Kasangati Court the Besigye case flies away mysteriously overnight to the High Court!

As the sun yet another day set over the Kasangati Magistrate Court and the final ruling on the petition from the lawyers of Dr. Kizza Besigye and his house-arrest since mid-February right before Election Day. The Police had without any information or assurance of the stakeholders of his case.

As the people and supporters had gained around the court had also the IGP Kayihura and DPC Kawalya of Kasangati deployed more police force and mambas, as the Police Force was ready and determined to block any rally for Kizza Besigye and the FDC Presidential Candidate.

Even on the roads leading to his home from the Trading Centre the Police had set up blockades and block the people from getting from Kasangati TC to his home. As the Police has no interest of following the demands of releasing Besigye out of his long-deemed house-arrest.

This saga does not seem to end as the Police and government of Uganda has no interest of letting the People’s President free from Preventative Arrest and making his home, his home again and not a prision as it, STILL!

The People in the area lost their cool when they heard that the case had been sent to the High Court. Peace.

Kasangati Court petition of Dr. Kizza Besigye house-arrest continues – Final ruling set to be tomorrow!

Today the legal-team of Dr. Kizza Besigye entered the Kasangati Magistrates court to continue the petition and filing of the case against the state and police house-arrest of his home in Kasangati, as it has been mid-February.

Witness comment on the matter today:

“Kasangati court has once again adjurned the ruling of the case in which Dr. KIZZA Besigye through his lawyer David Mpanga file a case against Inspector general of police and Regional police commader Kampala North to tommorrow ( tuesday) 10 am Kizza Besigye’s lawyers want court to order the with withdraw of police from Kizza Besigye’s home. This was after Prosy Katushabe the Kasangati court grade 1 magistrate over ruled the objection of state attoney calling for dismissal of the case. The magistrate gave Kizza Besigye’s lawyers to make their final submission by today 2pm. Hundreds of Besigye and FDC suppoters had thronged the the Kasangati court to witnessed the outcome of the court ruling”.

Lukwago and legal team visit Besigye’s home:

“At Dr. Besigye’s residence with Hon. Latiff Ssebaggala, Hon Kassiano Wadri and counsel Shifrah Lukwago. The Kasangati Chief Magistrate has overruled the state objection to Dr. Besigye’s application challenging the continued incarceration at his home and ordered the matter to be heard on merit. The final ruling shall be delivered tomorrow at 10am. The struggle continues”

Also the car of Dr. Kizza Besigye has been returned after being under Police custody for three weeks, and as the Kizza Besigye and fellow friends look over the car, they found that the Police had made new finishes to the car and added spy-ware and tracking devices to the car. As the criminal and fugitive they act as he is, as the Government and the Police still have him under house-arrest, keeps arresting fellow opposition activist as they are supposed in the Supreme Court Petition of Amama Mbabazi these days.

So the struggle continues kigwa leero! Peace.

Kasangati Magistrate Court yesterday Ajured the case, today they put a Pro Bono day. That means that the officials say they work for free this, in the UK a Pro Bono is a volunteer act for the public good. From Wikipedia: “A judge may occasionally determine that the loser should compensate a winning pro bono counsel”. That is a compensation of a losing case so that they get counsel, but the court of Kasangati called it Pro Bono Day, meaning that they don’t need to work the case, but giving the lawyers of FDC and Dr. Kizza Besigye compensation as Pro Bono, for the common good. Though it is literally one thing, stalling of time…

As the Legal-Dictonary.theFreeDictonary states:

pro bono: adj. short for pro bono publico, Latin “for the public good,” legal work performed by lawyers without pay to help people with legal problems and limited or no funds, or provide legal assistance to organizations involved in social causes such as the environmental, consumers, minorities, youth, battered women and education organizations and charities”.

So if the Kasangati court would do the public some good, they woudn’t do what they did today, with stalling the case another day. Here is from the official!

“With the Court Of Appeal Justice, Remmy Kasule and Madam Ruth Ssebatindira at the Uganda Law Society probono day at the Railway Grounds this morning. It’s a day where members of the legal profession offer free legal counsel to the indegents and renew our commitment to uphold the values of eqity and social justice”.

So Yesterday the Kasangati Court said the government needed more time, today they have only volunteers and can’t address the case, a Pro Bono litteraly means, but the government has enough resources to keep the Police and Military Police around his house, his area and roadblocks from Kampala as we speak, and get everybody interviewed, filmed and recorded before entering the gates of Kasangati, as the House Arrest continues. That is acceptable in the state of Uganda, as President Museveni continues to linger in power and keeping innocent men in jail and house-arrest without charges or reason for the arrest. A continuation that has been steady since before Election Day on the 18th of February 2016 and seem to go on until the swearing-in at this point.

