President Museveni sacks Minister Tumukunde and IGP Kayihura: However, will it make a difference?

Today, two loyalists of the President has gotten fired, this was sudden and was not anticipated. Today on the 4th March 2018, the Inspector General of the Police Edward Kale Kayihura and the Director General of Internal Security Organization (ISO) General Henry Tumukunde. Both have been dropped suddenly after the recent leaks of lacking policing and rising crime in Uganda. There been reported of only 5% rate of murders being solved in the recent year.

A statement signed by the President and dated 4th March, 2018, reads as follows: In the Exercise of the powers vested in the President by Articles 113 (1) and 213 (2) of the Constitution of the Republic of Uganda, I hereby appoint General Elly Tumwiine as Minister for Security, Mr. Okoth Ochola as the Inspector-General of Police and Brigadier Sabiiti Muzeei as the Deputy Inspector General of Police”.

So the President has actually acted on the worse state of the Police and the public perception, as the police has been more focused on opposition politicians, than actually fighting crime. I don’t think the Police Force will stop doing that and also ban Besigye from dinners and public gatherings. However, this is proof that the President acts. Even if he is late to the party, since he should known that the Police have had gangs working for them and intimidated them. It isn’t like the President did this while the Muslim Cleric died or the woman at Entebbe died last year. Not that the Police leadership changed when the AIGP Andrew Kaweesi was killed. Therefore, the Boda Boda 2010 and the Crime Preventers issues must have really hurt some pride. Since, the change happens now. As the ISO is investigating Police Force and the Police Force was starting to investigate agents who did kidnap civilians and also did dirty work. Clearly, the President maybe wanted to stop that sort of acts. Since both actions make it look stupid and also looks like to different criminal groups, which is sanctioned from the state.

So now the NRM goes back to the NRA days, as they are hiring Tumwiine, as the Daily Monitor reports: “The new security minister Gen Elly Tumwine served as Commander of the National Resistance Army from 1984 to 1987. Gen Tumwine who also sits on the UPDF High Command fired the first shot in the National Resistance war. He replaces Gen Henry Tumukunde” (Daily Monitor, 04.03.2018).

So Tumukunde loses ISO and Ministry of Security, the battle between Kayihura made them both lose. Even as Kayihura wasn’t long ago promised a new tenure and term. Therefore, his contract got taken back and now he lost his job on a Sunday. It was on 2nd May 2017 that Kayihura for a new three year term. Now the Deputy IGP John Martins Okoth Ochola takes over becomes the IGP. J.M. Okoth Ochola is what you call a traditional Police Officer, if he will implement that, instead of the military attitude of Kayihura is to be seen. As he has worked for years under Kayihura.

All of this might change the faces of the Police Force and the Ministry of Security, however, it is the same President and the same party behind it. If the Parliament, the President and the Security Organization wants change, the procedures and institutional polices has to change. The accountability and the organization has to change. The Police Force isn’t make the nation safe, neither was ISO or the UPDF. The Special Forces Command or any other organization created to secure the public. That is why people is murdered and there are no signs of proper investigations, even criminals who just get away with their crimes.

This change might happen because of the United States new Travel Advisory on the 10th January 2018 said: “Exercise increased caution in Uganda due to crime. Violent crime, such as armed robbery, home invasion, and sexual assault, is common, especially in larger cities including Kampala and Entebbe. Local police lack the resources to respond effectively to serious crime” (Travel.State.Gov, 10.01.2018).

So they are have started to worry about the state of the police in Uganda. When they are warning their tourists. It says a lot about how they know about the current state of policing in Uganda. This must have gotten into the ears of Museveni and that is why he fires both of them. As the squabble between Kayihura and Tumukunde, has been fought in public. As the ISO has gone after proxy organizations of the Police Force. They have taken people connected with Kayihura and now he didn’t just lose, but Tumukunde got sacked too. When you play high, the rewards might be high, but fall might be worse.

People despise Kayihura for his actions and his defense of the NRM, the political driven police force, who has bankrupt the Force and also extended the mandate because of the Public Order Management Act of 2010. The POMA clearly made the Police Force focused on policing and monitoring opposition, more than collecting evidence and actually solving crimes. The Police Work has been left behind, they have used fear and used gangs to stop people. It has been strange, but it was sanctioned and accepted until now.

President Museveni suddenly acted swiftly, as he wanted to save face, even if the barren organization, the bankrupt system is still there. The scandals and the lack of morals are there. The ISO and UPF are still two security organizations without trust in the public, because they are more into politics, than fighting crimes. They are no bipartisan, but a visible hand of the NRM.

The insecurity and the lack of policing is something that has occurred over time. It wasn’t created in a vacuum of Kayihura or Tumukunde. This was done by President and with his orders. Kayihura has said his been a loyal man who just follows orders. He will continue to say that to clean his hands of dirt, as he has done his vicious and malicious acts against the citizens. Kayihura knows this and he knows he has made political prisoners and done so as ordered from the State House. That is where the big problem is, it is the State House. The organizations, the institutions and the insecurity has been made from there.

It is the lack of transparency, oversight and accountability of the Security Organizations, it is the lack of resources and the maladministration. It is the whole structure and the orders from the President, who promise and pledge, but doesn’t invest. Museveni has created this, but it is easier to sack someone, than actually destroy something and rebuild. Right now the Police Force isn’t professional, neither is ISO. The lack of protocol, procedure and training, is the reason for this mess. The lack of actual officers who do their duty and has no reason to even do so.

We should also worry about Gen. Tumwine, the former NRA and rebel whose been loyal to Museveni, don’t expect ISO and Ministry of Security to be nice and smooth. The malicious acts of the Ministry will continue, as the vicious crackdown of 2001 was in the hands of the general. Who while in charge made sure dissidents entered Kigo Prison, which was leaked in 2005 and 2006. Therefore, the world knows that he tortured lawyer, human rights activists and also opposition activists there. Therefore, Tumwine, might do similar things now that he has power in service of Museveni. So he goes from the UPDF General Court Martial, where he has stated in the powers. That previous trials and charges on Besigye was ordered and not made on legal basis. Therefore, he is brave enough to speak up against Museveni. But if he will do more than speaking is likely, since Museveni has made him general and made him Minister again.

