About Time: A look into the Building Bridges Initative Report

What we are reading today is the results of the illegitimate elections of 2017. The Fresh Presidential Elections, the 26th October 2017, the ones where two dynasties didn’t get together in a free and fair elections. After the first elections of 2017 was on the 8th August 2017, which was happily dismissed and the IEBC had to make new elections in the same year. This was because, the verification of results and ballots was fraudulent. Not that the elections of October 2017 was any better, but the parties didn’t go all through it. Because, Raila Odinga and Uhuru Kenyatta had an handshake on the March 9th 2018.

So, today’s report is about this and the arrangement between the dynasties of Kenyatta and Odinga. They might have made it into a Taskforce, where they are Building Bridges to Unity or Building Bridges Initiative (BBI). This is an initiative made between them and not a direct public inquiry nor one made by the public for the public. This is the political elite finding new steps and statutes to settle grievances between themselves.

I will take some snippets from the 156 pages long report, but will not digress too much into it. As this is made for the parties and their own private interests. This is not for betterment of the Republic, but more for securing the facilitation of the current status quo and the leadership itself. To think otherwise, than the Fresh Presidential Elections of 2017 would have ended differently, just like the August polls did, earlier in the year. That is if this was free and fair, as it was forged results fitting one man and his elite.

Kenyans have God-given rights that must now stand alongside a Kenyan Charter of Citizen Responsibilities that is inspired by the National Anthem and the National Values, and includes a Patriot’s Pledge to the Nation and the Constitution of Kenya (for schools, workplaces, and official national and public events)” (BBI Report, November 2019).

As a Christian is a nice ideal to involve the faith in this manner, but still for a Republic and a pluralistic society and government, the BBI and the government itself should focus on the rule of law, constitutionalism and this to ensure the respect of laws for the citizens. What they are putting first is the faith and GOD, not what what should be put first from a governing perspective. Unless, the government is a church and a place of faith.

Prime Minister — Within a set number of days following the summoning of Parliament after an election, the President shall appoint as Prime Minister, an elected Member of the National Assembly from a political party having a majority of Members in the National Assembly or, if no political party has a majority, one who appears to have the support of a majority of MPs” (BBI Report, November 2019).

This is revitalizing the role of Raila Odinga, to have another one position in the cabinet and within government. That is to really have yet another big-man, so they have more leaders within the high-ranks. Instead of directly appointed by the President, the person is there on accord or consensus of the whole Parliament.

Leader of the Official Opposition — The runner-up of the Presidential election becomes an ex-officio Member of Parliament and the Leader of the Official Opposition if his or her party is not represented in the Government, or of a coalition of Parliamentary parties not represented in the Government” (…) “Question Time — The Opposition will play a key role in Prime Ministerial and

Ministerial Question Time sessions in Parliament. Question Time is an opportunity for MPs to question Government Ministers about matters for which they are responsible” (BBI Report, November 2019).

This is clearly made in the fashion of the Parliament in the United Kingdom. They are clearly wanting the Corbyn Versus Theresa May, they want the public to be squaring off between the opposition MPs and the Cabinet. To answer for themselves and to be accountable. Not only suddenly hold some Press Conference. This would be what this means. While also, letting the loser of the Presidential Election still having a place and a role in Parliament. That is to clearly give way and be viable, still after elections.

No Kenyan Left Out — The ‘Kubadili Plan’: As part of ensuring that all Kenyans have access to quality services which are foundational to putting people onto the path of shared prosperity, the Taskforce proposes a Kubadili Plan to bring marginalised wards to the level generally enjoyed by the rest of the country. The plan will be to identify the Wards which are most marginalised, at present and historically. Implementation should start with the Wards ranked last. Develop a plan to build schools, health facilities, roads, water, electricity, and police stations, in a way that the people of the whole Ward have access to them; and ensure that the facilities are built in all the Wards within a period of three years” (BBI Report, November 2019).

The ‘Kabadili Plan’ is just what the government is supposed to do, just on Ward level of government. This plan is what the government is supposed to do and isn’t a magic trick. This is just making it into a text and naming it something. The government are supposed to deliver basic needed services and this isn’t rocket science, but apparently the Taskforce see the current state not fit to do this.