That being said as a reminder of the lawfulness of the Kasangati Court as they work with orders from above, not from following the law for preventative arrests or anything else, that specifies time for it and release of the prisoner, as they have never taken away that Colonial law as the Government of Uganda has the need for it, it seems. Opposition leader Besigye have been under house-arrest since Election Day; giving more legitimacy to his cause by every moment; while the government can’t give real reason for the continued arrest!

Road Block at Kasangati 22.02.2016

Today I am writing out of my mind, as the was reported that the MPs in Parliament wanted reasons for keeping Dr. Kizza Besigye under siege with the heavy police brigade in Kasangati, Wakiso District. Something they been up to since 18th February, not that he has not been house-arrested before, that has occurred before, just as the travels and detentions at Naggalama Police Station and Kiira Road Police Station, is seemingly normal for the Presidential Candidate. And for a Presidential Candidate the close relationship with the men of law should not be there.

In his defense he is a politician, an opposition leader and the ghost of democratic leadership in Uganda, which is big thing for the men of law in Uganda. As the Police is a useful tool of the NRM-Regime and their tireless behavior to discredit the opposition. As they have created laws to get legitimacy for their actions as they have done tirelessly for attempting to stop opposition parties from organizing themselves. This done by the most biased law ever Public Order Management Act (POMA), IGP Kale Kayihura, CP Fred Enaga and all other Police Officers knows this law better then receipt’s for G-Nut sauces.

The continuation of the House-Arrest that lasted since mid-February without any charges or warrants, other than the preventative-arrest because if he is released; the country will go into chaos and contagious violence of near Armageddon proportion. As he does not have a tank, mambas, army and militias ready to re-create the massacre of Luweero again, the issue with that is that he is a peaceful politician with peaceful agenda, also talking about a peaceful transition and government that supposed to be accountable and the be transparent. While the ruling regime uses the army to suppress the people, police-force to detain people before trial and without charges, police-force who takes and detain people human rights activists and so. So the NRM-Regime and the government institutions are the ones who use the laws and order to keep everybody under their oppressive regime, while the NRM can do as they please and the opposition get detained or arrested for trying to their political work. Because the NRM has the Executive and he runs the place, so the other just should just kneel to throne.

Well, that is not a representative government right now. That is why the public is morning. Many might not be able to home today, because they couldn’t afford not to lose their jobs or would risk it by staying home. But the boycott can be important as the public performance of the black clothes or blue clothes as a sign of solidarity. But this here is not about that, still it is important to look at. This is a reaction to the unfree and house-arrested Dr. Kizza Besigye.

He has been house-arrested since 18th February, even been back and fourth since the 15th February, when he tried to get to have a Makerere rally and was taken back from Wandegeya roundabout. Then detained and then taken home. So he has only been really out of his home, when he went to All Saints for service, he has not voted in the local elections and been a citizen for the last 22 days, or even more. As the times he has tried to go out even to shop he has been arrested and detained at Naggalama Police Station. Before the Police took him home for more house-arrest, as that is their business at the moment.

This endless house-arrest is a meager display and arrogance of the ruling party, the Executive and the security forces who is in his hands. Besigye is under house-arrest for one simple reason: Legitimacy. The word who kills Museveni right now. No matter how the court case is going. How many people getting detained to hide the actual result, how many witnesses get missing, how many documents get forged to fit the announcement of Badru Kiggundu of 20th February; as the display of the government funds used to re-elect Museveni, the way the bribery and corrupt officials given voters money to sway their minds. This here is taking the vitality of the regimes new term and tenure. As the silence on the streets and the nearly warrior speech of NRM Secretary General Justine Kasule Lumumba right after the announcement! That should be visible sign as the only ones celebrated been Uganda Media Centre, Kiira Motors Company and the paid Youths who made a tiny made up victory rally in Kampala. Certainty is that simple reason for Dr. Kizza Besigye continuation of house arrest is Legitimacy.

EU Out of Politics Pre-Election Period

Legitimacy and legit assurance and trust come with validity of the support of your citizens and population. That you do not get with guns, arms and rigging government institutions. But that is not easy for President Museveni to see right now, as it is not “Who” but “What” for him while he talking to his best fans, instead for the cows of Mbarara.