We just have to see how this goes. Surprised today, yes and not so worried about the battle between Okoth Ochola and Tumwine. But if they will rock-the-boat, I doubt it and if they will reform their institutions and their organizations. I doubt that too. They will be figureheads who are loyal to Museveni and await orders from the State House. We will just see if their leadership roles, can stop the insecurity and the problematic state the Police has no in society.

The top chef, the one who has created this dish is in the State House. It is the President who is in-charge and let all of this happen. It is Museveni who didn’t act and made it possible for the Police to investigate and make sure the Police could solve the crimes done, the murders and all other activity. Clearly, that hasn’t been possible.

A Monster Museveni Created: The Failing Kayihura Police Force!

Gen. David Sejusa wrote this in a letter on the 7th July of 2014:

I wonder if Mr Museveni really knows what is going on in his own security institutions, or has he been rendered powerless by the very monster he created, i.e., personalised rule? It is because the officers who give him intelligence are the same arch criminals who need to cover their tracks. With no functioning systems, you wonder what information the head of state depends on to rule the country. Otherwise, how can he not see the danger he is putting the country into and himself? Not that it matters much though, because either way, he, Museveni, is personally responsible” (Gen. David Sejusa letter- ‘LOOMING WAR AND GOVERNMENT COVER UP: Government agents target civilians to scare population’ 07.07.2014).

Inspector General of Police (IGP) Edward Kale Kayihura, again you get on my radar, you are offering bounty for killers of innocent woman, who was dropped on the street like garbage. That is happening after dozens of strange foreign deaths are appearing all over the Republic. There so much weirdness going on, just like the Boda Boda 2010 relations and the Crime Preventers Program. All of this doesn’t add-up.

The sour relationship with Gen. Henry Tumukunde, the Chief of Military Intelligence (CMI) and the problems the police has with the Internal Security Organization (ISO). It’s like the Security Organizations are working not together to sting the criminals, but are trying to incriminate each other. As Muslim Clerical leaders died mysteriously last year, like group of woman in Entebbe too. There been so many strange unsolved crimes that the death of Assistant IGP Andrew Kaweesi seems like detour. Instead of the biggest hit-piece in the recent decade.

Within all of this as the Boda Boda 2010 leaders of Abdallah Kiatta and Paddy Sserunjogi aka Sobi. We can question how the police sanctioned this gang and let it off. And why suddenly it had to fall. Since the Police needed someone to go down and the Tumukunde had to pick someone to teach Kayihura a lesson or two. The striking revelations is how short distance it is from becoming a officer to act a criminal. That is what is worrying and also the signal, the only difference between the police officer and the criminal, is that the officer has the blessing of the state and a badge, the criminal has none. There is supposed to rules to the game, but clearly it is not.

On top of that and ICT scandals, the ICT frauds, that has escalated and became a big-deal, even the ICT Manager Amos Ngabirano fled from the country recently, because of how he was involved and that he feared for his own life. In all of this, the State House, the External Security Organization and the Police are also fighting for how to monitor the mobile money market. This is after who they should assigned the program and who can monitor it, if the its the Uganda Communication Commission, the Police or even the State House. So all of them can use the software to monitor the spending of Ugandans. This is happening, while people are busy seeing the external fights between Tumukunde and Kayihura.

They have even pushed further a New Vision reporter was abducted and gone from the paper for days, this Charles Etukuri, who has had close relationship with Kayihura and nicknamed his “Social Media Manager”. Therefore, this was another assault on the pride of Kayihura, who had seen many of his men taken and his lieutenants.

We can question what is going on, as the crimes are not solved, the bounty on Susan Magara killers proves the lack of mentality to solve the crimes and the lack of honest work within the Police. That is not strange, as the state of affairs isn’t getting better. All of this has happen quickly, as Kayihura has to even beg the Parliament for additional funds, since only 5 % of his operation are getting salaries. They are lacking funds to pay salaries as the police squad has increased and also the equipment of the police has become better. That is not strange as before the General Election of 2016, they got everything from new mambas, tear-gas and more manpower.

To top it all off, the Minister Jeje Odongo, Internal Affairs Minister has told Kayihura to polish the image of the Police. Kinda hard to do that on a little candy and not even paid-in-full. While the structures are even smashed by other security organizations. This is happening while the monitoring of the political parties and the enemies of the state. Not following the criminals and such. They have spent fortunes to follow and monitor the Forum for Democratic Change (FDC). Even more on house-arresting Kizza Besigye over the last two years, even the financial costs of tear-gassing, live-bullets and the misuse of power against political opponents of the President. That has all to cost a fortune, the extra hours and the equipment. Even the famous van and mobile terrorizing place, can be seen as project made out of nothing.

The sudden loss of funds, the lack of budget to an organization blown up to be political and block politicians cost. When they are not serving the people, but the will of man. Who want to beat everyone into submission. Especially the ones he cannot bribe into it.

We you combine all of this factors, I have not even addressed the saga of Crime Preventers, who has been used by the Police and the State during the elections, paid for uniforms and weapons. This together with all the other factors, the training and the constant move of leaders. The strategic forces and questionable work of the police. The sudden Fika Salama campaigns are cool, but the issues are deeper, than just on the surface, that cars are overloaded.

The police force is up-to something and certain things kept quiet about. Even the stories of Gen. Sejusa might have some power in them. As his warnings year back is now coming into light. The darkness and lack of institutions, the lack of oversight and use of gangs to keep things at bay. Are now shown, as much as the police is acting as criminals. Just as the sudden militias that came and went, where police-shootings was appearing in Kapchorwa Police Station attacks with SUN, Gulu Central Police Station with National Democratic Alliance (NDA) and the insurgency of Kirumiramutima in Kasese. All of this had violence and killings involved, but they silently stopped without any resurgent attacks by anyone of them. The government sanctioned violence was the one visible against the Rwenzururu Kingdom, as it was also on these two Police Stations.

