Press Statement: General David Sejusa’s fate cannot be hinged on the situation of his persecutors. That a military court martial chairman is ill in hospital cannot be reason to illegal and criminally keep General Sejusa in Luzira prison. (26.03.2016)

David Sejusa Court

The news that Major General Levi Karuhanga, the chairman of Museveni’s Kangaroo Court, the so-called General Court Martial, is unwell and is admitted in hospital, cannot become reason for Museveni and his terrorist bunch to keep General David Sejusa behind bars in Luzira prison.

As far as Free Uganda is aware, the High Court of Uganda ordered the so-called General Court Martial to cease hearing the Sejusa case.

Museveni and Levi Karuhanga were forced to officially abandon the case, and this was formally communicated by Levi Karuhanga at a recent court sitting.

Noteworthy, however, Museveni ordered the military court to deny general Sejusa his freedom, sending him instead back to Luzira for no known legal reason whatsoever.

General David Sejusa is today in Luzira prison at the pleasure of Despot Yoweri Museveni, and for nothing other than pure political expedience.

Museveni is a frightened man. He is keeping General David Sejusa and Dr. Kizza Besigye under locks, only because he is afraid of these powerful freedom struggle leaders freely interacting with the People of Uganda at a time when the whole country is united in demanding an immediate end to his (Museveni’s) illegal occupation of State House.

The message to Museveni and his bunch of state house ‘illegals’ is very clear – The most successful People Power Revolutions are won, not by the leaders, but by the People themselves.

Holding Dr Kizza Besigye and General David Sejusa hostage will not stop the People’s Revolution being actualised.

Instead, it is firing up the People’s courage and determination to resist and defy Museveni and his much-hated Musevenism like they have never done before.

As General Sejusa said when he was first savagely dumped in the military dungeon at Makindye, “the People of Uganda will soon free him and the Ugandan nation” from the claws of Evildom.

Erias Lukwago statement on Court Proceedings at Makindye Military Court on the 9th February 2016 on Gen. Sejusa

Erias Lukwago Makindye Military Court

The experience in the General Court Martial today was yet another episode of melodrama characterising that kangaroo tribunal. I may not be in position to share all the epic events of the day for obvious reasons but I can’t help relating to you a novel legal phenomenon enunciated by the Military officers prosecuting Gen. Ssejusa. When I presented myself as a surety, the said team, together with the Judge Advocate, put up a vehement opposition, on a fallacious ground that a civilian is not legally competent to stand surely for a four star Military General! !!. That it’s only a fellow General, or army officer of a superior rank who’s competent to do that. Ironically, the chairman of the General court martial, Levy Karuhanga is a Major General. Anyway, the matter is pending a ruling that will be delivered after the presidential election. Talk of justice made in Uganda!!!

Erias Lukwago’s Statement after Gen. Sejusa was escorted to Luzira Prison today

Lukwago-Eria

Today, I was convinced by comrades in the struggle to rescind a decision I had taken ten years ago never to bow before the General Court Martial as an advocate following the horrible treatment I was subjected to by the then chairman of the General court martial, Gen. Elly Tumwine during the perfunctory trial of Dr. Besigye in 2005. On the cool morning of that fateful day, I entered the General Court Martial premises in Makindye duly robbed as one of Besigye’s counsel but emerged out in the afternoon as a convict. It all happened when, in the course of the proceedings, I rose up to make submissions but was bundled into the dock where Besigye was standing, summarily tried on tramped up charges of contempt of court, convicted and sentenced to a fine of Ug. Shs. 1000= or imprisonment for a period of 2 weeks.

Today’s proceedings in respect to the trial of Gen. Ssejusa were reminiscent of the said experience, save that the current chairman of the General court martial, Major Gen. Levy Karuhanga was relatively civil as he did not overtly persecute the defence legal team. But for all intents and purposes the whole process was nothing short of a mockery of justice. Little wonnder that not even a single ruling was made on any of the oral applications made. In short, we just escorted General Ssejusa to Luzira remand prison.

Museveni Idi Amin

It’s even a misnomer to call that kangaroo tribunal a court. I regretted why I cancelled my journey to Mbarara for our defiance campaign. What, however, brought a little smile on my face was the powerful message General Ssejusa sent out to President Museveni as he reminded him that the dungeon in which he was detained for the last two days is directly opposite the infamous Cell of no return where Iddi Amin confined him incommunicado in 1976 but his spirit to fight for good governance was never dampened. I hope The likes of Gen Kaihura, Tumukunde and their ilk will learn one or two things from this message. FOR GOD AND MY COUNTRY.
