NYS-Scandal 2.0: A showdown in Court, but with no flair!

Today, there is clear evidence that the DPP Noordin Haji doesn’t build up cases or even deliver probable cause against the ones that is charged. If the DPP and the State Prosecution had followed up the case, the National Youth Service Scandal 2.0. This is nothing new in Kenya, as the Government of Kenya (GoK) and the Jubilee Administration have several of questionable transactions and misuse of funds. That is clearly known by the people and also by the DPP.

DPP Haji, if he was really serious about the NYS Scandal 2.0, they wouldn’t have made a case, had the trial and awaited the verdict without proper cause. That sounds unserious on the matter at hand, that the DPP and State Prosecution don’t have collected the needed evidence of the dubious transactions to fictitious companies and tenders. If the DPP really wanted this to go anyway, the state and himself would have delivered the proof of it.

Take a look!

The Director of Public Prosecutions (DPP) has with withdrawn corruption charges against 11 suspects linked to the second National Youth Service (NYS) scandal for lack of evidence. Charges against former NYS Deputy Director General Sammy Michuki, Rodgers Nzioka, Simon Kanyi, Steven Riungu, Josephat Njoroge, Lucas Otieno, Timothy Kiplagat, Charles Makau, Jackson Matego Juma, Humphrey Odhiambo, Bernard Masika were withdrawn under Section 87 A of the Criminal Procedure Code (CPC); this, however, means that should the state get any evidence implicating them in the case then they will be brought back before the court for prosecution” (Citizen TV Kenya, 07.01.2019).

We can really see what happen today, that is showing how the lack of work and proof is clearing people. The DPP and State Prosecution is at fault, not the Courts who cleared this Public Officials and appointed ones who are supposed to serve the public. We are just seeing, the cause and the effect.

This is a deliberate act by the DPP and the state, as a way to stop more prosecution of them. As the state failed to deliver proof of mischief or criminal intent, of thieving the state of funds from the NYS. That is actions happens as they followed. They are thinking they are fooling people. That the DPP lost a case, but seemingly this is the elite of untouchables, which the DPP cannot play around with. As they are people who are trusted by the President and Deputy President. They are people who are in high regard. That is why the DPP couldn’t really win the case or prove the corrupt behaviour, which was alleged, but not enough apparently.

The ghosts wasn’t proven, the fake tenders wasn’t either, because the state cannot touch these ones. As the DPP knows and we knows too.

They can play fools with ghosts, but we will not follow it. Because we are smarter and thinking more straight than that. The DPP are following orders, the Courts are getting a weak case. So the pieces of the puzzle matches and the ones charges get off the hook. They got shooked, but not took. Feel me?

Peace.

Opinion: Kadaga’s lifeline to Katuntu shows Parliamentary Rules are only for show!

That MP Abdu Katuntu gets to hold the Chair of the COSASE as the Speaker Rebecca Kadaga allows him to continue the Probe into Bank of Uganda (BoU) and the scandals it entails. This is like shady play, because if Katuntu are allowed to stay, what offers have they given to prolong his term as the chair of Committee in Parliament? Isn’t the legal protocol abiding for the lawmaker and MP?

Alas, that is just showing the mere disgraceful display of ignorance, the chronic cronyism and the patronage of the state. Even if Katuntu is waving the flag of an opposition party and being an MP for the Forum for Democratic Change (FDC). His acts of overstaying is the same of the ruling regime. He is just waiving differently in the elections, but when in power. The man has trouble emulating the ones he is supposed to oppose and defy.

That the Speaker Rebecca Kadaga allows the MP to be the Chair until the probe of the closure of banks done by BoU. Just shows the mere reflection of how the state doesn’t care about the laws or abiding to it. When it comes to their own. They trust Katuntu, that he will deliver the recommendations and the verdict that the state wants. If not, they wouldn’t have let him continue.

This even as the MPs are supposed to follow Rule 146, which sets an MP is only allowed to be 2,5 years at a Committee. That is clearly done, so they can ensure that they are getting more portfolio and not to connected in one field. As the connections and the cronies can team up, stop the back-log and also the lack of reports being discussed in the Plenary Session. Maybe, that is also why the Katuntu want to stay. As he has certain favours to uphold.

We can really question, as the final ending of the investigation of the BoU cannot be that important, unless the patronage around Kadaga and the President. Are planning to bury the report and make it as pointless, as certain other Parliament Reports, which are as stale as very old wall-paint after years of bad weather.

We can wonder why Kadaga fights over the rules made for the 10th Parliament, the rules made to ensure transparency and accountability of the Parliament. The 10th Parliament rules should be hold, especially by the Speaker. If the Speaker doesn’t care, should the chambers be invaded by strangers and also fake evidence for the Parliament, because if the terms doesn’t matter. Does anything else?

If the COSASE Committee terms becomes pointless, than what else is pointless dear Speaker? We can just wonder, why do the Parliament have protocol and guidelines anyway? If the Speaker doesn’t follow them or can change her mind?