Public Officers should not be in business with the Government — Address conflicts of interest by reducing Public Officer involvement in business with the Government” (BBI Report, November 2019).

Another basic one, as a person is in public office, shouldn’t have conflict of interests nor have the powers to give business advantages because of it. That is why many big-men in the past has given away or let their businesses into trusts, while they been in government. This should also be natural, also show what businesses the public officials, what sort of land and other assets they have. That will implicate them and also where they should recuse themselves from voting or participating in the process.

This is what I found as interesting within the report. It was a lot more, but this will be discussed. We can wonder what implications and what will be implemented by this report? Because, there is very little other than a big hoopla and not so much flash. We have to wonder if this will make any changes, if the Taskforce plans to bring forward Constitutional Amendments and other laws to reinforce what it t states?

That is if, this report has more value, than buying time for Kenyatta and Odinga. Because, unless something of this will be considered. There need to be more than launch and a final delivery of an report. This needs laws, motions and amendments, if they are sincere about what this one says.

Since, there is a lot of words and well-wishes, but not significantly addressed in the Report. They are talking of it in the conclusion, but then they are pushing the recommendations without considering what all might think of these. Some are good, but then again, this was a match between to parties not the whole Republic. Peace.

Lesotho: The Prime Minister and his Chinese Envoy…

Xie is probably the biggest corruptor in Lesotho”Mafa Sejanamane

We are living in interesting times, when the Kingdom of Lesotho and the political elite is corrupted by one man. In this day and age, the Prime Minister Thomas Thabane and his family is easily corrupted by the naturalized citizen from China, this being Xie Yan or “John”. His been an businessman since the 1990s in the Kingdom. He has had a convenience store and two building companies registered by 2011. But by now 2018, he had 24 registered companies in Kingdom, while his also appointed as a special envoy and trade advisor of the Prime Minister.

Xie Yan or “John” is really involved in all sort of affairs. If it is the Wool War or the Red Meat ban, his been involved and ensure some high stakes. With the knowledge of his rise, his enterprises growing, while his in “office”. That should be concern in itself. This is like the Gupta’s of South Africa, but a smaller scale in the Kingdom. The Gupta’s didn’t even have any office in the Zuma Presidency, but still had massive influence over state owned enterprises. Just imagine how “John” can deal with things from his close association and connection with the Prime Minister.

With that in mind, I have some articles, where the man is mentioned and revealed his character. Like he stated himself in October 2018: “The problem with governments in Lesotho is that ministers are very slow. Everything about them is slow. They don’t have powers to make decisions,” ( Lekhetho Ntsukunyane – ‘Thabane Chinese Advisor Attacks Government’ 15.10.2018, Centre for Investigative Journalism). Now that is cleared, look at what people say about him.

Xie, known universally in Lesotho as “John”, is a naturalised Mosotho who arrived in Lesotho from China in 1990 and built a business empire that includes supermarkets, construction, farming and quarrying. He topped the news agenda and stirred heated debate when Thabane appointed him “head of special projects and the prime minister’s special envoy and trade adviser on the China-Asia trade network” in August 2017, immediately after forming his new government” (Lekhetho Ntsukunyane – ‘Chinese business tycoon reveals how he helped fund politicians in Lesotho – but denies claim of state capture’ 01.11.2018, amaBhungane).

The Minister of Local Government and Chieftainship Affairs Mahala Molapo has asked the Directorate on Corruption and Economic Offences (DCEO) to speed up investigations into the awarding of the M340 million tender for the upgrading of Mpilo Boulevard Intersections. Last month the Principal Secretary (PS) of the Ministry of Local Government, Khothatso Tšooana, sensationally claimed that he was ordered to award the tender to a controversial Chinese businessman Yan Xie’s UNIK Construction Engineering company” (The Night’s Watch – ‘HEAT RISES FOR ‘MAESAIAH AND PHORI, THE 4X4 GOVERNMENT’S TOP LIABILITIES’ 07.11.2019).

