Opinion: A new Speaker has to be elected before a new plenary or business is transacted in Parliament

The 1995 Constitution in article 82(4) states that no business shall happen in Parliament other than the election of a Speaker at any time the Office falls vacant. Now that it’s official that late Speaker Jacob Oulanyah died in Seattle. The stipulations in the Constitution is clear and sets the parameter of the next actions.

In other parts of the article 82(5) the Chief Justice, which happens to be Justice Alfonse Chigamoy Owiny-Dollo, either himself has to preside of the election of the Speaker and the Deputy Speaker. He can also designate a judge to do it for him in his stead.

What we do know by the other stipulations in the Constitution. The Speaker cannot be a Vice-President or Minister for that matter. Unless, Rebecca Kadaga now resigns from her position. She cannot be re-elected as Speaker. If she would be willing to risk that and again renegade for her own personal interests. Which she did with fielding her candidacy in defiance to the will of her party in 2021. Alas, things can become tense and interesting.

Because, we know things will run with a State Funeral and a transport of the body from the United States and back to Uganda. Where a Committee appointed by the President will preside over the proceedings and functions of the late Oulanyah.

Since he was sick, the Deputy Speaker Anita Among have run the business of the Parliament. While she was expecting a ceremony of forgiveness from Hon. Francis Zaake this up-coming week. That will clearly be abandoned and new things are bound to appear.

The Constitution is setting precedence and there is protocol to follow. The ones who calls this cold-hearted and out of order. Well, if they want an illegal plenary and stop parliamentary business. Then you skip these formalities and opens up a quagmire of problems, which can haunt the transacted business of the August House. The House should be order and it should follow the stipulated laws, as it’s the body, which enacts and proposes new legislation. Therefore, they should be the ones that honours it first and accordingly so.

Some might say… isn’t that mighty Noble and outside of purpose. However, if the 1995 Constitution hadn’t said this in the articles and the laws was reflecting this. I wouldn’t have questioned the legality either. Nevertheless, here we are and the justifications to ask for it is justified. The article 82 is clear in it’s wording and there is little wiggle-room.

The ones speaking of long mourning period and not hold an election for a new speaker. They are void of the fact of the function and the constitutional bound role of the speaker. This is why the importance of doing it and ensure the formalities for business transacting in the August House. That should for matter for anyone who wants things to be done legally and after constitutional order.

Deputy Speaker Among might feel justified to continue, as she has done so in the absence of Oulanyah. Since he fell ill, became bed-ridden and went to hospital, even before he was referred to get treatment in the United States. She has been the one in his stead. However, the law isn’t giving her the rights to automatically get in his stead. The laws are set to have new elections. Meaning new candidates and possible re-election. This can be a hurdle or she have to trade on the goodwill of envelopes of late.

Time will really tell. Nevertheless, we have to see how the 11^th Parliament will operate, but if they will act accordingly to the Constitution. They have now one agenda and one objective, which the Chief Justice or the ones he appoints have to preside over. The new election of the new speaker and deputy speaker. Since the seat of the Speaker is now vacant. Peace.

Opinion: Willy comes from the woodworks to save Bobi Wine’s Petition

Now the long-gone Presidential Elections Petition of Robert Kyagulanyi aka Bobi Wine seems to be fetched by former Presidential Candidate Eng. Willy Maymbala. Mr. Mayambala suddenly comes out of nowhere to be the saviour of the day or the useful idiot depending on how you look at it.

Since, the Supreme Court Petition is useless neither way. The Courts will only validate the election and move on. It is all compromised and will not serve in favour of any opposition candidate. A person like Willy is only a pawn in a game chess. This will not change anything.

What is even more striking, is that NBS Television reported this on the man only two or three weeks ago:

“When asked about his financial status post-election on The Morning Breeze show, Mayambala said the elections left him poorer, jobless and down to earth. This is the situation for most politicians after elections, fr those who have lost, it is a double tragedy because they have to deal with the heavy debts without a source of income and for those who win, they have to clear their debts and deal with the pledges they made. It is a catch 22” (Freda Ajok – ‘Former Presidential Candidate Willy Mayambala Broke and Jobless After Elections’ 08.02.2021, NBS Television).