There been demonstrations in the diaspora like in Boston, U.S. and London, U.K. but not openly in Uganda, as in Uganda the Army, Military Police and Police has been heavy deployed. The people trying to access Besigye’s home has been either sent away, stopped on one of the three main roadblocks from Kampala, or if they got close been detained the DPC Kawalya or DPC Kasangati, and then sent to Kasangati Police Station. While using around USh8m daily to make sure that the presidential candidate, so he does not make a fuzz. With 22 days detained by close calculation means the government of Uganda has spent on keeping Besigye under siege a total 22 days x 8M = 172m. And the total amount of Police Officers on the detail is 150. So the Uganda Police Force sees the pride in keeping him inside his gates and in his home in Kasangati. If not, they are wasting a lot of manpower and resources to keep him there.

That the People and Citizens have not done more can be questioned, as they really showed up at every step of his campaign trail from November until the last day before Election Day. Since then the mourning and sadness has attended the land, while the government and security forces has gone into state of emergency. As the state has deployed the army and police to intimidate the public!

Ugandan Election 2016 Grieving

So long as Kasangati and the home of Dr. Kizza Besigye is besieged by the police under order from up-high and the Executive; as he knows what torn and scars to his reputation it is to have him around and know that he does not have support that Besigye have! That FDC could not file a petition that was why I first suspected why he was house-arrested and detained. Now over a week later and still behind the Police siege; the Police siege is so great that the Police invades the homes of his neighbor’s homes to go to the toilet, as the police officers after so long has still no mobile-toilet or anything of sanitary facilities. Therefore they have done it around the house, before the ones got fined for doing so. This proves the disregard of the public and how the people who happen to live around him now, get the issues with police. As the reports of people struggling to visit neighbors and move around the area, as the police check everybody.

With that in mind, people should know by addition to the Besigye home under siege, the people around also besieged and even “invaded” by the Police. That says how far this guy’s goes with efforts and reasons. As still days upon days an opposition leader is behind siege and not allowed to live normally because of his wish to create change and another type of government. That is the “sin” Besigye has done and why he is behind the siege. While the world is forgetting and the people seem to forget that they supported him during the pre-election period and just wanted be part of rallies, and not create the change. If not the fear of the Police and Army with their ability of create violence to citizens and detaining people. Now it is so strong that they do it because the government spread massive amounts of fear. I think is the fear and the mourning, not because they don’t believe in the change and the wish of changing government that actually represent them and not representing Museveni. As it does now!

So Uganda should #FreeTheVote #FreeBesigye and Kigwa Leero! The long staying and prolonged house-arrest does not make sense, but to validate the legitimacy of Besigye and proving as Gen. Muntu and others said it was a Coup d’état on the 20th February as the army was heavy deployed and police in the streets, not celebrating crowds for yet another term for President Museveni. Peace!

“A cloud of uncertainty hangs over the busy Kasangati suburb, an area now synonymous with opposition Forum for Democratic Change’s demands for change.  The Police have been deployed at every turn along the Kasangati – Nangabo road; with two road blocks mounted before one reaches Dr Kiiza Besigye’s home. Bird songs can be heard in the silence. The European Union election observer’s team is at it again. The team reiterated their concern over the continued detention of col. Kizza besigye even after the 18th February polls. The deputy chief observer Marian Gabriel says that their concern still stands in regard to how the state has handled the opposition leader. The FDC candidate Col. Kiiza Besigye who has been under house arrest for the last 12 days lost in the recently concluded presidential elections however he contests the electoral results. Dr. Kizza has limited access both to and from his residence and has been arrested several times since the declaration of the president of Uganda. The US embassy in Uganda once released a statement calling for Besigye’s immediate release. The statement warned that Besigye’s house arrest and other actions by the authorities are impeding efforts to challenge the results of the election.  The status quo however has not changed. Breaking down the words: “Resistance” and “Defiance”; As the Ugandan Police will not leave Dr. Kizza Besigye’s home until “Defiance Campaign” is discontinued; Long live the Irony!

Here is what is the difference between «Resistance» and «Defiance», just as the Uganda Police and the Electoral Commission doesn’t discuss the value of the words and says FDC has to stop with their campaign of Defiance, while not stressing the “revolutionary” and bush-war political party National Resistance Movement is okay, as they are was resisting the Obote dictatorship in the 1980… and has resist his force ever since.

I will publish this for the matter of pointing out how the words mean and what kind of political play that is played out. As the Police has said they will continue to squat outside of Dr. Kizza Besigye until he gives up the ideal of defiance. Well, let see the different value of them. And since they both are words taken from the queens language let me take the official source and respected dictionary of the Oxford Dictionary.

Here is Defiance:

“Open resistance; bold disobedience: an act of defiance the demonstration was held in defiance of official warnings” (Oxford).

Origin: Middle English (denoting the renunciation of an allegiance or friendship): from Old French, from defier ‘defy’” (Oxford).