We can clearly, see that the vision of Gen. Sejusa has power, as he saw this all coming. It is now visible, the lack of clear leadership, the reckless behavior of IGP Kayihura and Security organizations. That his involved other questionable activity and use of organizations that was beneath and beyond the services supposed to be delivered by the Force. Also the lack of investigations and the lack of actually policing. More of just brash PR stunts and picturesque shows of public display, instead of actually catching the murderous, the ones picked up is quickly released.

All of this madness is connected, the lack of funds, the growing organization, the battle of supremacy between Tumukunde and Kayihura. All of this isn’t a game, but real life at stake, they are all doing all of this because the President wants it like this. They want to use the Security Organizations to make insecurity to fake their own agenda.

This would been a pulp-fiction novel, a quick-fix book you buy at a flea-market. Instead, this is happening right in front of our lives. They are misusing the state funds and violating our intelligence, while they are proud of their craft.

There is to many things missing, the plots and the ideas, the scenarios where this is making the regime winning, other than spreading fear and silence people. If that is the only goal, they are using high-power weapons and expensive monitoring of politicians. While they are using the police to create crime and not actually fight crime. Which is weird in itself. It is visible and vicious!

Kayihura, should wonder and be boggled, he has lack of funds and giant mission, he needs manpower to fulfill the Public Order Management Act and the others things he want to do to serve the President. He is the presidents loyal servant. That he knows, but the actions and the now internal squabble between him and Tumukunde. We can wonder who else will join in and if the Mobile Money, will make the UCC and other go against him too. Who knows at this point, but the words of Sejusa should be with all of us.

The words we should remember today, as the police are in tatters and the public played for fools, we should remember: “I wonder if Mr Museveni really knows what is going on in his own security institutions, or has he been rendered powerless by the very monster he created, i.e., personalised rule?” (Sejusa, 2014).

We should ask if he is powerless because of the monster he created and he made during his rule. If he is able to understand and get into his mind, what sort of violence and policing his has sanctioned. Kayihura and his business has been accepted by the State House for years. The ISO, ESO and CMI, are all organizations that Museveni has created. Not only the UPDF and Special Force Command, who are other groups he has given powers too and training too. They can now fight each other and use methods of state organized violence against innocent citizens and possible troublemakers. However, most likely they will create trouble themselves. These are the monsters Sejusa described, the reckless organizations that will make him powerless. That is why he tries to pull the strings on the Police Force, but is it too late?

Mzee complains today about waste, however he haven’t rehabilitated sugar industry or revamped pharmaceutical industry either!

“In this regard, we need to learn and apply lessons from emerging economies such as India, whose total healthcare industry revenue is expected to increase from US$ 110 billion in 2016 to US$ 372 billion in 2022 in response to deliberate investments in telemedicine, manufacturing of medicines and health technologies, medical tourism, health workforce training and risk pooling/health insurance, among others. In order to achieve this, we need to plan in a harmonized way. In Uganda, for instance, we, indeed, have a nascent pharmaceutical industry producing Aids/HIV, Malaria, Hepatitis-B, pharmaceuticals, etc. drugs. These are, however, still using imported pharmaceutical grade starch and imported pharmaceutical grade sugar. The pharmaceutical grade starch and sugar are crucial for making tablets and syrups for children’s medicines. Yet, the starch is from maize and cassava and the pharmaceutical grade sugar is from sugar. I am told the drugs would be 20% cheaper. Moreover, apart from helping in the pharmaceutical industry, more refined sugar is also needed in the soft drinks industry. Uganda is squandering US$34 million per year importing refined sugar for the soft drinks, about US$ 20 million for importing the pharmaceutical grade starches not including the other raw materials, US$ 77million for taking patients to India etc. Africa is incredibly rich but wasteful” (Yoweri Kaguta Museveni at THE OFFICIAL OPENING OF THE JOINT EAC HEADS OF STATE RETREAT ON INFRASTRUCTURE AND HEALTH FINANCING AND DEVELOPMENT, 22.02.2018).

Seems like the 1980s World Bank loans to restart Kakira Sugar Works hasn’t done enough, since the Ugandan state did right after the National Resistance Army takeover of the state. They went into an arrangement with the World Bank getting loans for the company, to restart. That deal was done 8th March 1988. As the documents said back in 198:

“Uganda currently imports US$15-20 million worth of sugar annually, which ranks second only to petroleum imports. Import substitution through restoration of domestic production capacity is therefore a high priority and eminently justified given the considerable comparative advantage Uganda enjoys as a result of its landlocked situation. Conditions for sugar production at Kakira are highly favorable. Cane growing benefits from excellent soils, good rainfall distribution (requiring only limited sunplementary irrigation) and relatively low levels of inputs of fertilizers and pesticides. The project brings back to the Kakira complex the original owners who have a demonstrated ability to manage sugar operations at Kakira and elsewhere” (SUGAR REHABILITATION PROJECT, 08.03.1988).

Therefore, what the President said today, the Sugar Rehabilitation Project, which was done to stop the heavy imports of sugar and for consumption, has clearly not worked as projected. Since his own state is squandering their resources and not even following the loans to make the project work. That is my take on it. The president of 32 years has clearly mismanaged this and not finished his job. Since he hasn’t been able to rehabilitate the industry.

When it comes to pharmaceutical industry there massive challenges, not just the sugar starch for medicine coverage of the pills. Nevertheless, the whole arrangement, since the technology to operate these machines are imported, as well is the parts. Not only the sugar starch, but also the ingredients are imported too, than you have few companies who has automated manufactures, which makes hard to make medicine on a larger scale. It is also high operation cost, because of use of back-up generators because of blackouts and shortfall of electricity. Because of this, it is expensive to have cold storage of the medicine and have a storage for the final products.

So the Idea from Museveni that it is simple, it is the whole system around it, that makes it more profitable to import ready made medicine, than actually produce it. Even if the added value of production would be there, but with the circumstances put by United Nations Industrial Development Organization, seemingly it is from 2009. However, the state of affairs hasn’t changed that much.

