Besigye Case-State Witness Contradicts Himself (Youtube-Clip)

On the orders of the sudden change of guards from the Calvary to leave the home of the People’s President in Kasangati; Let be clear the message of IGP Kayihura is not doing this out of goodwill; the Police leaves because Mzee thinks he is safe

IGP Kale Kayihura: “We shall not allow Kizza Besigye to continue violating the law. We shall watch his conduct to ensure people and property aren’t in danger. We are extending a token of goodwill but we expect him to respect the law”. He also said: “he has instructed Kasangati Police Station DPC to withdraw deployment outside Dr Kizza Besigye’s home as they maintain close monitoring of his movements to ensure people’s safety”. He said this today at a Press Conference at Nguru, the Police Headquarters.

This was supposed to happen at the Kasangati Magistrate Court earlier today:

High Court judge Justice Elizabeth Kabanda is expected to rule on the matter in which the DPP is challenging Kasangati grade one magistrate’s decision of continuing with the hearing of Kizza Besigye’s case challenging unlawful incarceration at his home.

While that was supposed to happen this morning after over 40 days without charges or warrant the IGP Kayihura has ordered the Police to leave the property of Dr. Kizza Besiyge.

Let’s be clear on the matter, it is not good-will, it happens the day after the petition and the “official” post-election period is over. Because now the judiciary and the Electoral Commission is scotch free by law. Therefore the “threat” of Dr. Kizza Besigye and his FDC is gone in the matter of the law and the Elections laws of the country.

IGP Kayihura says it is goodwill that they leave, be clear it is not and they have been squatting in an unlawful action against a presidential candidate and besieged his legal political party. Now it’s supposed to be ordered by him to the local District Police Commander James Kawalya of Kasangati. They have been there for 41 days!

How is it to violating the law to defy the regime who detain you without reason while preaching and executing orders who resists common sense, as the ruling party is following a Resistance Movement, but cannot handle Defiance; that must be a lie as the defying the matters is clearly resisting and being of resistance towards what was then an oppressive regime of Obote. They did their resistance against that and took power. So it is foolish to stumble over the rhetoric of defiance campaign as the defying of the regime who can’t stand by their unlawful actions and their draconian laws.

During the 41 days, twice the IGP Kayihura has gone out with statements and press releases and claimed he was not to be under house-arrest, but with the orders today he establishing precedence as they have closed his area and his movement. They have taken him lots of time to be detained at different Police Stations and sleeping at night in his home, before the Police-Van stopped coming in the mornings at his home.

The Police have detained people trying to visit him, not letting FDC officials getting to his home and conduct party meetings, they have roadblocks and even squatted at neighbors’ homes since the Police never established mobile-toilets to the Police-Officers who besieged his home.

So the whole ordeal is messed up and the UPF, IGP Kayihura and the NRM-Regime do this like amateurs and like fools. They whined-up the Electoral Process, the people who got ecstatic and think that there will be changes, but that is not the fate of the people, as the NRM-Regime had it all already decided for them.

They might leave him for now, but don’t be surprised if he leaves his compound that the monitoring of his movement will leave him the opportunity to yet again visit and be detained at Naggalama Police Station or Kiira Road Police Station, even if he is extra lucky get a arrested and taken to Kampala Central Police Station, he knows the cell of every station because of the special place in the heart of Mzee.

What they fear is that he can ignite the people and no matter how much the army or the Police try to control them, they cannot shut it down when it becomes like his Nomination rally in November 2015. So they have not kept him under house-arrest since mid-February out of good heart or of the best of the country, but for the best of the Executive and for him to dissolve the will of the people as the monument of the opposition have been under siege and not really had the freedom or liberty to be an ordinary human being.

So IGP Kayihura, you can stick your “Goodwill” up your blindly following the Executives behind and take that arrogant mentality somewhere it is fitting. Because you have told fairytales and told nonsense for so long that the goodwill you speak of, is not a true assessment; for the simple matter you have no charge or warrant, taken the freedom of a presidential candidate and taken it away with force and made his home a prison.

Also the blatant disregard done by the Kasangati Magistrate Court and the judges who has used Pro-Bono, Waiting days and then send the matter to the High Court without the judgement been done there either. Therefore the matter of illegal house-arrest was today been set to determine at the Court again. While the IGP Kayihura orders might inflict and gives “freedom” under “monitoring” Police proves that he is still seen as a “criminal” by the NRM-Regime. Because a free-man and ordinary citizen would not be monitored and followed by the security organization. That is something that IGP Kayihura and the NRM have totally forgotten. But hey they don’t believe in the will of their people, only of the one man with a vision; the old man with a hat who has the only vision that matters and the orders that IGP Kayihura follows blindly.