Resistance by understanding by the Oxford definition is refusal or to comply with something. “Hold back” from the authorities as the French did with their resistance and went behind the back of German invasion of France in the Second World War. While Defiance is OPEN resistance, not only holding back, but BOLD disobedience, that is the message Dr. Kizza Besigye sends. That is not that far from each other. When you see that defiance is to defy somebody and their rules, while resistance is to refusal to accept or comply with something. That both actually is meaning that the President is sending! That he is “resisting to comply” with something as he done since the 1980s, the resisting to become like predecessors, though apparently after this election, he became like them.

Defiance campaign of Dr. Kizza Besigye is on the same scale as Resistance. There is meager difference, the other difference that being a Resistance Movement has a meaning as well. One is open and bold while the other not following orders. So I don’t see why the Movement, the Electoral Commission and the Police should have troubles. If the continue to do so, then the NRM should fix their name. While I speak about their name, let us see what the Oxford definition is!

What Oxford dictionary says about an Resistance Movement:

“(also resistance movement)A secret organization resisting authority, especially in an occupied country: he went underground and joined the resistance’” (Oxford).

The irony about the name of NRM is  National Resistance Movement. A Movement that is underground and a secret organization that is resisting authority; especially in a occupied country. I am sure the Ugandan people feel a little occupied as the soldiers and police wander down the streets and the mambas are visible in broad daylight. The NRM is not an underground organization and such, but it is ironic that they have that name and has “Resistance” in the middle, as they are “holding back” something. As the NRM gives officials warnings and Kizza Besigye and the FDC are defying the messages and open decrees that the government have given him and his party officials.

The irony is now open and in the wind. As the Police and Army should not have a reason by the definition of the words to against “Defiance” as the ruling party is a Resistance Movement and even speaking of pride of their “Resistance”. That there is viable and honest approach to the matter and that nobody has taken it  and demolish the non-sense is for me weird. So if the authorities are serious and respectable. They would stop this at once, actually yesterday! While we all know, but they don’t their own words. We can see that the NRM cannot see the value of their own middle name “Resistance”, therefore their problem with “Defiance” can be seen as pointless. .But the campaign of Defiance should not be in the issue in the land of the RESISTANCE Movement!  Peace.  

The Police shows their arrogance toward the FDC; the Police said they had the ability to fill in the Petition!

Well I will start with a quote from the Uganda Police Spokesman as it says it all! Read what he is saying: “Confining Dr. Kizza Besigye could not prevent FDC from filling a petition if they wished so” – CP Fred Enaga (Kampala Dispatch, 02.03.2016) to the press on the 2nd March 2016.

The days on end with house-arrest, the days on end with detaining at Naggalama Police Station and Kira Road Police Station for going out his home, and that is not preventing him filling a petition? Mr. Fred Enaga is you listening to your own reasoning?

You guys in the Police have done everything in your power to destroy the ability for the FDC to fill a petition. You have guarded the FDC Headquarter at Najjankumbi, attacked and arrested FDC staff at one point. You have stopped FDC Officials and FDC agents who had the Declaration Results Forms. So you could get the DR forms and save face for the mismanagement of the Electoral Commission during the days after the Election Day and the tallying.

If it is arresting continuously FDC agents and men who have evidence of rigging; if that is not stifling the works on gathering evidence to file a petition, than your stupid or ignorant Mr. Enaga. But you’re just saying the words IGP Kale Kayihura want you to say.  You are just proving that the Police is one of the tools to demolish the opposition; as that is the wish of President Museveni.

If not stopping Journalist around Kasangati to report the movement of your police force is not stifling the world to know your mental violence against Dr. Kizza Besigye. Than I don’t know what freedom is?

A little example to you Mr. Enaga:

Mr. Enaga, I hope you get house-arrest, get your people who work for you perpetrated by men of law, and stifle your every movement. Take your car away from you while you go to church. Get your credited police force to get tear-gas into the offices where you work and get men with riot-gear to detain you. Guard the building you work at and not give your ability to work. I will execute this orders to this to you because I have: “intelligence that you’re terrorizing your own citizens and planning to persecute innocent people and hurting them with mambas in the street and house-arresting people without charges”.

Than you can try to do police work and speak your mind to the public. I am sure you couldn’t even put a parking ticket in Kasangati, which was the official excuse for detaining Ingrid Turinawe of FDC and NBS reporter Remmy Bhati who was on Live-TV yesterday.

I do not really wish you this treatment Mr. Enaga; the treatment your Police Force has been doing to the FDC has gone through. For the simple reason: I don’t wish any men or woman go through the hardships that the FDC are and the life that Dr. Kizza Besigye has right now. Mr. Enaga, you sound like fool and act like a fool. Please look at yourself and your police force, be proud of your nonsense. Peace.