Mafa Sejanamane, Lesotho’s ambassador to Ethiopia and a representative to the United Nations Economic Commission for Africa (UNECA), is a strong critic of Xie’s. In a lengthy editorial published by Lesotho’s MNN Center for Investigative Journalism this March, he wrote: “The picture which emerges out of Xie’s dealings is of an extremely devious person whose business modus operandi is one of a corruptor…Xie doesn’t care about those businesses as long as they are a front and a means through which he stays in the front seat for government tenders. He is a ruthless tenderpreneur. “Xie is probably the biggest corruptor in Lesotho,” Sejanamane concluded” (Lucy Papachristou – ‘Lesotho: Chinese Businessman Admits to Funding Top Politicians’ 06.11.2018, OCCRP).

I will end this part with the words of Lesotho Analysis:

Two things are important here:

a)all known businesses of Xie were closed while LRA went on with its investigations. It is not known whether and how much Xie settled his obligations since LRA does not disclose such issues about its clients unless there is a court order. But what is known is that Xie liquidated his businesses and months later resumed business under new companies. The old companies which owed LRA no longer existed. As a result of the closure and the liquidation of those companies a number of local companies which were owed money had no alternative but to write-off substantial amounts of moneys owed. One company whose records I have seen wrote off almost M500, 000 of the debts Xie’s company owed.

b) Xie also runs a lot of companies as a silent or a hidden partner. For example he ran a company called Jackpot Wholesalers which was under a different organisation as opposed to Jackpot Supermarket. He claimed then that he was not the owner but the financier of that wholesale. It was closed, but I have no confirmation that it was liquidated like the other companies. When a character who does this sort of shady dealings, whose involved in direct connection with Prime Minister and his cabinet. When his there and has the ability with his “office”. We can just imagine, how he will use his influence and possible funds to sway policies and regulations his way. To enforce his businesses and his associates. That wouldn’t be weird, but natural. To that extent, that his motivation is more money, easy monopolies and hopefully a sanctioned business-model, which gives astronomical growth for his companies.

As we have seen, in 2011 he had a few businesses, but by 2018 he had registered a dozen more. This while his been involved and knowingly helped the leadership of the day. With the help, he surely wants a “pay-off”, which will include kick-backs and government tenders. We can imagine the amounts scorned and funds eaten.

John” is taking the Kingdom of Lesotho for a fool. Thabane is facilitating it. Maybe, because John paid of his wedding and other family events. Maybe because John paid his rent while in exile. Who knows, but there is a relationship that is a gain for Xie Yan and not for the people. That should worry the King and his Court. Peace.

Opinion: Lt. Col. Nakalema aim wrong with her 4th December march

Lt. Colonel Edith Nakalema has today launched the first public march sponsored by the outfit she’s running. That will be a state owned march on the 4th December 2019 with the special guest, His Excellency, the Fountain of Honour, Yoweri Kaguta Museveni.

What is really colourful about this enterprise is the message and the slogan of it all. That is the beautiful wording of “A Corruption-Free Uganda: It Starts With Me”. It is really rich coming from the State House. Really ironic and special, that the unique Anti-Corruption Unit of the State House are usually catching the small fishes, but not touching the kitchen cabinet nor anyone in close association with the President.

That’s why its very rich of the State House and its outfit to have a theme like this. Like the people don’t know whose doing it and whose letting the grand corruption happen. The President has even accepted the Presidential Handshake. He has accepted that businesses get started, get tax-holidays as long as he gets kickbacks. Not like he will let any opportunity of a short-sighted funds go away. Even if it means selling the most prominent building in Kampala, Mabira Forest or anything else. As long as he can get something out of a deal, he will do it eventually.

President Museveni and his handlers will secure that, that’s why his not touched, even with abundance of agencies combatting and securing the government tenders, procurement and budget. However, none of them have ever had the capacity to arrest or charge Amama Mbabazi, Sam Kuteesa, Kahinda Otafiire, Elly Tumwiine and so-on. They are all living lavish, but came out of the bush-war piss-poor. You go figure how their wealth got started.

With this all in mind, the theme should be rewrote, “It Starts with the President”. That would have been accurate. It would have targeted the National Resistance Movement (NRM) and their cronies. Instead, they go after the chicken-thieves and the ones that has no power, no suction or connection within the deep administration. The ones who are rightfully wrong in their actions, misusing local government tenders, creating ghost teachers and whatnot. Still, the biggest culprits, the ones who does it on large scale, the ones who has made and forged the system. They are walking beside the President, they are appointed by him and are untouchables.