This also happen at Kasangati today!

Besigye Reacts To Supreme Court Ruling (Youtube-Clip)

Kasangati Court has a “Volunteer-day” and stalls the verdict for Dr. Kizza Besigye House-Arrest!

Kasangati Magistrate Court yesterday Ajured the case, today they put a Pro Bono day. That means that the officials say they work for free this, in the UK a Pro Bono is a volunteer act for the public good. From Wikipedia: “A judge may occasionally determine that the loser should compensate a winning pro bono counsel”. That is a compensation of a losing case so that they get counsel, but the court of Kasangati called it Pro Bono Day, meaning that they don’t need to work the case, but giving the lawyers of FDC and Dr. Kizza Besigye compensation as Pro Bono, for the common good. Though it is literally one thing, stalling of time…

As the Legal-Dictonary.theFreeDictonary states:

“pro bono: adj. short for pro bono publico, Latin “for the public good,” legal work performed by lawyers without pay to help people with legal problems and limited or no funds, or provide legal assistance to organizations involved in social causes such as the environmental, consumers, minorities, youth, battered women and education organizations and charities”.

So if the Kasangati court would do the public some good, they woudn’t do what they did today, with stalling the case another day. Here is from the official!

From the FDC:

“Disappointing..that officers of court should use technicalities to perpetuate abuse of individual’s rights. The police chief isn’t untouchable, can be sued. “ -Mr. Daudi Mpanga, Barrister for Dr. Besigye. Dr. Besigye’s case adjourned until Monday because it’s pro bono day”.

From Erias Lukwago today:

“With the Court Of Appeal Justice, Remmy Kasule and Madam Ruth Ssebatindira at the Uganda Law Society probono day at the Railway Grounds this morning. It’s a day where members of the legal profession offer free legal counsel to the indegents and renew our commitment to uphold the values of eqity and social justice”.

So Yesterday the Kasangati Court said the government needed more time, today they have only volunteers and can’t address the case, a Pro Bono litteraly means, but the government has enough resources to keep the Police and Military Police around his house, his area and roadblocks from Kampala as we speak, and get everybody interviewed, filmed and recorded before entering the gates of Kasangati, as the House Arrest continues. That is acceptable in the state of Uganda, as President Museveni continues to linger in power and keeping innocent men in jail and house-arrest without charges or reason for the arrest. A continuation that has been steady since before Election Day on the 18^th of February 2016 and seem to go on until the swearing-in at this point.

That being said as a reminder of the lawfulness of the Kasangati Court as they work with orders from above, not from following the law for preventative arrests or anything else, that specifies time for it and release of the prisoner, as they have never taken away that Colonial law as the Government of Uganda has the need for it, it seems. Kasangati Court Adjured the case of Besigye till tomorrow as the Police needs more time to respond!

It is continuation of the Dr. Kizza Besigye’s siege and house-arrest in Kasangati, Wakiso district. The Police have held him under house arrest since right before the Election Day on the 18^th February 2016.

Today the petition to Kasangati Court in Kasangati Trading Centre to free Besigye; early in the morning the judge of the court where they said the Defence had to file it in before 4pm today. The Court said they needed more time to respond to the filed petition to the court. The respondents in this case Police needed more time to respond. So the court is adjured to tomorrow.

From the FDC themselves:

“Mr. Daudi Mpanga, lawyer for Dr. Kizza Besigye informing press that Dr. Besigye’s case is now fixed for hearing, this Friday at Magistrate Court, Kasangati. The case was adjourned to Friday 18th March, 2016 to give the State more time to prepare its response” (FDC, 17.03.2016).

As this happen there has arrived more Police and Security guards around his home. There is already three roadblocks and set of police in the area. He is seemingly a great criminal now that he has filed a petition to the court to be released free from his preventative-arrest and get justice, as he went from being a presidential candidate into a house-arrested fellow without charges, which are still at that state to this day.

The Police of the area have used the time to stall a petition against the Presidential Election of 2016, as they have gone aggressively against the FDC. So this is a continuation of that and the result is that the authority continues with the unlawful behavior, as they use the Preventative-Arrest of Besigye and monitoring everybody in the area. So the time is ticking and the unjust behavior as the state keeps him on guard and under siege. The proud state of Uganda Police has drained down to this and President Museveni must be with his cattle smirking. Peace.  

Uganda Elections unfolds; Dr. Kizza Besigye under house arrest; Erias Lukwago arrested; NRM Tally Center legally address the press(?)

The third day and the polls continue to dropped while ballot boxes comes to surface as we know the police officers took them away on the polling stations. There has now been found at NRM candidates as Hon. Oulanyah of Omoro had boxes hidden, and Police had boxes containing the votes for Dr. Kizza Besigye.