That is how it looks like and how can we trust this probe, when the chair of the committee can just override the rules. Gets extended and violate the laws to finish a probe into dealings done by the BoU. We can really wonder if the report will be juicy or be watered down juice. Certainly, I cannot trust it now. Not that I ever did, but before, they at least acted like they cared about protocol. Now, it is just pointless exercise of power. Without any rules, as the Speaker can overrule everyone. As she wants. That is the memo, we have gotten this week. Peace.

UN Experts Report expose illegal Gold Export to Uganda!

Again and again, the UN Experts are getting validated sources of mineral exports, which are ending up in the hands of the Gold Refinery in Entebbe, Uganda and ending in Dubai, United Arab Emirates. These stories continues, as the National Resistance Movement (NRM) and President Museveni are taking advantage of the lack of authorities and control of the borders. That is why the Ugandan can get the illicit gold and earn fortunes of the trade.

They are forging documents and doing so by tricking customs and ways. To ensure, the gold goes from Bukavu to Entebbe into the hands of the AGR. The company, which happens to run by Gen. Salim Selah, the brother of the President. The State House of Uganda is earning fortunes on the illicit trade of gold and forging the gold sources even.

Take a look:

In addition, the Group found that Ugandan authorities lacked a coherent policy to combat smuggling. The Group also found that Kampala-based gold exporters did not have an efficient system to avoid the contamination of their supply chains with illegally traded gold from the Democratic Republic of the Congo” (…) “In fact, documents concerning a supplier for AGR obtained by the Group show the risk of contamination of the supply chain with gold illegally sourced or traded from the Democratic Republic of the Congo. The supplier, a Congolese national based in Bukavu who provided AGR, in October 2018, with gold worth more than $3 million, travelled with an official document, delivered five months earlier, identifying his occupation as that of an electrician. The supplier declared to AGR that the gold was sourced from the United Republic of Tanzania. Initial investigations conducted by the Group suggested that the individual was used as a broker by many Bukavu-based gold smugglers” (UNSC, 2018).

We have seen these stories before, its still vital and important to show, yet more evidence of the illegal export and illicit trading of the Congolese gold through Ugandan exporters, which happens to be in connection with the President and his brother Gen. Selah. This is common knowledge, but has to be addressed. As the ownership of the AGR is known and also, how that implicates the State House.

This is just a few statements of what they do, but still enough to prove how they do it. As this is very fresh reports and just out from the UNSC and their experts. Peace.

Let me take a sledgehammer to the Japanese dream of President Kenyatta!

Yesterdays Round-Table Interview with President Uhuru Kenyatta, really shows some PR Stunt out of this world. He thinks he can spin it beautifully on live-broadcast. Where the President can attribute the difference between a thriving economy and his own. Even if the Japanese has higher loan-grade of the GDP, they are exporting much more and have such an advanced economy compared to the Kenyan. This is well-known, but the President tries to flatter himself and ask of the journalist to speak like an economist. Well, that is to different professions, maybe, let economist David Ndii explain, before the PR stunt is shown yet again. Shall we?

David Ndii explaining:

Kenya’s SGR, Uhuru Kenyatta’s erstwhile legacy project, has turned out to be the bugbear that this columnist among others warned that it would be. Its freight capacity is a third of what was promised, and it cannot be competitive without a hefty public subsidy. Uhuru Kenyatta’s administration has increased Kenya’s foreign debt two and a half fold, from US$9 billion to US$25 billion. The railway alone accounts for a third of this increase; another third is by sovereign bonds for which the country has nothing to show” (David Ndii – ’CHINA’S DEBT IMPERIALISM: The Art of War by Other Means?’ 18.08.2018, link: https://www.theeastafricanreview.info/op-eds/2018/08/18/chinas-debt-imperialism-the-art-of-war-by-other-means/).

Here is Mr Masai’s conversation with the President:

President Kenyatta: Do you know what the debt of the Japanese government is?

Mr Masai: I’m not really concerned about Japan.

President Kenyatta: Do you know what the Kenyan debt is?

Mr Masai: As I said, right now it’s something between Sh4.5 to Sh4.8 trillion

President Kenyatta: No, no, no as a percentage of the GDP [gross domestic product], talk like an economist.

Mr Masai: 56 per cent of GDP

President Kenyatta: What is Japan’s debt?

Mr Masai: I’m not in Japan so I’m not interested in Japan but Kenya

President Kenyatta: Japan’s debt is over 100 per cent of the GDP” (Evelyn Musabi – ‘Why Mark Masai is trending after Uhuru roundtable interview’ 29.12.2018, link: https://www.nation.co.ke/news/Why-Mark-Masai-is-trending-after-Uhuru-roundtable-interview/1056-4913816-q3k0d/index.html).

As we have seen how a renown economist plays the Kenyan economy and how the President does it. We can really see how this plays out. The President are right about the levels of debt for the government of Japan, but that is domestic. While the growing debt of Kenya is foreign and to other nations. Which is a whole another level… Where the carefulness of paying back should be key for the Jubilee.