So, a man that is broke and jobless seeks relevance and a paycheck to revive a dying petition. This is clearly an attempt to stay relevant and have some sort of play in the public regard. Willy needs to be seen and get traction. He needs that to stay relevant and have any points of getting validated somewhere. Willy already ran a terrible campaign as an independent and didn’t get anything worth mentioning from election. The only thing he got was debt to deal with. That is surely not the detail he signed up for.

Clearly he does this to get a some traction, but how can a broke man be able to carry the expenses of a court case? How could he even have the funds to campaign and be a Presidential Candidate, when he has nothing when its ended? It is not like he was in the public ahead of the elections and neither been so after it all.

No, this is a publicity stunt and he maybe hopes the State House can bail him out. He has already stated his poverty earlier in the month. A jobless man with no money can clearly not carry a petition like this. Who will be his lawyers and be his attorneys in this case? Who will do that Pro-bono? Aye?

Free Willy, he needs redemption and that quickly. This is not cutting it. It is not funny. Just to breathe life into a dying horse. To validate the election and give Museveni the recognition he needs. So, that he can get the foreign donors of his back. As every “avenue” has been exhausted. Peace.

 

A Memo on Bobi Wine’s Bulletproof Vehicle

Well, so… Robert Kyagulanyi aka Bobi Wine got a bulletproof SUV as a gift from the diaspora and well-wishers from abroad. It was a gift given to him, because of how the state uses its security organizations and how they are going after him. This is to ensure the leaders safety and security with one measure at least.

However, what has unfolded since says more about the then it should have. First and foremost, they are probing and investigating who allowed it to happen. Secondly, they are warning that they might impound it and make it government property. However, that is really interfering in the givers and the diaspora’s will to donate to Bobi Wine.

Because, until recently… the state has had no issues with donations, gifts and grants to its enterprises. The state could offer deals for kickbacks and whatnot. So, its not like this is new. The President issued a legal remedy a few years back called “Presidential Handshake” where everyone involved in the Tax case with Heritage and Tullow got some extra “bonuses”. Even the brothers who photo-copied documents got a little fortune for the “hard” work in that case.

This vehicle is only showing how this state operates. There are people involved who have no issues and ensure things comes across borders with no fuzz. That is why it came in the hands of Bobi Wine who is practically very isolated and not allowed to do much in the grand sphere of things. Therefore, the state and its high-ranking officials is scratching their heads of the sudden pictures and thank you note from Bobi Wine.

These sorts of perks are only for the ones closely associated with the President or himself in that manner. The state doesn’t even provide these services to the huge entourage who is all eating on the plate of the Executive.

You could wonder and speculate, but the mere gist of it is… that only Yoweri is entitled to gifts like these. He can have planes, choppers, ranches, estates and businesses in his name all around. His plaque of himself across the Republic from schools to a water-tap. That is just what he does. But nobody else is supposed to do it. That is just for the Fountain of Honour himself.

However, the Fountain of Honour cars haven’t been shot at off late. That has happened to Bobi Wine while he was campaigning. That happened at least twice and was close to hit the passenger beside the driver. There were also shots at his tires in another district. So, its easily to say why he see the need for this vehicle with that equipment. When the state is so trigger-happy and aims at him.

This here is a foolish enterprise. It only shows what sort of state that is at play. Instead of showing maturity or sincerity. The state goes after the opposition who just got scraps. When the state own high-ranking officials is swimming in cash and perks. That is obvious to the naked eye. The double standard and the lack of care.

The vehicle is only showing the symptom of everything wrong with the state at this point. A man shouldn’t need that type of car with those specifics, but because of how the state operates. The man needs that type of car to shield himself from danger. Peace.