We can really estimate, that the adjustment and the needed organization to pull forward both industries during the years of NRM hasn’t been totally fruitful. If so, why would he complain about the imports of sugar and medicine, when he hasn’t been able to make it function with his 32 years of reign? Someone who has 3 decades, should have the ability and time to find the information, finalize plans and execute as seen fit. That is if he cared about the industries in question and their possible engines for growth and riches of Africa. Nevertheless, he hasn’t cared and haven’t used the time wisely. He has used the time bitching and not acting. That is just the way things is and it isn’t becoming better either.

He could have made sure that the pharmaceutical industry had energy, had the sufficient organization behind it to make the medicine, not only import and assemble certain medicine, he could have made sure the sugar industry was profitable and had the equipment to make the refined sugar used in the pharmaceutical industry. However, both is a lost cause, because it takes money and time. Both, is something he doesn’t have, since the narrative isn’t making him wealthy.

Alas, he we are at the status quo, with a President running for life and complaining about waste. When he has wasted 32 years and not made effort to change it. It is all talk and no fire. Peace.

Looking into the inflation of 1987 as the Sugar prices are rising in today’s Uganda!

We have had a wonderful collaboration with IMF since 1987. We have managed to control inflation. By controlling inflation, we have succeeded in preserving the people’s earnings” – Yoweri Kaguta Museveni (State House, 2017).

Well, there been many who has set similarities with the inflation and price shocks of the year 1987. The Republic of Uganda has been through their mess before. The government of Uganda and the National Resistance Movement/Army (NRM/A) had just taken power in 1986. This was a year after the coup d‘etat, which brought the NRA into power. President Yoweri Kaguta Museveni in collaboration with International Monetary Fund (IMF), which had agreements and Structural Adjustment Program (SAP), which promoted deregulation and less state control of the economy. This was also put forward to settle inflation and the deficit that the state had.

So, because some has put similarities between 1987 and 2017, as the prices has gone from about 3,000 Uganda Shillings (UGX) in 2016 and 7,000 Uganda Shillings (UGX) in 2017. There is clearly that there was problems in 1987, but whole another level. The Sugar Industry wasn’t established, the economy of Uganda needed export of coffee and this was the sole benefit of foreign currency into the economy.

Inflation in Uganda is running as high as 200 percent, and low prices to farmers serve as a disincentive to agricultural production in a country of rich soil and mild equatorial climate” (…) “At the center of the debate is the issue of devaluation. In its first year in office, the Government revalued the currency from 5,000 to 1,400 shillings to the dollar, saying that the move would make imports cheaper. But exports have become increasingly expensive. Devaluation Debated. Some hard-line nationalists in Government insist that the cost of devaluation would be devastating. The cost of such imports as sugar, cooking oil and soap would increase significantly, they say, making the average Ugandan even worse off than he is now” (Rule, 1987).

In 1987 the Uganda shilling was demonetizated during the currency reform and a currency conversion tax at a rate of 30% was imposed to further reduce excessive liquidity in the economy. There was an immediate drop in average inflation from 360.7% in May to about 200% cent in June. However, with the possible fears of complex and drastic currency reform, the premium shot up, representing essentially a portfolio shift to foreign currency, and possible capital flight, and suppressed inflation. The intended aim of the conversion tax, apart from reducing excessive liquidity, was to lend money raised through this tax to the government. This was to finance the budget deficit over a short period, rather than financing it through printing more money. Nonetheless, inflation shot up again within three months mainly due to renewed monetary financing of increased government expenditure, domestic credit expansion by commercial banks to meet coffee financing requirements and financing of the newly launched rural farmers scheme” (Barungi, P: 10-11, 1997)

Prices for sugar and vegetable oil (both imported goods) increased rapidly in the early part of the year, falling between May and August — replicating the pattern of the premium between the parallel and the official exchange rate. The subsequent fall in sugar prices and stability of cooking oil prices were due to greater official imports. Inflationary pressures on food prices have been aggravated by supply shortages on account of severe transportation problems” (World Bank; P: 36, 1988).

In October 1986, Mulema was replaced by Dr. Crispus Kiyonga, who has a medical background Kiyonga has a difficult task. The government’s finances are shaky at best. In an attempt to enable Ugandan citizens to purchase imported consumer goods, the government fixes their prices below world prices. This, of course, puts considerable pressure on the government’s finances: for example, in July 1986 the government imported $4.8 million worth of sugar to sell at subsidized prices” (Warnock & Conway, 1999).

Perspective from Kakensa: “Today sugar costs 7000/- per kilo. When Museveni came to power in 1986 each kilo was at 4/-(four shillings). Immediately he came to power he said Ugandan shilling had lost value, in 1987 all money was changed, not only changed but two zeros were cut off to give it value on addition to the 30% levied on each shilling. This means on every 100 shillings, you got 70cents. Those who had 100,000/- got 700/-” (Kakensa Media, 12.05.2017).

We can see there was certain aspects, but the sugar industry now is different. The Sugar factories are now real and the business are now in full affect. While, in 1987 the state needed coffee exports to get funding and foreign currency. The sugar was imported and was put on fixed prices. The inflation back then was because of the crashing economy after the bush-war and the effects of it. The Sugar prices now are rising for different reasons. These reasons are the yields of sugar-cane, the hoarding of sugar and the export of surplus sugar. Also, the production of ethanol and bio-fuel. That was not the situation and context in the past.

Still, history is repeating itself, since the NRM, let the prices run as crazy in the past. The price has gone up a 100% in a years time. Which, means the prices who doubled from 3000 to 7000 Uganda Shillings. This is not a stable and the ones who get hurt is the consumer and Ugandan citizens. Peace.

A look into the rising Sugar prices in Uganda!

I commissioned a state-of-the-art ethanol distillery at Kakira Sugar Factory in Jinja today (Museveni, 23rd January 2017)

There are various of reasons for the rising prices of Sugar and processed sugar in Uganda. This isn’t the first time or last cycle of inflation on the prices of this common commodity. Sugar is common in Uganda for concept of having in it in the chai or the milk tea. To sweeten the milk and the black tea the Ugandans drink. Therefore, the Ugandans are needing and using lots of it on daily basis. It isn’t a luxurious goods, but a daily usage, for ordinary use. It has become staple and is staple together with matooke, cassava, rice and maize flour. This is all seemed as basic for the Ugandan people. Sugar is something very important. Therefore, the rising prices says something is out balance.