The Dr. Kizza Besigye story continues:

As the third day and the counting continues. Dr. Kizza Besigye is after being arrested twice, is now put under house-arrest in his home in Kasangati in Wakiso District, after being taken by force yesterday from the FDC headquarters in Najjanankumbi.and later detained at Nagalama; and at late night driven home by Police, even if the FDC men wanted to make sure that Ingrid Turinwa was also safe, but the Police whisked away the men and sent them home. That was not only Besigye, but also Gen. Mugisha Munut and Biriggwa Wasswa.

Red Pepper writes:
“DEVELOPING STORY: Police has blocked all roads leading to the home of Kizza Besigye in Kasangati. No person is allowed to enter or leave his home. Journalists have been turned away” (Red Pepper, 20.02.2016).

Daily Monitor writes:
“A heavily armed police garrison at Dr. Besigye’s home blocks our editor, Bagyenzire Atuhaire Alex from accessing the home of the FDC presidential flag bearer; they won’t take questions on who has ordered them to block visitors to Dr. Besigye’s private home. Besigye is under siege, he can’t leave home. All entrances are blocked by police” (Daily Monitor, 20.02.2016)

As well as journalists not allowed at the gate of his home, his lawyers Daudi Mpanga and Ernest Kalibbala have been turned away at the gate. The FDC Campaign has also not been allowed to enter his home or be there together with Dr. Kizza Besigye.

Dr. Kizza Besigye was taken home by the Police without a belt, phone or money. Besigye does not have a phone for the moment, the internet in the home is jammed by the police. This is reportes of this from Winnie Byanyima the wife of Besigye .

The amount of Police in the surrounding areas:
“1200 policemen and military have been deployed on all major roads that lead to Besigye’s home in Kasangati” (Kampala FM, 20.02.2016).

As Lord Mayor Erias Lukwago tried to access the house of Besigye he was arrested by the Police today. FDC Party President Gen. Mugisha Muntu has not been allowed through the gates to Besigye’s home.

Amama Mbaabzi house in Kololo suburbs of Kampala was sealed off yesterday by Police and Field Formation Unit. Have not heard any reports since then, so expect that he is still under house-arrest today, and would like to be verified if not.

There have been put up roadblocks on Entebbe Highway around Lubowa and it’s been there since last night!

“Roadblocks mounted on major roads in & out of Kampala: Jinja Gayaza, Kampala-Gulu, Masaka, Hoima, Kampala-Mubende & Entebbe” (WBS TV Uganda, 20.02.2016).

In Kasese:

“Reports reaching us indicate that: One person shot dead as police disperse protesters in Kasese. People are demanding release of final results for Thursday elections” (Hello Uganda, 20.02.2016).

Ofwono Opondo has continued his arrogance on today’s Capital Ganag:
“It is not enough people know there was an election. The people who cast the votes decide nothing. The people who count the votes decide everything”. Comment: He has just followed the Dictator of Joseph Stalin and he is such an inspiration these days for you.

As the missing ballot boxes seems to surface:
“Besigye has won Acet, Odek and Omoro counties, but Police hid the boxes” (87.7 Kampala FM, 20.02.2016).

Hon. Oulanyah reports:
“A total of seven white ballot boxes, three of which had pre-ticked ballot papers were found in Hon. Oulanyah’s Omoro constituency this morning, reports indicate” (Red Pepper, 20.02.2016).

Interesting right? Especially with the findings in this home as well. There is certainly big tale of fixing results from Omoro alone. And wonder if that is the only area where the elections has unfolded like this. Let all of us just think about that while the Electoral Commission adds more numbers from their cooked numbers as we speak.

A Plot Twist:

I have officially quit listening to Andrew Mwenda as he describes the world in a sense seems like a fairytale world. His tweets are like a dream-land and defending the NRM into oblivion and attacking the opposition while the opposition is jailed, detainer or arrested. Even Abed Bwanika has been detained yesterday if you didn’t capture that in the FDC saga and demonstrations in Kampala, that happen after the Police went crazy at the FDC HQ.

Find one thing wrong during my last remarks:

Today the NRM Talley Center at Jokas Hotel has addressed the media on 20.02.2016 while FDC tried to the same at their Headquarter on the 19th January and then the Helicopter with tear-gas came and the military police arrested them all. Why didn’t the Police enter and take down the NRM tally Center as the Electoral Commission is only allowed to do so, they said that yesterday didn’t they?

Well, there seems to still not being close to being a level playing-field in this elections. And there will continue with political movements until it is all uncovered. Peace.