Opinion: Nyanzi’s obsession with the Bad Man from Kamwokya [isn’t doing her any good]

It is not long ago Dr. Stella Nyanzi left Kampala for Nairobi as she feared for her life post-election time. Everyone understood this and applauded her for leaving to secure herself and her kids shelter in Kenya. However, now that she is there…

Here activism isn’t fruitful or doing anything good. Only showing that her focus isn’t as clear as it needs to be. Nyanzi needs to either chill or ask for some guidance. Because, her two last poems only seems like a weird obsession. For someone who has been a Besigye fanatic and supporter. She should know what it does and why she joined Forum for Democratic Change (FDC).

Nyanzi lost her first election and that to the National Unity Platform candidate for Kampala Woman MP. The two last poems seems like she’s targeting Robert Kyagulanyi aka Bobi Wine. One is about his “bullet proof car” that the diaspora and his supporters abroad bought him. The other is about him sexually withdrawing mid-way from the Supreme Court. This is really her character now.

We know she has used sexuality and vulgar language. That is why she was arrested over “buttocks”. Therefore, this is not shocking… but her ways… now she is targeting Bobi Wine instead of Museveni. Wanting Bulletproof buses and cars for all citizens. Wondering, if she was as infuriate when Besigye made his a fortress and made new security features?

I don’t remember her fury and style of response to it. Maybe she wrote about everyone needed steel-reinforcement over the windows and windscreen. I cannot recollect that, maybe I don’t get the memo or the 16 bars of fury from the good doctor.

Nyanzi have worked for the cause and shown character. She has gone through a lot for her activism. Nyanzi deserves credit for that. Nevertheless, this here is a full wasteland. It is a such a sorry excuse from her. If she thinks this is her bread and butter. Good for her… but it is not doing any good.

It is just making trenches between the FDC and NUP. Instead of being on the same side trying to dismantle and remove a dictator. The Head of State get to see a battlefield between the ones on the other side. Museveni must be grinning and thinking…. Nyanzi couldn’t have served a better cold opening and be more self-destructive then this.

That is why even in a Open Letter on NRM.Co.Ug called her now a “comrade” and that says it all. Nyanzi should be so much better then this… but apparently this is her game right now. Instead of using her platform to advance the “defiance” or “Plan B” or anything else to challenge Museveni. She is busy going after Bobi Wine, because he isn’t acting in manner, which she is cool with.

Nevertheless, Nyanzi is maybe not the Bad Man’s crowd. Nyanzi maybe hope the international supporters will by her poems and next book. God knows what her next stage in her career. As her political gambit didn’t pay-off in the first play. She needs some sort of guidance. This isn’t it… unless, she wants less friends.

Bobi Wine has backers and they will help him out. Just like others have helped Besigye and other opposition candidates. This is just how the game goes. The diaspora cannot afford to shelter everyone. Neither can the backers of the FDC. Therefore, the former academic. Should ask for the safety from the government… who is the reason and the needs for bulletproof car and vest in the first place. The rigged court system and predetermined petition as well. Not like her party would even challenge an Presidential Election. So, why have trouble pulling out? When your man isn’t even trying to get it in the first place? He wasn’t even hitting that with his bare-feet?

Therefore, Nyanzi better call Kasangeti and get some feedback. We all understand why she left and that is within reason. Now, that she did that for her safety. She should be the first to understand why others see it important to safeguard their leader. Just like it was fine when Besigye added features to his own SUV back-in-the-day. It all made sense then and it does now.

Also, why have problems with withdrawal, when you men doesn’t even try to hit a shorty up? Your gang didn’t even join the dance and don’t even want to see if they have a shot in the first place? That’s because they have already been told in the past they weren’t all that in the past. This is why the FDC isn’t doing it.

Bobi Wine did campaign. The NUP did challenge within its capacity and they gotten much more weight in the game. It is not all lost. Neither is it for the FDC. However, they both need each other and can make it stronger. However, this bickering here is only making things weaker.

Nyanzi should know better, but maybe people like are asking to much. Maybe she has had enough and needs to vent indefinitely. Maybe she was scorned by the loss in the Election and blame the head of the party who made it happen. God knows, but I don’t….