The balance have now been lost a year after the election. The prices of goods and food was also rising in 2011, therefore, the Republic had the Walk 2 Work demonstrations. These was demonstrations against the rising food prices, which also meant the sugar at that time went up. The same is happening now. With also on alternative exception, that the producers are not only creating sugar for consumption anymore, but ethanol and bio-fuel. Therefore, the produce and profits are going to export bio-fuel and other products, instead of the sugar that the consumers in Uganda uses. This also is an explanation for the rising prices, as well the added exports to Kenya, where the producers gain more selling it there. Than in Uganda, take a look!

In April 2017 USMA commented:

Uganda Sugar Manufacturers Association (USMA) says the increase in sugar prices has been prompted by the increase in cost of production and the deprecating shillings against major currencies. The Association’s Chairperson, Jim Kabeho says sugar millers were forced to announce what he called a paltry 4 percent increase on each 50-kilogram bag on ex-factory price. The increase according to Kabeho saw a 50-kilogram bag of sugar trading at one hundred and eighty five thousand shillings up from one hundred and seventy thousand shillings” (…) “Meanwhile a source at the Ministry of Trade Industry and Cooperatives who asked for anonymity says the Ministry suspects that the big players like Kakira could have decided not sell its sugar to the market so as to increase production at the ethanol its ethanol plant. The sources says sugar mills with ethanol plants are finally making money on sugar through on co-generation of power, alcohol and ethanol” (URN, 2017).

In April in Masindi:

Masindi district leaders have risen up against the Masindi district Resident Commissioner, Godfrey Nyakahuma over stopping sugar cane buyers from buying cane from Masindi district. Last week, Nyakahuma launched an operation of impounding trucks of all sugar cane buyers who buy sugar cane from Kinyara sugar limited out growers and over five trucks loaded with cane were impounded by police” (…) “Byaruhanga added that that is a sign indicating that Kinyara sugar Factory has no capacity to crush the available sugar cane adding that since Uganda has a liberalized economy let everyone come and buy the abundant cane available instead of leaving the farmers suffer with the monopoly of Kinyara sugar factory. Amanyire Joshua the former mayor Masindi municipality said that if Kinyara is saying that sugar cane buyers are poachers, Kinyara sugar factory is a smuggler because it is also doing the same. Mary Mujumura the deputy speaker Masindi district blamed Byaruhanga Moses the presidential advisor on political affairs for failing to advise the president on political issues saying that he is not supposed to enter into business matters” (Gucwaki, 2017).

In May 2017:

From last year’s average of Shs 3,000 per kilo of sugar, the price shot to Shs 4,000 early this year and is now hovering over Shs 5,500. A kilo of Kinyara sugar is the cheapest at Shs 5000, while Kakira sugar is selling at 6,000 a kilo. On the shelves, Kakira sugar and Lugazi sugar are scarce compared to Kinyara sugar, which is in plenty. Many dealers have now started hoarding sugar in order to benefit from anticipated price hike in the short term” (URN, 2017).

In May 2017 – Stanbic Statement:

The only category to buck that trend was wholesale & retail, where staff costs rose and employment fell. Average purchasing costs also rose in April, reflecting increased prices for animal feed, food stuffs, raw materials and sugar. Higher cost burdens were passed on to clients, leading to a further increase in output charges” (Stanbic Bank, 2017).

President Museveni praises Kakira Millers:

I would like to thank the Madhvani Group, despite the disappointment by Idi Amin. The family pioneered the production of sugar in Uganda. By 1972 they were producing 70,000 tons but today they have almost tripled the production to 180,000 tons,” he said. The President was today commissioning a state of the art ethanol distillery at Kakira Sugar Limited in Jinja district. The US$36 million facility, which is the largest in the East African Region, will be producing 20 million litres of ethanol annually” (…) “President Museveni pledged to address the issues to regulate the sugar industry but urged the Madhvanis to partner with farmers with large chunks of land for production of sugar-cane, as the cane is not a high value crop. He said people with small land holdings should be left to do intensive farming like the growing of fruits that give high returns. Turning to the issue of prices payable to sugar-cane out-growers, President Museveni advised the buyers and out-growers to sit together and agree on the prices taking into consideration the market prices globally” (Uganda Media Centre, 2017).

Government statement on the 11th May:

Speaking to 256BN on condition of anonymity a government official monitoring the situation said the manufacturers have not increased the factory price, but he conceded that the situation is worrying. “At the factory prices are stable. Why is it that the prices at the retail gate are high. This means that there are some distributors who are using the hiding strategy in order to rob Ugandans. As Government we shall continue monitoring the situation until we come up with the solution” the official said. Affordability of sugar is considered a key barometer of an ordinary person’s well-being and its pricing can take on political dimensions when people cannot have sugar with their tea” (256BusinessNews, 2017).

Putting the price in pespective:

Kakensa Media reported this today: “Today sugar costs 7000/- per kilo. When Museveni came to power in 1986 each kilo was at 4/-(four shillings). Immediately he came to power he said Ugandan shilling had lost value, in 1987 all money was changed, not only changed but two zeros were cut off to give it value on addition to the 30% levied on each shilling. This means on every 100 shillings, you got 70cents. Those who had 100,000/- got 700/-” (Kakensa Media, 12.05.2017).

This is all proof of a systemic malpractice, where both export, together with lacking yields because of drought and also the production of ethanol and bio-fuel. All of this collected together are reasons for the rising prices of sugar. The sugar price goes up because the use of cane for other things than millers producers sugar for consumption, but for other export products. This is all making sure even as the Republic of Uganda has in the past produces to much, it now doesn’t. Since it elaborately uses the sugarcane for other products.

