officers ready to battle innocent citizens attending opposition party meetings, campaign event or consultant meeting.

This here is just the epitome of the problem as the IGP Kayihura is the one who are on top and orders. Fix the opposition and get them in line with the Movement. If the population don’t then they are protesters who need to be silenced by any means. That means beating innocent citizens on the sidewalk. So the people are by definition by the Police Commanders guilty before proven innocent. That is injustice into a system. A system created by the cowards of the Movement.

It’s hard to call the militarized political organization National Resistance Movement (“the Movement”) cowards, but in this instance they are. They so cowardly that they cannot handle to defend their violent behaviour or even listen to the witnesses they are bribing to silence. The actions of the weakness of character is so evident that the IGP Kayihura uses time with Algerian Police on visit and now Rwandan Police on visit; instead of defending the brutality of his officers on his command.

The Movement under their policing is proven now to be branch of the Political arm, instead of a State Security Organization that secures the safety of all citizens. The violence and brutality for waving the hands to Besigye is a crime; while the IGP Kayihura own demonstrators at Makindye Magistrate Court sealed of the Courts and wanted to lynch the defence of petition against him. This happen while his Police Officers we’re looking or just barely making sure they could leave the gates of Courts. Even of the Lawyer Abdalla Kiwanuka car was destroyed outside the Court.

When even today the Minister of Internal Affairs Jeje Odongo says “Kayihura is not a person but an institution and an institution cannot appear in Court”; a Hon. Jeje Odongo is a coward defending cowards without any sense of justice. The Internal Affairs are a barking dog together with the DPP Chibita who tries to subdue the citizens. The Citizens who deserves be innocent proven guilty. Right now that only applies to the IGP Kayihura and his organization, even some of the Movement cronies who defend the petition at hand.

The change of hands proves the administrative behavior to silence the Courts and control the cases that depend on the ethical backbone of the Movement. Which is to keep the loyal men around the Executive at any cost; IGP Kayihura is a loyal man to the Movement therefore he can do as he sees fit as long as this keeps the Ruling party at bay. The cowards use any methods and by any-means the courts, the legislative and the Police Force to silence the Republic. This case and the choice after the trial process are now in the hands of the DPP, instead of the judges residing at Makindye Magistrate Court. What a pleasant and coincidence that the man just took over the case and the evidence before really trying it through the courts. The validation for doing so is questionable, as the IGP and his subordinates we’re not there either.

Time for the cowards to get a reality check and question their behavior against their citizens as they acts as expected rulers instead of men and woman who are there on behalf of the citizens; if they acted so they wouldn’t accept to beat up and brutality attack the citizens. Because if they we’re a legitimate government they would acts as men and woman who cared about the citizens and not use them as pawns when they are needed; but when they are not needed they need to be silenced like they are doing now. Opinion: Why I have a giant problem with the Military Courts are pending the ‘Treason’ charge of Hon. Michael Kabaziguruka!

Today the case we’re adjourned at the Makindye Military Court as the Lieutenant General Andrew Gutti we’re receiving and holding the court martial over the newly elected Member of Parliament representing in Nakawa district of Kampala. He beat the former MP Hon. Fred Ruhindi of National Resistance Movement, the former Attorney General in Parliament who must feel the pain of not gaining public support after being loyal to his master in President Museveni.

With this in mind, this is a case that has been going for a while since his firsts arrest, raiding of his homes and detaining. After that the detained Hon. Michael Kabaziguruka have been tormented at the Kireka SIU, been changed prisons and not allowed to get visitations. While the Ugandan Police in May 2016 where looking at the working place, the home and any indication of the Treason plans “we’re supposed to have”. As much as the Forum for Democratic Change Dr. Kizza Besigye we’re also charged with treason and taken to Moroto and back to Luzira to serve his charge and waiting the pending case. He has been later taken on bond and has to go to court every second week. This kind of pleasant piece of freedom is not something the Republic gives to Hon. Kabaziguruka.

Hon. Kabaziguruka are charged and we’re supposed to plan to ‘assassinate’ the executive, the long-serving president, his excellency Yoweri Kaguta Museveni on his farm or so. As insulting and wild assumptions of the Uganda Police and their defense… this is sadly not a new way of silencing the opposition as they have done this before. That they did with detaining Besigye before and also his brother for the same charges. So the stories of this seem fabricated to suit the powers to be and keep them on top while the Opposition goes for justice in kangaroo-courts.

The Hon. Kabaziguruka is to set a standard and set the level of fear the NRM regime can put in line. They are putting a non-military man and not a soldier, lieutenant, sergeant or any kind of military position man, but a civilian through Military Court. If this we’re General Sejusa than it had made sense, as he hadn’t until one point not gotten his retirement from the UPDF. The issue with Hon. Kabaziguruka, he is not a military man who are a part of the UPDF at this point. Therefore he should been taken to ‘Ordinary’ Court and not Military Court. He should be tried by the people and their representative of understanding the law; not by military men who are loyal to Lt. Gen. Museveni, but a court who are supposed to be loyal the Constitution and the laws that are applied in the land.

This case shouldn’t be going in a military court; it has nothing there to do. It is a fiction of imagination that the society is so militarized and the levels of fear from the Executive that he has to take citizens who is not connected to his army to military courts to answer for phony charges. The case will be back to surface again on the 23rd August 2016. As the FDC Honourable have yet again to answer for made-up charges. The reality of the extent of impunity under Museveni is now ridiculous and malicious. What the outcome and if the silencing of the up-coming MP is an indication this 7th Term President and 10th Parliament MPs will have a hard way of legitimizing the political climate they are showing with  these arrests and this Police Force violently and with charges providing unsound methods to secure the power of NRM. But is it worth it though; When everything is corrupt and nothing is pure not even real or just? Is that what the legacy of Museveni will be that he corrupted all institutions and defended his accusation of grabbing power by taking innocent political careers as feeding his ego on the farm?