Nevertheless… in this instance. Nyanzi is in the wrong and doing no good. Doing no good to herself and neither to her cause. If she want change and wants to make difference. She could be on the barricades, but here she’s throwing stones at a ally. Just because he got a car and shown the world how entangled the judges was with the dictator. However, that wasn’t enough for Nyanzi. Who is safe and sound in Nairobi. Peace.

Opinion: Bobi Wine needs to drop a scathing report on the 14th January 2021 Election

Now that the National Unity Platform (NUP) and Presidential Candidate Robert Kyagulanyi aka Bobi Wine is withdrawing his petition to the Supreme Court. Than he has to do something smart. The case itself and the petition … needed to be waterproof and prove “beyond reasonable doubt” and its close to impossible for the petitioner to prove the deficiencies in the General Election itself.

The NUP and Bobi Wine hopefully knew this and that is why they have tried to add amendments, affidavits and whatnot. The state and the court have dismissed that. They have downplayed and mocked Bobi Wine too. Chief Justice Dollo have sounded like a renegade brother of the President. He could just be his attorney and smile along. This was a predetermined case and no matter what Bobi Wine would have brought. He wouldn’t have received justice…

Now, on the 22^nd February 2021 the NUP and Bobi Wine needs to add the evidence together. The algorithms, the polling stations extravaganza and election violence as well. Putt it all together and show it bluntly in a document. Have the DR Forms in annex and everything else. Have the bail and bond notes. Sort together all the sort of pictures and shown the amount of abductions. Prove the malpractices and maladministration of the Electoral Commission and the other authorities.

All of this has to be made and dropped online. For the whole world to see. Make it a big report and a modern day ‘Pearl of Blood’ of 2021. That is what is needed to be done. In such a manner, which Uganda People’s Congress (UPC) tried in the early 1990s with their pieces too. To undress and prove the ills of society. That is what is needed now. Just to show the sinister, aggressive and the sort of approach the state did to “win” the election for Museveni this time around.

This wasn’t a contested election. It was open rigging and they are not even trying to conceal it. There is nothing honest about the approach or the ways they did do it. Every single of action and planned steps ahead was in favour the incumbent and his allies. They have secured the majority of Parliament without even trying. As they could field candidates and even in new districts, where the opposition couldn’t try. They were blocked and stopped from organizing… therefore, the “victory” is a false flag in itself. Doing the same thing Museveni said UPC was doing in 1980 election.

Bobi Wine needs make a giant report filled with details and evidence to such an extent. That the state and the authorities feels undermined. Also, in such a way that makes the citizens react too it. Not to forget, get the donors and international community to react and sway their opinion. Get them to grips with the bleak realities and figure out the status of things. Since, they look baffled and not understanding of the oppression and horrific acts towards the opposition in the Republic.

Bobi Wine and his party have a lot of work to do, but I believe they can do it. They have already made one smaller report and it would be grand to get giant report filled to the brim. Just to show the world the truth and the harsh environment, which they reside. Peace.

Opinion: Bobi Wine’s petition was predetermined to fail

When we heard that Robert Kyagulanyi aka Bobi Wine and his lawyers was bringing his Electoral Petition to the Supreme Court. Plenty of us knows that this is a foolish enterprise. It is not the sort of place to go to get your grievances sorted out. No, the Supreme Court is filled with appointees of the President. These residing Justices aren’t there to serve justice, but serve their master. These folks aren’t there to be free and fair, and according to the laws. No, they are there to secure the spoils and legitimize the election. That is why they are there.

What is important for Bobi Wine and National Unity Platform (NUP) was to collect evidence. Have proof of their allegations, have the affidavits and direct evidence according to the electoral law. Nevertheless, they have to prove it to such an extent. That its clear the petition will fail. The Electoral Law is so rigid and strict, that they can bend the arms of the petitioner and break the back of his attorneys. While the State Attorney and the men Representing the President can have a cake-walk to the Judgment Day.