That has made the Madhvani Group rich and their exports of sugarcane products are clearly selling. Now even their basic milled sugar are sold more expensive on the Ugandan market. There are also proven problems by other millers, who either has to much cane like Kinyara Sugar Factor in Masindi. Which is ironical problem, as the Kakira and Lugazi sugar is empty on the shelves, while the sugarcane hoarding Kinyara are still in the shops. But Kakira which is produced by Madhvani Group, we can now understand, since they have bigger operation and is blessed by the President for their industrial production of ethanol and bio-fuel.

Therefore, the are more reasons than just shopkeepers not getting enough stocks. That the rising prices are not only that there is lacking production. It is the system of export and production. Where the cane isn’t only becoming milled sugar for consumption, but for all the expensive industrial exports like bio-fuel and ethanol. This is all good business, but also bad for consumers and citizens who are accustom with decent prices for their sugar. That is not the fact anymore, as the business and millers has found new profitable ways. So that the surplus sugarcane and also the other gains massive profits. This is all good business for the owners of the sugar-millers and sugar industry. The one who feels the pitch is the consumer and the citizens. Who see scarcity of sugar inside the shops and also the inflation of prices on the sugar. Peace.

Opinion: UPFF seems like made-belief by the Calvary, as the NDA and SUN never reappeared!

Kaweesi Murder Probe: Police warns public against conspiracy theories and speculation, adds that such will slow down investigations” (…) “Police are investigating a group calling itself ‘Uganda Patriotic Freedom Fighters’ that claims to have murdered AIGP Kaweesi” (…) “The group posted on social media commending itself for a job well executed and blamed police for arresting innocent people” (NBS TV Uganda, 27.03.2017).

There been many rebel outfit of late who has taken claims of violence and robbing Police Stations, what is common is that that they come into light and fade into dust as quick as they came. These ones has all been parts of questionable acts and taken weapons and ammunition from the Police Force. Still, there has not been anyone who is caught for these crimes, neither has there been anyone taken to court. Therefore, I wonder about the newest who appeared this month!

In March 2016, the sun set on Uganda, and initially “We, Save Uganda Now” (SUN) that took responsibility for the attacks on Kapchorwa Police Station, where the former army commander ‘Mali Moto’ we’re running it. And ever since then they have not reappeared!

In June 2016, a new surfaced rebel outfit named National Democratic Alliance (NDA) attacked the Gulu Central Police station, as it was even stated by the Police Force that is was UPC Deputy Secretary Dan Odiya Oola, who was in charge. The NDA has not attacked anything else since the day in question.

Than there was the Rwenzururu Kingdoms Royal Guards and the “Kirumiramutima” (the Strong Hearted) that was a militia in the Rwenzori and Rwenzori Sub-Region. These ones created problems in the region after the election and supposed to done so since 2014. Still, the violence only appears when the Uganda People’s Defense Force (UPDF) arrives in Kasese, like last year in November, when the Flying Squad twice attacked the Buhikira Royal Palace in Kasese. It is easy to forget, but the problem of rebels appears when the Police and Army attacks innocent civilians in the region. That problem also disappear when the army leaves the region. Than the locals are preoccupied burying the dead.

So when I here that a new rebel outfit takes the responsibility for the assassination of the Assistance Inspectorate General of Police (AIGP) Andrew Felix Kaweesi, they we’re suddenly a group who claimed on social media called Uganda Patriotic Freedom Fighter (UPFF). They came out of dust and has no history, just like the groups who apparently was in charge of the assaults on the Kapchorwa and Gulu Police Stations during last year. The pattern are written in the sand.

The serious rebel outfits has been scattered and are now based on foreign territory, as Allied Defense Force (ADF) is based now in the Democratic Republic of Congo and Lord Resistance Army (LRA) who are in Central African Republic (C.A.R). So these are not something that is apparent problem for the security organizations or the Police Force.

So I have a hard time believing that a new outfit of rebels has that sophisticated and knowledge about top leadership inside the Police Force, that they get the knowledge of the Police Commanders house, road and about the time he leaves for his office. That the Rebel Outfit UPFF came into force and with actions all of sudden. It came from the moment of clarity as it usually do after the incident.

Just like rebel outfits came into action right after the Police Stations was assaulted in 2016. All of a sudden the ‘strong hearted’ rebelled in Rwenzori.

Now that Jospeh Ssonko, appear and claims responsibility days after the death of Kaweesi. As much as the new Police Spokesman today Asan Kasingye speaks these words and tries to explain the on-going investigation. Since the UPFF, SUN and NDA are all coming from the same source and sources are all quick and brief online. Still, their placement and quick relief of information comes and goes as quick as the government needs it.

Therefore, the government hopes people forget the other rebel outfits and leaders, as they dwindle in presence and importance. However, the dead and the families of the lost will still wonder what really happen, this are the losers of this political game, as the ones who ordered and got the AIGP Kaweesi assassinated. As well, as all the other speculations that opens up questions of this public display. That the Police Force and their leadership wants to peddle this sort of false narratives instead of dropping proper intelligence. This proves that the Police Force is rotten, as the government is lacking will of accountability and transparency. So if the Police Force and key leadership together with other Security Organizations had offered or created this sorts of violence. Than, the Republic would know that rebels and the other created stories, might just be hogwash.

That this is a possibility, that the Uganda Police Force, that the Army and the other agencies wishes to subdue and silence the public discourse as they comes with false information. This seems probable, as this is yet another group arriving to court without any invitation or knowledge of their origin and their leadership. Like the knowledge of the start of ADF and LRA are inescapable and accessible. But if you tries to get knowledge on UPFF, NDA or SUN, your have to invent the wheel and than take ride.

So, I have doubt that UPFF exists, as the NDA and SUN is made belief, it is as believable as the manufactured cases against FDC leadership and the made-up case of treason against Dr. Kizza Besigye. The same is about the believed aggressors who appears out of nowhere. Peace.

OAG Muwanga reports that the Local Government misuse of public funds, while Court Awards are going unpaid!