That’s why, if the Anti Corruption Unit was sincere, they would have targeted not “me” but the President, Museveni himself. But she did so, she wouldn’t see another day in her office. So, we do understand. She doesn’t want to bite the hand that feed her. We all get that, but if they wanted to be honest. The aim should be at the King, then you best not miss. Peace.

Opinion: Uhuru, wananchi are broke because of you…

“The President wondered where all the money being used to construct government projects is going. In fact, he specifically asked us the question: Why are people broke; why is it that there is no money in their pockets?” the official reported to be a parastatal head was quoted by the publication” (John Wanjohi – ‘I Don’t Understand Why Kenyans are Broke, Uhuru Says’ 12.11.2019, Mwakilishi.com).

President Uhuru Kenyatta must think people are gullible and ignorant to the facts. That they are not understanding the bigger picture nor the consequences of the actions made by the central government. Because, going around asking this sort of question, opens the door to wonder, how stupid does the President think the wananchi is?

President Kenyatta, first and foremost. It is your reign and your decisions that has made people out of pocket and broke. It is your government policies, your actions as head of state and the reactions to that. Which in the end, accumulate to the result of unemployment, poverty and the lack of cash to go-around. That is all because of you and your yes-men.

People have tried to blame Henry Rotich for this, but lets be clear. His the scapegoat. The Cabinet Secretary or the Minister, which is easy to aim at, but he has just sanctioned and followed protocol made by the President and his patronage. There is nothing else too it.

That is why with the growing corruption in the reign of Kenyatta, the added debt and the new cap or celling for debt. Just shows what it is all about. The free money of loans to shield the over spending government, which builds pipedreams and white elephants like there is no tomorrow. While wondering why people doesn’t earn coins on it. That is because, they don’t get the tender through shady companies like with the NYS Fund, neither do they get any direct benefit of the SGR. Secondly, non see the money for the maize scandals nor the sugar cartels too.

That’s why its like this, just like the crack-down betting firms, where the state banned one and opened up the gates for another one. There is no development, only more shady tricks. Just like the trade of milk and the standards put on that, which is ironic. Since the President himself is involved and owner of that. Plus all the estates, hotels and whatnot, both the President and the DP now owns. They have created empires while being in office, also ensuring the cronies get a cut too. While the state suffers a bondage and will have for generations, because this one borrowed fiscal stimuli like their was no tomorrow to begin with.

So, its better for Uhuru to not act a fool, but to actually do his job. He has been globetrotting and a vagabond as the President. Maybe time to cool down, not do PR stunts and empty pledges of the Big Four and the Building Bridges Initiative, but actually deliver something that matters. Not just empty expensive containers, which someone inside the Ministry of Health could profit from. Since, that is how the Jubilee government have operated on a large scale, with Grand Corruption in their veins and borrowing money at large too. Therefore, the lack of fiscal responsibility, nor any substance of development for the poor.

That’s why Kenyatta, that’s why you have not succeeded. You have reigned supreme since 2013, but your not leaving anything positive behind for 2021. Only more loans, bigger corruption scandals and a questionable legitimacy, as you rigged the last election and used Cambridge Analytica to massage your message to the masses. Which will not be forgotten. Peace.

Opinion: Sen. Imee Marcos cannot revise the plunder history of her family!

If we cannot punish old plunderers, we should stop pretending that we are out to punish the plunderers who came after them. If our people do see punishment for plunder past and present, then “plunder” would become a meaningless word added to our vocabulary” (Ruben Carranza – The Meaning of Plunder Past and Present, 2001)

Well, today was a special day, that the truth about the verdict about one court case against the family of Marcos in the Philippines. However, even if this is botched and dismissed court case because of lack of evidence. There is still plenty out there proving that this family has ill-gotten gains, has stolen and plundered. Just that they got away with it this time. That doesn’t revise nor free the legacy of the family, which became stupid-rich while being in power.