We know this game is rigged and isn’t fair. When the Justices or Judges of the Supreme Court travels to meet one of the Respondents aka President Museveni at the State House Entebbe. That is just how things goes. It is not long ago since they were appointed either. That is just back in September 2020, Chief Justice, Alfonse Chigamoy Owiny – Dollo and his Deputy, Richard Buteera took an oath at the State House of Entebbe too. That was 4 months ahead of the polls, which now is in question.

It is not like these changes didn’t happen just in time ahead of the polls. Not like the President wouldn’t secure people he knew he could trust to deliver his will. These are token loyalists and that is why Dollo lost his composure this week. That just shows it all really.

It is a farce and a fraud. Just like the polls itself. Everything is just a slow-motion preparation for the glorious day and bash of glory at Kololo. Where the President will walk and swear himself in with fellow dictators and tyrants. Just so he can feel grand and magnificent. Be the majesty for a moment and feel the power at his fingertips. Because, that is what this is all about.

This Supreme Court hearing and petition isn’t about revealing the truth. This court case isn’t about the reality. No, the election was rigged and was a hack-job in favour of the Self-Styled President for Life. All means was used to win and nothing wasn’t done to deliver the “figures” needed. The state uses all part of its apparatus, state machinery and violent means to silence critics as well. Therefore, this petition is just a finalization to get legitimized. Even if it is all based on a lie.

The President wants to live on a lie, because he cannot bear the truth. The President cannot stomach or understand the truth. Because, if he did… he would fight himself and his whole being. It would hurt his pride, arrogance and whatever moral turpitude he posses at the moment. That is why the Supreme Court is only there to favour him and not really answer to the articles or electoral laws in question. These are just there to be fitted as they see fit, but not mean anything. As long as the result is a validation of the crown and the monarchy of one man.

Bobi Wine should after all is said and done. Just as he petitioned the United Nations. Just release a scathing report. Fill it with the affidavits, the technical evidence from the App and the DR Forms he has. Just file it all together. Show all the brutal violence. Timeline all of it and stamp the dates of the violence, abductions, arbitrary arrests and extra judicial killings. All of it compiled and dropped online. Make it public. Spread it to the winds and ensure the grand public. The media and everyone else get to see. Just to expose and show the sinister act of the state. The will to overturn the will of the people.

President Museveni and his Supreme Court cannot phantom the damage. The hurt and the devastation it can bring. The sort of play of unleashing all the skeletons and show the force, which the world should reckon with. It got too and it is about time. It isn’t fun and games, but a bloody battle for supremacy. This is the way the President is playing. Whatever happening now is just a show and finessing the game. It isn’t about rule of law or justice. Because under this regime. What the public is served is injustice.

That is the truth. Bobi Wine and NUP knows this. They are living in it and seeing the pain of standing up to the throne. He has dared to challenge it and shown his popularity. It isn’t a bargain chip, but a proof of how little regard the public has for Museveni now. He needs the army and the state to shelter him. There is no hut or home he can seek refuge in now. They will not allow him, unless he comes with guns and tear-gas.

Museveni will distort and fatigue all of this. Just as his done before. It is just a matter of how Bobi Wine plays this one out. He will never win the case in the courts. However, it is how he sways public opinions that matters now. Bobi Wine has used the legal route and follow protocol, but that will not serve him a victory. No, he got to do other things to overcome, but also make the President feel weak and fear him. Right now…

He thinks he got him and his caught in the same system as all his predecessors was too. In a game where Museveni knows the plan and the final say. However, Bobi Wine and his Team got to strategically plan out for a loss, but what to do next. As this will not be enough. The approach and idea is noble in itself, but it is not breaking the chains. It isn’t easy to go against it all and at every turn there is a new obstacle. Nevertheless, as unforgiving this sort of play is.

The NUP and Bobi Wine needs to realize, but not give up. That this Supreme Court petition was foolish one, but one that can give them sympathy. Even if it gives them nothing in return. The results won’t be in their favour and neither ill the outcome give any substance of credibility to their claims. No, they will be dismissed and non pertinent. That is just how these things are, as the predetermined game was already in motion.

Bobi Wine is just playing it and he got switch-up to win. Peace.