Parts of this has been reported before, but that was as reports of the coverage from Parliament as the Auditor General John Muwanga we’re attending preliminary sessions and delivering OAG Report of 31st December 2016, which is the end of year report from the OAG. That one has stories to tell. Parts of this are known, but they are proving that words in Parliament had other numbers than the report that is released later on online. Still, the vast waste of funds and the unallocated or unaccounted funds proves questionable use of public coffers in the Local Government, the districts, parish and municipalities. These funds are important that is well spent and accounted for, because the funds are supposed to go to local government salaries and investments for the citizens. Therefore the mismanagement of this is thieving or maladministration from the civil servants or the locally elected officials. Take a look!

Outstanding Court Awards:

“Government had outstanding amounts in court awards, compensations and other liabilities totaling to UGX.684Bn as at 30th June 2016. The outstanding amount in Court awards and compensations has been accumulating over the last five financial years raising from 54Bn to now 684Bn. I observed that as a result of government’s failure to pay these court awards on time, the awards have accumulated interest and in some instances the interest has exceeded the principal award. As at the close of the year outstanding interest had accumulated to UGX.175.3Bn” (OAG, P: 12, 2016).

Local Government issues:

“The amount is comprised of UGX .1.310Bn which lacked procurement files, UGX.21.225Bn where there was breach of procurement procedures, UGX .4.695Bn involving inadequate contract management and UGX.0.315Bn of unauthorized contract variations. Conse­quently, it becomes difficult to ascertain whether value for money was achieved” (…) “Expenditure amounting to UGX.3.896Bn was identified as funds unaccounted for. Consequently, I could not confirm that the funds were utilized for the intended purposes. The delayed submission of accountability may also lead to falsification of documents resulting into loss of funds. This was caused by failure of Accounting Officers to enforce accountability controls and lack of an advances ledger to monitor advances” (…) “Regulation 32 of the Local Governments Financial and Accounting Regulations, 2007 requires Councils to ensure collection of all budgeted revenue in an approved manner. Review of revenue performance revealed significant under collection of Local revenue in 161 Councils amounting to UGX.17.165Bn” (OAG, P: 31, 2016). “Out of 307 Local Governments, 148 entities representing 48% of the Local governments lacked land titles for the land where council properties are located. There is a risk that council land is exposed to encroachment and disputes which later leads to litigation in courts of law arising from land disputes between the Councils and the Communities” (OAG, P: 33, 2016).

Here you can see the numbers and it is dozens of Presidential Handshakes, the handshakes of the President could go unaccounted for a dozens of times. That the Government have learned from the Parliament and Central Government is clear, since this is rampant and seems to indicated in many local governments. It cannot be okay that the lacking of documentation and of how the monies where spent. Of how and where the documentations went before the allocation of the funds. That shows malpractice and maladministration in the Local Government. Something that is also evident in the Courts, the Courts hasn’t paid out their awards on time and adds extra interests, which the government have to pay as well. Peace.

AG Muwanga address mismanagement of public funds in the Local Government; staggering amount of funds that disappears!

I hope this does not boggle your mind. Bear in mind that the Uganda Revenue Authority (URA) lots of scrutiny for paying bonuses on a Tax-Case against Tullow Oil Corporations. This has led to giant pay-out’s to fellow loyalists in the regime and in the civil service, and other who helped the arranged case that they won in favour of the URA and the NRM; so that AG Muwanga tells about bad practices in the districts and counties is not surprising. When I went through the local portfolios during the campaigning, there was usually funds not spend or even unaccounted in a dozens districts. That was last budget year, not the one mentioned from the AG this time around.

Therefore, here is his revelation in Parliament yesterday:

“Auditor General, John Muwanga, who presented the report to the Speaker of Parliament, Rebecca Kadaga at Parliament on January 4, 2017, said the accounting officers attributed the irregularities to challenges encountered during decentralization of salary payments on the Integrated Financial Management System and Integrated Personnel and Payment System. “Many of the accounting officers explained that they had initiated the process of recovering the overpaid amounts and training of staff to build capacity and address the challenges. I wait for evidence to that effect,” Muwanga stated in the report. At least 33 local governments are quoted to have procured items worth Shs 27.5 billion without following public procurement regulations and guidelines. Out of this, Shs 1.3 billion lacked procurement files; Shs 21.2 billion where there was breach of procurement procedures; Shs 4.6 billion involving inadequate contract management and Shs 315 million from unauthorized contract variations. About Shs 3.8 billion was identified as funds unaccounted for by the local governments. “I could not confirm that the funds were utilized for the intended purposes. The delayed submission of accountability may also lead to falsification of documents resulting into loss of funds”. On under collection of local revenue, 161 councils registered a shortfall in collection of revenue amounting to Shs 17.1 billion, majorly attributed to failure to carry out revenue enumeration and assessments, non-enforcement of contracts with private revenue collectors, understaffing and incomplete revenue records” (Parliament Watch Uganda, 04.01.2016).

If you wonder where it went, than the only ones knowing is the ones that was in charge of transactions and the ones actually taking the monies. The Public Coffers gotten looted without proper procedure for random trades. We can only imagine where the money went. Who used it and for what purpose is not easy to know, if it was buying a great car or house, even if it was paying a side-chick of a local mayor, we do not know. What we do know is that the money left the system without acknowledgement and without needed guidelines of the usage of the funds. That is worrying how easily billions can fly out of the coffers. Brown envelopes of funds easy spent on joy and needed supplies for the elected and public servants without any recites or valid reason for the use.

That this is clear indication of the practices and lacking moral of both central government and local government is certain. Certainly if the Central Government cared and the Local Government was worried of repercussions for their misbehaviour they would have acted otherwise and might even tried to payback the funds to the state. Instead, they used it without warning and might be wasted monies on luxury items during the election.

When the Local Government even with lacking of protocol extend their goodwill to forge documents to prove the valid use, you know the system is made wrong and need a recharge, there are certainly to many loose ends when they go to that extend to clean their wrong doings. Peace.

Uganda: Leadership Code Amendment of 2016; what are the important changes in the law?