Today’s Botched Court:

MANILA, Philippines— It might have taken more than 30 years “to prove our innocence” but Senator Imee Marcos was grateful just the same. For lack of evidence, the Sandiganbayan has junked a civil case involving an alleged Marcos ill-gotten wealth worth P1.052 billion” (Malia Ager – ‘Imee Marcos: It took over 30 years to prove our innocence’ 08.10.2019, Inquirer.net).

Imee Marcos thinks she can revise history and suddenly take away the past of her family. It is natural that someone want their relatives to get a better legacy. However, the senator here is far off. If she thinks the botched plunder case now is freeing the history of Ferdinand Marcos or Imelda Marcos self. It is just a misstep in the courts. There is plenty of other cases and also foreign evidence of the actions done by her parents.

I’ll be dropping the titbits of information from Chaikin and the SARI, whose been investigating the money laundering, the illicit transfer of funds from the Philippines to Switzerland/Lichtenstein and elsewhere. To show what the Family Marcos did in their hey-day. Also, end with the court case, where the Marcos was deemed guilty of doing so in 1993 in a similar case. Therefore, the Marcos are far from “innocent” in the manner.

Like David Chaikin reported this in 2000: “A RICO claim brought in 1989 in California in the United States sets out in some 100 pages the details of how Ferdinand Marcos, Imelda Marcos and others conspired to loot, divert and launder public assets for their personal use and benefit. The RICO claim estimated that $5 billion in ill-gotten wealth was taken by the Marcoses, their associates and accomplices. But there is other material suggesting that Marcos took even greater amounts of money” (…) “The significance of the Malacanang documents is that they established investigatory leads concerning the secret Marcos assets in Switzerland. They provided the starting point for any analysis of the size of the Marcos’s Swiss wealth. Indeed, based on the Malacanang documentation and from other sources, in April 1986 the Philippines Government asserted that the Marcoses had accumulated illicit wealth of over $5 billion dollars, and that at least $1 billion had been transferred to Swiss bank account” (David Chaikin – ‘TRACKING THE PROCEEDS OF ORGANISED CRIME – THE MARCOS CASE, March 2000).

The Stolen Asset Recovery Initiative – Asset Recovery Watch updated on 20th July 2017 on the case of Ferdinand Marcos and Imelda Marcos (United States) or the ARW-63. The asset case that started in 1986 and ended in 2006. Which stated this: “According to a 2007 case study by Merceditas Gutierrez, Ombudsman of the Republic of Philippines, from 1986 to 2006, the total value of the assets recovered in the U.S. is less than $50 million. They include: (1) in New Jersey, funds in a bank account and two residences at Princeton Pike and Cherry Hill used by Marcos children (amount not given); (2) administrative settlement relating to four New York buildings (40 Wall Street, Crown Building, Herald Center, and at 200 Madison Avenue); (3) settlement agreements that led to recovery of properties such as the Olympic Tower Apartment, Pendleton Drive property, the Cedars, Summit Drive Beverly Hills, Lindenmere estate and the Makiki Heights property; (4) seizure of various jewelry, art, and other valuables; and (5) funds in Sanwa Bank and shares in California Overseas Bank and Redwood Bank” (StAR Stolen Asset Recovery Initiative – Asset Recovery Watch, 20.07.2017).

That is something from abroad, but if I go back into history in the year of 1993. This sort of case went differently: “Imelda R. Marcos was found guilty of corruption this morning and sentenced to 18 to 24 years in prison. The conviction came seven years after she and her husband, Ferdinand Marcos, were hounded out of the Philippines in a popular uprising. Mrs. Marcos clutched a rosary as her sentence was read in a special anti-corruption court. Outside the packed courtroom, crowds of her supporters held a vigil; opposite them, hundreds of anti-Marcos protesters cheered the former First Lady’s conviction” (New York Times – ‘MARCOS CONVICTED OF GRAFT IN MANILA’ 24.09.1993).

So, in another time, the courts would have done something else today. Still, the history of the Marcos will linger on. It will not be forgotten and the family is not vindicated like she claims. It is a reason why the previous Presidents have tried to recover funds from the plunder. That shouldn’t be forgotten in this matter.