Also, the Kenyan is the107th largest export economy, while Japan is the 4th largest export economy. Therefore, the dynamics of the economies are different. Just by the mere recognition of this, should make the President shiver to compel them even. Just like the GDP per Capita is $3.16K in Kenya, while in Japan it is $42.3K. The last measure to prove how wrong it is, the ECON Complexity, the Kenyan is at 89th of 214, while the Japanese is 1st of 214. These numbers are all taken from the Observation of Economic Complexity (OEC). Therefore, they are saying a lot and shows why the President shouldn’t compare these economies and the loans they have. Especially, when you see the significant differences.

Kenya is miles away from Japan. They are not even close. They are so far apart, that the Kenyan better beg the Japanese advice to build their economy and not just borrow to build a railway. Peace.

Burundi: Is President Nkurunziza planning to move the capital now?

There are now reports and indications, as of the Council of Ministers have made an arrangement to work on a law, where the goal is for the political capital of Burundi to be moved from Bujumbura to second biggest city, Gitega. As it was the Second Minute from the Council of Ministers today.

This is clear indication that the President and his party are planning a move. That Pierre Nkurunziza has another giant project, than his own re-election in 2020. Something only a dictator would do, to make his mark.

What is special is that Nkurunziza had parts of his early life in Gitega and went to Secondary School there. So this would be going back to his roots. Gitega is also strategic in the geography of the Republic. But seemingly, the guess would be to get foreign donations and loans to sustain a move like this. As the Burundian government have felt the falling regard with donors. Not so strange, when several foreign NGOs are closing because they will not follow the new laws on ethnic employment standards, which the government has put on them.

Now, the CNDD-FDD and the Council of Ministers are planning a move, there are reports that the capital will be separate, that the Financial Part will still be in Bujumbura, but the political will be in Gitega. Than, its a partial move from the authorities. No matter what, this is move done on a purpose.

Either to solidify the CNDD-FDD and the Presidency with a giant symbolic project like this. If the President does this, he keeps his old promise from 2007. Maybe, at the same time, he should be able to raise funds to make the defunct airport working again. But, that would be a side-show in the schemes of things.

Gitega or Kitega Town was the town of the kings or the Mwami. That would be fitting for the Imboneza yamaho or the eternal leader of the Republic. His wishes has to be honored. Now that he is more secured, ensured the laws on his side and the all the branches of government follows him. He can move the Capital of the Kings. So, that he can be the eternal leader from where the kings reigned in the past.

It would make sense in that regard to move it there. As the Eternal Leader would follow the proud Kingdom of Burundi, even if the last king was killed there in 1972. He still would follow and continue that, as the Bujumbura would be where the money is, but the power would be in Gitega.

What is more rare, is that Bujumbura has about 497,000, while Gitega has about 22,000 citizens in it. Therefore, he sizes and vast difference is obvious. As the new capital would only be a power move and a way of diverting funds. Since the government would need massive changes and funding to make Gitega a viable political capital, like a National Assembly and other houses of the branches of government there. Which is today in Bujumbura. They would also need to inquire the allies and the ones with diplomatic mission to move, if they want to be close to sphere of power.

This is all, just mere speculations at this point. As the Parliament haven’t voted for the bill and it is in the works. The text of the law have not yet been leaked or any sort of draft either. Therefore, who knows the whole piece of the puzzle. However, this is a major move and an expensive one.

A clear message by the President and his party. That Nkurunziza are not fooling around and want it all his way. The Eternal Leader, in the town of the Kings and residing there would be more peaceful, than in Bujumbura. Peace.

Sudan: The people are revolting against the government!

The Republic of Sudan is in flames, as the public is tired of the Omer Al-Bashir regime and his reign. As the lack of economic progress or stagnation as it is. The bread-prices are rising and the Sudanese Pound is weakening towards the US Dollar. Therefore, the public has had enough this week, as demonstrations and protest has erupted through the Republic.

We know the government is alerted, as they have killed just during the last 24 hours at least eight demonstrators in Khartoum alone. Who knows the real numbers or fatal occurrences, as the state has blocked social media and internet through ZAIN Sudan and other companies.

We know the situation is dire, when not only the bread prices are sky-rocketing, but the fuel prices too. While the government has not given higher salaries or secured the public for the added costs of living. The soldiers are also lacking basic salaries, therefore, the whole system from the top is defunct.

We know the state is serious, when the state has blocked WhatsApp, Facebook and Twitter, in a game of trying to black-out information from the Republic to the world. As the world has to anticipate the next moves.

While the death has occurred, thanks to the Authorities cracking down on the ground. The Spokesperson and Minister of Information Bushara Aror claims the Police Force have been civil in their duties. Surely, the public outcry says something else.

The demonstrations, protests or riots are not only in Khartoum, but all over the republic. Its been in Nuhood, Post Sudan, Atbara, Damar and Hasaheesa. That was on the 19th December, but yesterday, it spread to Dongola, Kareema, Beber, Gadarif and beyond. Therefore, this a national protest against the state, not just the ones suffering in the capital, but in general.

This has to known, that the Sudanese are demonstrating against the decades after decades of reign for Al-Bashir, his cronyism and corruption, that his lack of respect for justice and rule of law. Is not under stated. That the man who has ruled with an iron fist. Is know seeing that the people are revolting against him. They have had enough. Peace.