The original Leadership Code of Uganda where commencement 26th June 1992 in the early years of the National Resistance Movement; so the Government of Uganda need more to revised and amended as the Minister for Ethics Reverend Simon Lodoko has ideas to make the Leaders and Civil servants more ethical inspired. This done with amending a new law and making it stricter and giving the Ministry a strong Authority with a legal power as the law propose to change a very subtle committee who discuss proposed leadership breaches with Parliament and Minister; the Tribunal are having more ability to actually following the breaching and unethical behavior from leaders and their snitching ways. That is why the Tribunal gets revised from a measly Committee towards a powerful Tribunal!

Take a look at important issues that are wished revised and changed to make the 1992 law better and more control from the Central Government!

In the original – 

Section 10:

(1): “A leader shall not put himself or herself in a position in which his or her personal interest conflicts with his or her duties and responsibilities”

In the new Amendment:

(1)“A gift or donation to a leader at any public or governmental occasion shall be treated as a gift or donation to the Government or the institution represented by the leader and shall be declared so to the Inspector General; but the Government or the institution shall keep an inventory of the gift”.

There is a giant different between putting himself in a conflict and getting a gift. The Conflict is by approaching an offer that might substantially discredit the decisions alters the judgement done by the leader of government or in any government institutions. That is different from becoming somebody who get gift and has to give it to the government and institution who the leader works for. The gifts system is normal in many states as the leader and civil servants represent the states and cannot take bribes of gifts and such therefore these laws exist to make sure gifts and donations doesn’t become an issue to secure the vote/regulation/license or use the government institution to gain more than the competitor that doesn’t give or donate to the government leader.

Therefore the rule change is healthy, but will it just be lawful text and followed up the current leadership and only done as PR stunt as the NRM Regime hasn’t really been showing talent for accountability and transparency other than stern warnings and when donor aid has been cut. Then the government has swallowed a few bloody court cases and showing grand-corruption to prove their ability to honest budgeting; while going back to office when the court are gone and the questions from donors are silent. Therefore I have doubt that this law has affect as the Auditor General and Inspector General of Government (IGG) doesn’t even dig deep into the current corruption; so this seem like beautiful words, but will they acted upon?

Create a Tribunal:

Other key ones are adding a Tribunal that the leaders and representatives for government institutions report to and follow the ethics of their actions. They will have a chairperson that is elected by the Parliament and the ones in Parliament cannot appoint a chairperson, unless they can appoint a High Judge of the High Court. Which is part of the new 19 Section in 19A and 19B; this Tribunal will be elected by the President and Public Service Commission; with approval of the Parliament (19C).

This Tribunal will follow the case if non-else party is available to fetch evidence and collect affidavits as long as they believe it is “subject cause”. They can even interrogate needed persons even “abroad”. New in 19R (5): “The Tribunal may make an order in to costs against any party, and the order shall be enforceable in the same manner as an order of the High Court”. So the Tribunal will get the same value as a Court Order to follow the cases and follow the alleged breaches of the Leadership Code.

The strictest clear rules on the Tribunal is in the 19Z:

“A Person who –

  • Insults a member in, or in relations to, the exercise of his or her powers or functions as a member of the tribunal;
  • Interrupts the proceedings of the Tribunal;
  • Creates a disturbances, or takes part in creating a disturbance in or near a place where the Tribunal is sitting; or
  • Does any other act or thing that would, if the Tribunal were a court of record, constitute contempt of court, commits an offence and is liable, on conviction, to a fine not exceeding twenty-five currency points or imprisonment not exceeding six months or both”

Another change is the total replacement of this part of the law:

“20. Report of the committee.

Upon the completion of an inquiry conducted by the committee or upon receipt of a report of findings submitted by the Inspector General of Government or the Inspector General of Police or the Auditor General under section 19, the committee shall make a report to the authorised person; and in a case where the committee or the Inspector General of Government or the Inspector General of Police or the Auditor General has found that the leader whose conduct was inquired into is in breach of this Code, the committee shall make such recommendations as it considers appropriate as to action to be taken against the leader.

The committee’s report under subsection (1) shall be made public and shall state whether the leader is or is not in breach of this Code in respect of the specific matters inquired into by the committee and, in the case of a breach, shall set out—

 the nature of the breach which the leader has been found to have committed;

the circumstances of the breach;

a brief summary of the evidence received during the inquiry into the breach; and

its findings and recommendations.”

This with the amendment changes to this:

“(1) The Registrar of the Tribunal shall inform the authorised person in writing, of the decision of the Tribunal, within thirty days after the date of the decision.

(2) The authorised person shall upon receipt of the decision under subsection(1) take actions within thirty days.

(3) The authorised person shall report to the Tribunal in writing within fourteen days after the explaination of the thirty days referred to in subsection (2) of the action taken by him or her”.

Here the Tribunal doesn’t need to go public as they needed before, because this section is changed and amended with the new Leadership Code of 2016, this proves the writing happens between authorised person and the Tribunal and not to commit it public. It means within 30 days actions against a person will happen, but not publicly. So the Tribunal compared to the Committee of old can work in silence and act against somebody without common knowledge.

As the Section 23 original law says this:

“23. Procedure of the committee.

Subject to this Code, the committee may, after consultation with the Minister, make rules regulating its procedure under this Code”.

The newly amendment says this:

“Procuring information and attendance of witnesses.

Subject to this Act, the inspectorate may –

  • Summon any person who, in the opinion of the Inspectorate, is able to give information relating to any matter relevant, to the investigation being conducted by it, to appear before inspectorate and to furnish such information and produce any documents, papers or thing that may be in possession or under the control of that person; and
  • By order in writing, summon the person to attend before the inspectorate at a specified time and place and to be examined on oath”.

With this substantial change together with the others, the powers of the Tribunal is to inspect and get witness report or an affidavit as the summons of a person who might have information has to answer to the Inspectorate for the Tribunal under oath. The relevancy of this is the powers that the law might give the Tribunal as they can investigate and summon. Not only consult with minister after the code has been followed by the Committee. So the powers of following breaches of the set the law gets more ability to sanctions citizens. While the Tribunal get more power than a Committee that ask the Parliament for ability to act like the Leadership Code of 1992 does. Peace.