It might been lack of evidence today, but if someone seriously wanted to follow the money. They might have gone to the other authorities that has kept things on file. Where they could have seen the accounts, the spending and even the estates in question. Still, the senator want to look innocent. Even if she knows perfectly well what happened. Peace.

Opinion: The inventor of the Presidential Handshake is incorruptible, apparently?

Do not be corrupt. Do not agree to take a bribe. I have never taken or accepted a bribe from anyone”Yoweri Kaguta Museveni at the National Prayer Breakfast (08.10.2019).

The man that has been known for having international investors at his state house before accepting the deals. The man whose accepted the Presidential Handshake as a pay-off for his civil servants. The President who was entangled together with his Foreign Minister in bribe and money laundering scheme landing the Chinese National Patrick Ho, 3 years in prison in the United States.

Suddenly, his a blessed man, whose never been bribed or accepted bribes. I have a hard time believing that. As all micro-managed infrastructure deals, all sorts of agreements are done with him in the picture. He decides if a developer, if a contractor gets their way. The President is connected and somewhere will get a kick-back. To think otherwise is naive.

That President Museveni thinks people are this stupid in the year of 2019. Is very special, it is unique and deliberate lying. A commandment that isn’t important to him, neither is the one about thieving either. Both of them has been done steady in years in office.

Maybe, the NRM and the President should look into their own cadres, should look into the High Command and the National Executive Committee. To see whose is who. This man cannot consider being serious or meaning the words coming out his mouth. Before looking at how he came out of poverty in the bush-war to be one of the richest on the continent three decades later. This being done, while having a don-ditto salary as President, but still eating more than plenty ministries every budget year.

Well, to say it easy this is non-sense. Wonderful and colourful words, which is common-sense. However, his actions over the years combined with the open knowledge. Make it sounds like the wrong person said it. That is it.

Mr. President maybe not accept handshakes, inside-deals and whatnot on your clock. Because, we know they do. Peace.

Opinion: Did the Anti-Corruption Unit at the State House overtake the IGG?

Irene Mulyagonja, the fourth Inspector General of General (IGG), who was appointed to this position in 2012. Are now six years later appointed to Courts of Appeals as a judge. A position she used to have since 2008, when she appointed as a High Court judge back-then. Therefore, she’s returning to her field of work after 7 years in “absence”.

What is clear is that the IGG has lost the mantle, haven’t been as focused or had the pivotal role as it could have had. However, that is not her fault. The state has established a new Anti-Corruption Unit in the State House. The IGG, had already competition with the Financial Intelligence Authority (FIA), the Public Procurement and Disposal of Public Assets Authority (PPDA) and the Uganda Investment Authority (UIA). Combined with the Office of the Attorney General (OAG), the Judiciary and the law-enforcement in general. Therefore, in the field of anti-corruption, there is a bit many chefs to compete with.

So, as an IGG she’s become more of a ghost. But that is because, well, the state has funded and created the State House initiative, which have put the others on the back-burner. Not like they have any prominence or reckoning of late. I cannot even remember a substantial report from either of the authorities in ages. That revealed something substantial or even investigated state owned enterprises nor the government tenders. Its been so little or nothing.

With this in mind, maybe it was a gift from the President to appoint her to the Courts of Appeals. So, she can use her skills, her experience and her knowledge to good use. Since it was wasted at the IGG.

We can hope this is greener pastures, maybe even a relief. Since, the hopelessness and the diverted fight against corruption must be boring. When the ones and cases are directed to the State House and not to the other authorities. Even if their mandate, their mission and their government position is more bearing in law and in print, than the one suddenly created last year.

Well, good luck at a new venture Irene Mulyagonja. We have to see who will be the fifth IGG and who will be the ghost in the machine. Because the role of the IGG has diminished with time. We can just wonder, why they bother even having it at this point and time? Peace.

Well, its about that time, another President and another Republic, where the public is chanting in the streets and starting a revolution. Because, they are tired of being pawns on the big-men’s game. They want to be seen, have a government that actually care and actually governs.

In our time, there several types of rulers, Jovenel Moise is a special kind of ruler. The one whose elected with no legitimacy. The whole election had about 20% voter turnout and out that 20% he got barely enough to have 55%.
